AN ORDINANCE ADOPTING A COMPREHENSIVE AMENDMENT TO CHAPTER 2
(VEHICLES FOR HIRE) OF TITLE 4 (BUSINESS AND LICENSE REGULATIONS)
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS
WHEREAS, the Village Clerk has recommended a comprehensive amendment to Chapter 2
(Vehicles For Hire) of Title 4 (Business and License Regulations) of the Village Code of the Village of Oak
Brook, and
WHEREAS, the Village President and Board of Trustees concur with the recommendation of the
Village Clerk and have determined that revision of Chapter 2 of Title 4 as provided herein will promote the
health, safety and violation of the public and the Village,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein
Section 2 That Chapter 2 (Vehicles For Hire) of Title 4 (Business and License Regulations) of
the Village Code of the Village of Oak Brook is hereby amended by deleting same in its entirety and
replacing that Chapter 2 as set forth in Exhibit A attached hereto and made a part hereof
Section 3 All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed
to the extent of the conflict
Section 4 This ordinance shall be in full force and effect from and after its passage, approval and
publication as required by law
Section 5. The Village Clerk is hereby authorized and directed to publish this ordinance in
pamphlet form in the manner provided by law

4 -2 -1 DEFINITIONS Unless otherwise expressly stated or the context clearly indicates a
different intention, the following terms, for the purposes of this Chapter shall have the meanings
indicated in this section

"operator" A person who drives or is licensed to drive a taxicab on the streets and ways
within the Village
"mileage" The distance in the rate of fare, as mechanically or electronically registered,
from the point of passenger pickup to the point of passenger delivery
"operator's permit" see "Taxicab Operator's Permit"
"owner" Every individual, person, trustee, partnership, association or corporation
owning, leasing, operating or having the use or control of one or more
taxicabs in the Village
"person" Includes natural persons, partnerships, associations, firms or corporations
"rate sheet" The schedule of rates and fares charged for the transport of persons in a
taxicab
"taxi stand" A place which has been designated by the Village as reserved exclusively for
the use of taxicabs
"taxicab" All vehicles driven by mechanical power used for the carriage of persons for
hire except buses and limousines as such terms are defined in the Illinois
Vehicle Code
"taxicab company" Every individual, trustee, partnership, association, firm, or corporation
engaged in business as a proprietor, franchisor or dispatcher of one or more
taxicabs
"taxicab license decal" That decal provided by the Village Clerk upon issuance of a taxicab
license pursuant to this Chapter to be displayed on each Taxicab as
evidence of license issuance
"taxicab operator's permit" That permit issued to the driver of a taxicab, pursuant to Section 4 -2-
5 of this chapter
"taximeter" Any mechanical, electrical or electronic device installed in a
Taxicab, which calculates and indicates the fares, measures the
distance traveled and time elapsed, and indicates other charges
which may be due
4 -2 -2 Taxicab Commissioner
A The Taxicab Commissioner (hereafter referred to as the Commissioner) shall
perform all the duties and functions of Commissioner as provided in this Chapter,
including, but not limited to, the following
1 Convening and presiding at certain hearings and meetings required by this
Chapter, and
2 Approving, denying, revoking and suspending licenses pursuant to the provisions
of this Chapter
B The Village Manager shall assume the duties of Commissioner The
Commissioner may at any time appoint a Deputy Commissioner, who shall have the
power to perform any of the duties of the commissioner hereunder (Ord G -569, 4 -9-
1996)
4 -2 -3 Taxicab Company Licenses.
