ORDINANCE 2007- ZO -V -S -1220
AN ORDINANCE GRANTING VARIATIONS FOR THE
DEVELOPMENT OF A GRAVEL PARKING LOT AND RELATED
IMPROVEMENTS AT 1315 AND 1425 KENSINGTON ROAD
IN THE VILLAGE OF OAK BROOK
(PIN 06 -26- 102 -008, 06 -26- 102 -009)
WHEREAS, an application has been filed by the Hawks Soccer Club (the "Petitioner ") on behalf
of the McDonald's Corporation, the property owner, requesting variations for the development of a gravel
parking lot and related improvements at 1315 and 1425 Kensington Road, Oak Brook, Illinois, and
WHEREAS, on September 4, 2007, the Zoning Board of Appeals conducted a public hearing on
the request for variations, pursuant to due and appropriate legal notice, and recommended approval of
the special use subject to certain conditions, and
WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the
factors required for approval of the requested variations and made specific findings, including that the
special use would be operated so that the public health, safety and welfare will be protected, and that
there will be no substantial injury to other property in the neighborhood, and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of
the Zoning Board of Appeals and deem the variations, as set forth below, to be in the best interest of the
Village
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows
Section 1 The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein
Section 2 The Petitioner is hereby granted variations for the development of a gravel parking lot
and related improvements at 1315 and 1425 Kensington Road, Oak Brook, Illinois, subject to the
following conditions
A The development shall be in substantial conformance with the plans as submitted and
revised specifically including, but not limited to the following
Variation to Section 13 -12 -4A of the Village Code to permit a gravel parking lot
instead of the required hard surface parking lot
2 Variation to Section 13 -12 -3C of the Village Code to eliminate the requirement to
depict parking lot stall dimensions
3 Variation to Sections 13- 12 -4B, C and D of the Village Code to eliminate the
requirement for parking lot landscaping and screening
4 Variation to Section 13 -12 -4G of the Village Code to eliminate the requirement to
install curbing of the access drive and parking lot
5 Variation to Section 13 -12 -4H of the Village Code to eliminate the requirement for
parking lot striping
B The Petitioner shall comply with all Village requirements for storm water management
C In the event that the Village needs access to the Kensington Road right -of -way, Petitioner
will not hinder access under any circumstances
D Final engineering approval
E All other provisions of Special Use Ordinances S -1050 and S -1211 are to remain in full
force and effect
Section 3 The variations and the scope of this ordinance are limited and restricted to the
property located at 1315 and 1425 Kensington Road, which is legally described as follows
LOT 1 IN MCDONALD'S AUTUMN OAK SUBDIVISION, BEING A SUBDIVISION OF
PART OF SECTION 26, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD
PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT OF SURVEY THEREOF
RECORDED JUNE 22, 1990 AS DOCUMENT R99- 77300, IN DUPAGE COUNTY,
ILLINOIS

Section 4 If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not effect any of the other provisions of this ordinance
Section 5 All ordinances or parts thereof in conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict
Section 6 This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law
