S-977 - 11/14/2000 - VARIATION - OrdinancesORDINANCE 2000- ZO -V -S -977 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF 9- 1 -10B, 9 -1 -10C and 9 -1 -1 OD OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS (32 Regent Drive, Oak Brook, IL 60523) WHEREAS, an application has been filed requesting a variation from the provisions of Sections 9- 1 -1016, 9 -1 -10C and 9 -11 OD of the Village Code of The Village of Oak Brook, as amended, reducing the building top of foundation to 2.2 feet above the base flood elevation rather than the required three feet; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals of the Village on October 3, 2000, pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by the said Zoning Board of Appeals that the variation requested be approved; and WHEREAS, this Board of Trustees of the Village of Oak Brook, having reviewed the proceedings before the Zoning Board of Appeals, finds that the applicant has demonstrated exceptional hardship and otherwise satisfied the standards of Section 9 -1 -9 of the Village Code of the Village of Oak Brook for the reasons enumerated in the Zoning Board's October 3, 2000 minutes; and WHEREAS, the corporate authorities of the Village of Oak Brook deem the passage of th1is ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oaks Brook; i NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE!VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby ado tedl as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section 9- 1 -10B, 9 -1,- 10C 'and 9 -1 -1 OD of the Village Code of the Village of Oak Brook to permit construction of a single- family residence 2.2 feet above the required base flood elevation instead of the required three feet as depicted on the Topographical Survey and Site Development Plan last revised Augul st 30, 2000 by Morris Engineering, Inc., a copy of which is incorporated herein by reference. Section 3: That this ordinance is limited and restricted to the property located at 32 Regent Drive, Oak Brook, Illinois, which property is legally described as follows: i Lot 257 in Brook Forest Unit Two, being a subdivision of part of Section 27, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, IL. Permanent Parcel No. 06- 34=406 -003. a7 Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 14th day of November, 2000.