A No taxicab shall be operated upon streets and ways within the Village, nor shall any
taxicab company engage in business, unless there shall first have been obtained therefor
licenses from the Village Clerk Such taxicab licenses shall be issued for the term of the
licensing year, April 1 through March 31, or such part thereof as remains at the time the
license is applied for, and shall be effective for such period of time unless sooner suspended
or revoked The full yearly license fee shall be charged no matter when the license is applied
for or issued
B Applications shall be made by the taxicab company, in writing, to the Village Clerk on
forms as reasonably required and approved by the Village Manager A license fee of two
hundred dollars ($200 00) shall be submitted with the application If the application is for
renewal of a taxicab company license, the application shall be submitted to the Village Clerk
no later than thirty (30) days prior to expiration of the current license Renewal Applications
filed after this deadline shall be considered a late filing but shall be accepted by the Village
Clerk provided a late filing fee of fifty dollars ($50 00) is submitted with the application and
license fee Taxicab companies shall be required to include in the application a true
statement of certain facts including, but not limited to the state of incorporation of the taxicab
company if the company is a corporation, whether the company is organized and qualified to
do business under the laws of the state if it is a corporation, the taxicab company's principal
place of business, the full names and addresses of the individuals who own the taxicab
company, whether the taxicab company is a corporation, partnership or sole proprietorship,
and the registered agent of the corporate taxicab company The full names, dates of birth
and residential addresses of persons having an ownership interest of five percent (5 %) or
more in the taxicab company shall be disclosed on the application.
C A rate sheet to be in effect for the period of the taxicab company license shall be
included as part of the application
D The Taxicab Company shall comply with the following requirements, to wit
The applicant shall be required to file with the Village Clerk, as part of its application
for a taxicab company license, a certificate of insurance issued by a solvent
company authorized to do business in the state and approved by the Village
Attorney, insuring the taxicab company and owners of all taxicabs for which licenses
are sought, its drivers (operators) and employees against liability for any damage or
injury to, including death of, any person and for damage or injury to property resulting
from the negligence of such licensee, owner, operators, employees or any other
agent in the operation of such vehicle Such policy of insurance may cover one or
more vehicles. Taxicab companies having taxicabs operated by independent
contractors must cause each operator to provide proof of automobile liability
insurance for each taxicab registered pursuant to this Chapter or provide the
required insurance on behalf of such independent contractor
2 The limits of liability shall be, with respect to each vehicle covered by such policy, not
less than three hundred thousand dollars ($300,000) combined single limit, each
accident or such other amount as required by Illinois State Statute (625 ILCS 5/8-
109) Such policy of insurance shall provide for the payment and satisfaction of any
final judgment rendered against the licensee or owner of such vehicle for both
damage to property and for personal injury, including death
3 The policy shall be further endorsed to provide thirty (30) day advance written notice
of any cancellation thereof to the Village Clerk In the event the insurance coverage
required under this section is cancelled, the taxicab company license and all taxicab
vehicle licenses and taxicab operator's licenses relating to such taxicab company
shall immediately terminate as of the effective date of such insurance termination
unless a substitute policy of insurance complying with the provisions of this Section
is provided to the Village prior to the effective date of the insurance cancellation
4 In the event that a final judgment or claim has been paid by any indemnitor or
insurance policy, as a result of which the original amount of coverage required herein
is proportionately reduced, all licenses issued pursuant to the authority granted by
this Chapter to the affected taxicab company, its vehicles and operators shall be
immediately terminated subject to reinstatement, within thirty (30) days, by
replacement of the coverage so reduced
5 All licensed taxicab companies shall provide proof of automobile liability insurance
for each taxicab registered pursuant to this Chapter Such proof of insurance must
be carried in each individual taxicab licensed pursuant to this Chapter at all times
and shall be made available to any person involved in an accident at the time of such
accident
E The Taxicab Company, along with its application for a taxicab company license shall
license or cause to be licensed each individual taxicab operated by, for or on behalf of such
company within the Village, in accordance with Section 4 -2 -3
F The Village shall investigate to the extent that the Police Department deems
necessary the owner(s) of the applicant taxicab company, including each officer, general
partner, sole proprietor and all persons having an ownership interest of five percent (5 %) or
