AN ORDINANCE AMENDING SECTION 5 -5 -2 ( "TAX IMPOSED ") OF CHAPTER 5
( "MUNICIPAL HOTEL TAX') OF TITLE 5 ( "MUNICIPAL TAXES')
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK
WHEREAS, 65 ILCS 5/8 -3 -14 authorizes the corporate authorities of any municipality to impose a
tax upon all persons engaged in the business of renting, leasing or letting rooms in a hotel; and
WHEREAS, by Ordinance G -451, passed and approved on September 25, 1990, the Village of
Oak Brook established a tax of 1% of the gross revenues for the rental, leasing or letting of rooms in a
hotel or motel (the "Hotel Tax ") on hotel and motel operators, and further established procedures for the
collection of the Hotel Tax; and
WHEREAS, the Board of Trustees of the Village of Oak Brook (the "Board ") has determined that it
is in the best interest of the Village to increase the Hotel Tax from one percent (1 %) to three percent (3 %);
and
WHEREAS, the Board has further determined that it is in the best interest of the Village to
establish a Hotel Beautification District (the "Hotel District ") to include public right -of -way and adjacent
properties along 22 "d from Illinois Route 83 to the east Village limits, along Spring Road from 22"d Street to
16th Street, and along Jorie Boulevard from 22nd Street to 31 St Street, and that certain of the Hotel Tax
revenues may be applied to the installation and maintenance of improvements in the Hotel District,
including landscape and hardscape features in the discretion of the Board, and
WHEREAS, the Board hereby finds that the creation of the Hotel District and the installation and
maintenance of improvements therein, will serve to promote tourism and conventions and attract
nonresident overnight visitors to the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That Section 5 -5 -2 ( "Tax Imposed ") of Chapter 5 ( "Municipal Hotel Tax ") of Title 5
( "Municipal Taxes ") of the Village Code of the Village of Oak Brook be amended as follows:
(a) By deleting paragraph B and substituting the following:
B. There is levied and imposed a tax of three percent (3 %) of the gross rental
receipts from the renting, leasing, or letting of rooms in a hotel or motel within the
Village, for each twenty -four (24) hour period or any portion thereof for which a
daily room charge is made, provided that the tax shall not be levied and imposed
on any permanent resident or on a person who works and lives in the same hotel
or motel.
(b) By adding a new paragraph F as follows:
F. There is hereby created a Hotel Beautification District to include public right -of-
way and adjacent properties along 22nd Street from Illinois Route 83 to the east
Village limits, along Spring Road from 22nd Street to 16th Street, and along Jorie

Boulevard from 22nd Street to 31 st Street. Certain of the tax revenues imposed
under paragraph B of this section may be applied to the installation and
maintenance of improvements in the District created herein, including landscape
and hardscape features, in the discretion of the Village Board, for the purpose of
promoting tourism and conventions and attracting nonresident overnight visitors
to the Village.
Section 3: That this ordinance shall be in full force and effect from and after its passage, approval
and publication in pamphlet form in the manner provided by law.
Section 4: That all ordinances or parts thereof in conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict.