more of any such applicant If this investigation of the application material reveals
information showing any of the following, the application shall not be approved and no license
shall be issued to the taxicab company
The owner or an officer, shareholder or director of the owner, has been convicted of
a felony based upon the taxicab business or similar business within the past ten (10)
years,
2 The owner or an officer, shareholder or director of the owner, has been convicted of
a felony or misdemeanor unrelated to the taxicab business or similar business which
felony or misdemeanor involves any of the following offenses
(i) unlawful possession with the intent to deliver any Controlled Substance, as
such term is defined in the Illinois Controlled Substances Act (720 ILCS
570/100 et seq ), as amended from time to time, or Cannabis as defined in
the Cannabis Control Act (720 ILCS 550/1 et seq ), as amended from time
to time, or an Intoxicating Compound as listed or defined in the Intoxicating
Compounds Act (720 ILCS 690/0 01 et seq ), as amended from time to
time, within the past ten (10) years, or
unlawful possession of any Controlled Substance, Cannabis or Intoxicating
Compound, within the past five (5) years, or
Any sex offense as such offenses are defined in the Illinois Criminal Code
720 ILCS 5/1 -1 et seq , or any like offense of another state or country,
within the past ten (10) years, or
(iv) any offense involving violence against another person or threatened
violence against another person under the Illinois Criminal Code 720 ILCS
5/1 -1 et seq or any like offense of another state or country, within the past
ten (10) years, or
(v) any offense involving moral turpitude, including, but not limited to any
offense involving the misapplication, misappropriation or misuse of funds of
another person, within the past five (5) years
3 An owner or officers, shareholder or director of the owner, has been convicted of a
misdemeanor based upon conduct or involvement in the taxicab business or similar
business within the past five (5) years, or
4 The owner or officer, shareholder or director of the owner, has misrepresented or
omitted material facts in the application for a license
G The taxicab company licensee shall be responsible for the acts, omissions and
general conduct of persons operating a taxicab for, on behalf of or with the permission of
such taxicab company The taxicab company shall, periodically during the term of each
annual license, determine if its taxicab operators continue to meet the qualifications set forth
in this Chapter and shall promptly inform the Village Clerk of the names of any such operators
who fail to so qualify
H If a licensee holding a taxicab company license under this chapter shall change its
principal place of business, it shall notify the Village Clerk in writing Upon receipt of such
notification, the Village Clerk shall make the necessary alterations to her records No fee
shall be required for a change in the principal place of business of the company If ownership
of a cab company licensed under this Chapter shall be conveyed to a new owner, said new
owner shall apply for a new license in its name in accordance with the procedures and
standards set forth in this Section There shall be no transfer of a license from one owner of
a business to another
I There shall be no limit on the number of taxicab company licenses nor on the number
of taxicab vehicle licenses
J If the taxicab company provides no service in the Village for a period of ten (10)
consecutive days, the Village Manager, upon hearing, after not less than five (5) days' notice
to the owner, may thereupon revoke the license of such taxicab company
4 -2 -4 Taxicab Vehicle License, Vehicle Requirements
A No taxicab vehicle shall be operated upon the streets and ways of the Village unless
there shall first have been obtained for each such vehicle a taxicab vehicle license The
requirements of this Section 4 -2 -4 shall be in addition to those of Section 4 -2 -3, relating to
taxicab company licenses
B Applications shall be made to the Village Clerk on forms reasonably required and
approved by the Taxicab Commissioner A license fee of twenty five dollars ($25 00) per
vehicle shall be submitted with the application The following information for each taxicab to
be licensed shall be provided
1 The year, make, color and vehicle identification number,
2 Name, address and telephone number of the owner,
3 Written certification that required safety inspections of the taxicab and inspection of
the taximeter have been completed not more than thirty (30) days prior to the date of
application and that such inspections find the taxicab to be safe and the taximeter to
be in proper working order and accurate
4 During the term of any license issued to a taxicab company, if the company
substitutes another taxicab for any taxicab licensed with the Village pursuant to this
Section, or adds any additional taxicab to the list of licensed taxicabs, the company
shall license such substitute or additional taxicab with the Village pursuant to this
Section
C All taxicabs licensed by the Village of Oak Brook are subject to periodic inspection by
the Oak Brook Police Department, as required by the Taxicab Commissioner and the taxicab
company shall promptly upon notice from the Police Department make said taxicab available
for inspection
D Every taxicab operated by a taxicab company licensed by the Village, shall be
identified on or in the taxicab, as follows
1 On the center of the exterior main panel of the front or rear doors of each such
taxicab, there shall appear the cab number assigned by the taxicab company and
the taxicab company's name and telephone number,
2 On the back of the front seat, clearly visible to passengers in the rear seat of the
vehicle, there shall be affixed a copy of the taxicab company and taxicab operator's
permit in plainly legible print, the telephone number of the cab company, and the
rates charged for trips inside and outside of the Village,
3 All taxicabs owned or operated by or on behalf of a taxicab business licensee shall
be identically painted so that they are readily identifiable However, no coloring
scheme or name shall be similar to that of any other taxicab company who has
previously been issued a taxicab license by the Village
E The condition of taxicabs licensed by the Village shall be as follows
1 Every taxicab operated in the Village by a taxicab company licensed by the Village
shall be maintained in a safe condition at all times If any taxicab shall become
unsafe for operation or if its body or seating facilities shall be so damaged as to
render the taxicab unfit for public use, the Taxicab Commissioner may, after hearing,
suspend the license issued to the taxicab company operating that vehicle, or
suspend that taxicab vehicle license, until the vehicle is made safe for use by the
public or replaced with a vehicle that complies with this Chapter
2 All doors of every taxicab shall have functional interior door handles and latches
3 In addition to the requirements in Subsection (F) of this Section every taxicab
operated by a taxicab licensed in the Village shall meet the following standards while
in service in the Village
(i) The vehicle's exterior appearance including paint, lettering and chrome shall
be in good condition and free from excessive rust, and
The vehicle's interior shall be clean, sanitary and the upholstery shall be in
good repair
F Each taxicab operated by a licensed taxicab company within the Village shall provide
seat belts for each passenger, provide entrances and exits free of interior barriers and have a
sufficient number of exits to permit every passenger and the driver to exit from the vehicle in
the event that one side is rendered impassible as the result of an accident, safety conditions
or otherwise
G Every taxicab operated by a taxicab company licensed by the Village shall be
equipped with a taximeter, in good working order, connected with and operating from the
transmission of the taxicab No taxicab license shall be issued for any taxicab until the
taximeter therein meets the following requirements
Taximeters shall have a lighted dial or dials to register the fare in accordance with
lawful rates as set forth herein and the dial shall at all times be maintained by the
taxicab company in plain view and readable by the passenger Such taximeter shall
also properly and accurately register, indicate and display the time consumed by the
taxicab while in waiting, the distance traveled and the amount of fare to be
determined and charged therefor
2 Each taxicab shall, during the period between sunset and sunrise, be equipped with
a light which shall enable the passenger engaging and using such taxicab to read the
figures indicated thereon Every taximeter placed on a taxicab shall be so arranged
that the dial thereof is in plain view of the passenger while riding in such taxicab, or
upon alighting from the same
3 Prior to licensing and if required by the Taxicab Commissioner, inspection of the
taximeter shall be conducted by the Village as follows
(i) No taximeter shall be attached to a taxicab unless it has been inspected by
an inspector approved by the Police Department and found to be accurate
and sealed by such inspector The Taxicab Company shall keep certificates
of accuracy issued by the inspector for each taximeter in each taxicab and
provide the same for inspection by a passenger or any police officer upon
request The expense for such inspections shall be that of the licensee
Each taximeter shall be inspected annually not more than thirty (30) days
prior to March 31, or such other date set by the Police Chief or his designee,
and a certificate of accuracy, as provided above, shall be submitted by the
cab company to the Village Clerk prior to the renewal of the taxicab
company license In the event a complaint is made that any taximeter
registers improperly or inaccurately, the Police Chief or his designee shall
immediately examine and inspect or cause such examination and inspection
of such taximeter complained of Upon request by the Chief of Police, the
taxicab company shall submit any taximeter installed on a taxicab to an
inspection to determine its accuracy
Every taximeter shall be tested by running the taxicab to which it is attached
over a course of standard mile -in- length or by a mechanical test to prove the
accuracy of the register thereof Either of the foregoing tests may be
selected at the discretion of the Chief of Police In order to determine
whether such taximeter correctly registers "waiting time," it shall be the duty
of the Chief of Police, his designee or a testing firm approved by him to test
such taximeter by comparing the time recorded as shown by the fare
computed on the dial thereof with the standard time Such tests shall
ensure that the taximeter correctly registers those rates and fares
authorized by this Chapter
4 No person shall detach any certified or inspected taximeter from any taxicab and
attach the same to any other taxicab, the front wheels of which are of different
diameter from those with reference to which the taximeter was originally tested,
unless a new inspection of certification is had on such taximeter
5 No taxicab driver or taxicab company shall operate a taxicab with a taximeter that is
inaccurate, that has not been inspected as provided herein, or that is otherwise not in
compliance with the provisions of this Chapter
6 It shall be unlawful for any person to tamper with a taximeter or to break any seal
thereon,
7 No driver of a taxicab equipped with a taximeter while carrying passengers or under
employment, shall display the signal affixed to such taximeter or other similar device
in such a position as to denote that he is employed at a rate of fare different from
that to which he is entitled under the provisions of this Chapter
8 The Village Clerk shall from time to time issue a list of private firms authorized to
perform taximeter inspections
E Every taxicab operated by a taxicab company shall pass mechanical inspection tests
as specified by the Village The inspections must take place not more than thirty (30) days
prior to application for a taxicab license or the renewal of such license The inspections will
take place at a firm or firms designated from time to time by the Village The expense for
such inspection shall be that of the licensee No license shall be issued for any taxicab that
fails to meet these inspection requirements The Taxicab Commissioner shall from time to
time issue a list of private firms which are authorized to perform vehicle safety (mechanical)
inspections
4 -2 -5 Taxicab Operator's Permit
A It shall be unlawful for any person to operate a taxicab for a taxicab company
licensed by the Village unless that person has been issued a permit by the Village It shall be
unlawful for any person to operate a taxicab that is not properly licensed pursuant to Section
4 -2 -3 herein No taxicab operator's permit shall be issued unless the requirements relating to
taxicab companies set forth in Section 4 -2 -3 and the requirements of this Section 4 -2 -5
have been satisfied
B Operator Qualifications Each operator who shall drive any taxicab in the Village
shall at all times meet the following qualifications
Possess a valid State of Illinois driver's license of a classification required by State
law for the transport of persons for hire,
2 Be twenty -one (21) years of age or older,
3 Be in good physical condition, and shall not have any nervous, organic, or functional
condition or disease which is likely to interfere with the safe performance of his or
her duties as an operator, and
4 Be able to read, write and speak the English language, as determined by a test
administered by the Village Clerk Such test shall consist of the applicant completing
the taxicab operator's permit application in the presence of the Village Clerk or her
designee
5 Have a Secretary of State's driving abstract showing no convictions for any of the
following offenses
(1) driving under the influence of a controlled substance, cannabis or an
intoxicating compound (625 ILCS 5/11 -501 et seq ) or similar provision of a
local ordinance or any like offense of another state or country within the past
five (5) years, and
(ii) reckless driving (625 ILLS 5/1 -503 et seq ) or a similar provision of a local
ordinance or any like offense of another state or country, within the past five
(5) years, and
(iii) any offense originally charged as listed under subparagraphs (i) or (iii)
above and later reduced to gny negotiated lesser offense, within the past
five (5) years
C The application for a taxicab operator's permit shall be approved by the Taxicab
Commissioner or his designee and a taxicab operator's permit issued pursuant to and in
accordance with the following rules and regulations
1 Application shall be made by the operator, in writing, to the Village Clerk on a form
reasonably required and approved by the Taxicab Commissioner Prior to issuance
of the permit, a non - refundable license application fee of fifty dollars ($50 00) shall
be paid
2 The operator shall be required to include in the application a true statement of
certain facts including, but not limited to, the name and address of the operator, the
age and date of birth of the operator, the driving convictions of the operator, the type
and class of driver's license of the operator, convictions for the use, possession or
sale of controlled substances, cannabis or intoxicating compounds, any felony or
misdemeanor convictions of the operator - applicant, the home address and
telephone number of the operator All such information shall be provided under oath
3 At the time of application, the driver shall submit his /her driving abstract obtained
from and certified by the Illinois Secretary of State's Office dated not more than thirty
(30) days prior to the submittal of the application for a license
4 At the time of application, the operator shall submit a photograph of himself or
herself for the purpose of having his /her photograph taken, which photo shall clearly
and accurately show the applicant's face and shoulders
D The Police Chief or his designee shall investigate the applicant for a taxicab
operator's permit If this investigation or the application materials reveal that the statements
made as part of the application are inaccurate or reveal information showing any of the
following, the application shall not be approved and no taxicab operator's license shall be
issued to the applicant
1 The applicant has been convicted of a felony based upon his /her conduct or
involvement in such business activity or similar business within the past ten (10)
years,
2 The applicant has been convicted of a felony or misdemeanor unrelated to his /her
conduct or involvement in such business activity or similar business, which felony or
misdemeanor involves any of the following offenses
(1) unlawful possession with the intent to deliver any Controlled Substance, as
such term is defined in the Illinois Controlled Substances Act (720 ILCS
570/100 et seq ), as amended from time to time, or cannabis as defined in
the Cannabis Control Act (720 ILCS 550/1 et seq ), as amended from time
to time, or an Intoxicating Compound as listed or defined in the Intoxicating
Compounds Act (720 ILCS 690/0 01 et seq ), as amended from time to
time, or any like offense of another state or country within the past ten (10)
years, or
(i1) unlawful possession of any Controlled Substance, Cannabis or Intoxicating
Compound, within the past five (5) years, or
(iii) Any sex offense as such offenses are defined in the Illinois Criminal Code
720 ILCS 5/1 -1 et seq , or any like offense of another state or country,
within the past ten (10) years, or
(iv) any offense involving violence against another person or threatened
violence against another person under the Illinois Criminal Code (720 ILCS
5/1 -1 et seq ) or any like offense of another state or country, within the past
ten (10) years, or
(v) any offense involving moral turpitude, including, but not limited to any
offense involving the misapplication, misappropriation or misuse of funds of
another person, within the past five (5) years
3 The applicant has been convicted of driving under the influence of a controlled
substance, cannabis or an intoxicating compound under Illinois law (625 ILCS 5/11-
501 et seq ) as amended from time to time or similar provision of a local ordinance
or any like offense of another state or country, within the past five (5) years
4 The applicant has been convicted of reckless driving under Illinois law (625 ILCS
5/11 -503 et seq ) as amended from time to time or similar provision of a local
ordinance or any like offense of another state or country within the past five (5)
years
E No taxicab operator's permit shall be assigned or transferred to any other person
Upon issuance of a taxicab operator's permit, the operator shall at all times when operating a
taxicab in the Village carry a permit card that contains his /her name, permit number and year
for which the permit is valid The taxicab operator shall show the card to any person
requesting to see it at anytime the operator is operating the taxicab
F The term of all operator, permits issued under the provisions of this Chapter shall be
for the license year, and in every case shall expire at the end of the last day of March of the
license year The full yearly permit fee shall be charged regardless of when the permit is
applied for or issued
4 -2 -6 Use of Taxicabs
A It shall be unlawful to refuse any person transportation in a taxicab to any place of
destination within the Village in a taxicab that is unoccupied by a passenger for hire, unless
such taxicab is on its way to pick up a passenger or otherwise out of service or unless the
person to be served appears intoxicated or uses profane or abusive language in attempting
to contract for service When the taxicab is out of service or carrying a passenger, there
shall be displayed on the taxicab, and visible to those outside the taxicab, a sign or light
indicating the taxicab is "not for hire" in letters at least two inches (2 ") in height
B Group riding is permitted in taxicabs, provided, that the operator accepts no more
than five (5) passengers for any trip, and provided that the fare charged to any passenger will
be no greater than as permitted by this Chapter
C Additional passengers picked up subsequent to an original flag pull may be picked up
with the consent of the passenger first employing the taxicab and will be charged for the
prorated meter reading as determined by the operator
4 -2 -7 Conduct of Taxicab Operators
A It shall be unlawful for any operator to conduct himself in a disrespectful or
contemptuous manner toward any person, or to use abusive or profane language while so
occupied or in charge of such vehicle
B It shall be unlawful for any operator to solicit by word, gesture or otherwise the
patronage of any person upon any public street or place in the Village
C It shall be unlawful for any operator to seek employment by repeatedly and
persistently driving taxicab about the streets of the Village or otherwise interfering with the
proper and orderly access to or egress from any theater, hotel or other place of public
gathering
D Operators shall be obligated to render reasonable aid to any person who suffers
injury or illness while a passenger of a taxicab operated by the operator
E It shall be unlawful for any operator to use, possess or be under the influence of any
controlled substance, cannabis or intoxicating compound when operating a taxicab
F It shall be unlawful for any operator to violate any provision of this Chapter
4 -2 -8 Rates and Fares
A No person owning, operating or controlling any taxicab within the limits of the Village
shall charge in excess of the rates and fares shown on the current rate sheet on file with the
Village Clerk and as determined by the taximeter Rates and fares may be revised by the
taxicab company at any time, provided the taxicab company files a revised rate sheet with the
Village Clerk prior to the imposition of such revised rates and fees
B Waiting time shall include the time when the taxicab is not in motion beginning within
a reasonable time after arrival at the place to which it had been called, or the time consumed
while standing at the direction of the passenger, or time consumed while standing because of
conditions beyond control of the operator, but no charge shall be made for time lost for
inefficiency of the taxicab or its operator or time consumed by premature response to a call
C A schedule of the rates and fares authorized herein shall be prominently and clearly
displayed in each taxicab by affixing a notice containing same on or to the rear of the front
seat of each taxicab The size of such notice and the manner of its display shall be in
accordance with regulations therefor promulgated by the Village Clerk It shall be unlawful to
refuse or fail to display the schedule of rates and fares as required herein
D No taxicab operator shall charge or attempt to charge any passenger a fare greater
than that to which such operator is entitled under the provisions of this Chapter When the
Village is notified of a rate change during the period of the license, the taxicab company shall
place corrective stickers on the previously issued license to reflect the new rate
E Every taxicab operator shall have the right to demand payment of the legal fare in
advance and may refuse employment unless prepaid, but no operator of a taxicab shall
otherwise refuse or neglect to convey any orderly person upon request anywhere in the
Village unless previously engaged or unable to do so
F If demanded by the passenger, the taxicab operator shall deliver to the person paying
for the hiring of the same at the time of such payment, a receipt therefor in legible type or
writing containing the name of the owner or operator, the municipal license number or the
operator's permit number, or the taximeter number and any items for which a charge is
made, the total amount paid and the date of payment
G This Chapter shall not affect the right of a duly licensed taxicab company operating
duly licensed taxicabs to enter into private contracts, whether verbal or written, with any
person, firm or corporation, for a regular carrying for hire of special persons or groups, as the
parties may contract However, nothing in this section shall authorize any taxicab operator to
negotiate fares upon any pickup in the usual course of business
4 -2 -9 Reaister of Licenses and Permits
The Village Clerk shall keep a register of the name, address and photograph of each person owning
or operating a taxicab licensed under this Chapter, together with the license number and the
description, make and model of such taxicab, with the date and complete record of inspections made
of it Such records shall be open to the inspection of the public at all reasonable times, and shall be
public records
4 -2 -10 Books and Records of Account
Every licensed taxicab company shall keep accurate books and records of account and log books of
service rendered in its dispatching office The Taxicab Commissioner or his designee shall be
permitted to examine those books and records of account and logs as they may relate to a specific
charge that is the subject of a complaint or public hearing under the provisions of this Chapter
4 -2 -11 Complaints
A Any person may file a written complaint with the Village Manager regarding the
conduct of a taxicab operator or taxicab company or the condition of a vehicle
B The Village Manager or his designee shall investigate all complaints against taxicab
operators, or taxicab companies or vehicles He shall notify the operator and the taxicab
company of the complaint and may conduct a meeting on the matter If the Village Manager
determines that such a meeting is necessary, the operator and a representative of the
taxicab company shall be present If the Village Manager determines that any provision of
this Chapter has been violated, he shall take any further action consistent with the provisions
of this Chapter and may also refer the matter to the Police Department or President
4 -2 -12 Revocation or Suspension of Taxicab License
Any taxicab company license, taxicab vehicle license or taxicab operator's license shall be subject to
suspension or revocation after hearing, by the Taxicab Commissioner upon a finding that the holder
thereof has violated any provision of this Chapter, the Village Code, State Statute or other applicable
law Upon suspension or revocation of any taxicab company license, taxicab vehicle license or
taxicab operator's license granted hereunder, the holder or holders thereof shall be immediately and
automatically barred from taxicab activity and operation within the Village per the terms of the
supervision or revocation
4 -2 -13 Penalties
A Penalties for violation of this Chapter shall be a fine of not less than $100 00 nor
more than $750 00, which shall be imposed by a court of competent Jurisdiction
B Notwithstanding the imposition of the fines aforesaid, any license issued pursuant to
this Chapter shall be subject to suspension or revocation by the Taxicab Commissioner for
the same violation that resulted in the Court imposed fine
