CALL TO ORDER: CALL TO ORDER The Meeting of the Plan Commission was called to order by Chairwoman Tropinski in the Samuel E. Dean Board Room of the Butler Government Center at 7:08 p.m. 2. ROLL CALL: ROLL CALL Gail Polanek called the roll with the following persons PRESENT: Chairwoman Marcia Tropinski, Members Thomas Doyle, Raju Iyer, Raj Lal (arrived 7:24 p.m.), Simon Sheers and Kenneth Wilczak ABSENT: Member Naveen Jain IN ATTENDANCE: Director of Community Development Robert Kallien Jr., Planning Technician Gail Polanek and Planner Rebecca Von Drasek 3. NEW BUSINESS NEW BUSINESS A. ZONING CONSULTANTS, TESKA ASSOCIATES — COMPREHENSIVE ZONING REVIEW OF THE VILLAGE OF OAK BROOK ZONING ORDINANCE CONSULTANTS, - REVIEW ZONING ORDINANCE Director of Community Development Kallien provided a brief overview of the zoning ordinance update. Mr. Savoy emphasized that the Zoning Ordinance update was creating a Performance Based Approach to the Ordinance. Mr. Savoy began his presentation responding to written review comments submitted by Commissioner Doyle (provided in Italics). Comment 1) Chapter 7: Business and Institutional Districts Establishment of Commercial Districts, B2 — Consider changing "big box" to "department stores ", which is typical of the Oakbrook Shopping Center, and others. "Big box" generally is used for Costco, Sam's Club, Target and Kmart Superstores, etc., which are typically located in B3 type districts. Mr. Savoy explained that the industry standard uses the term "big box "; he noted that he might refer to it differently but argued that "big box" in this instance was appropriate. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 1 of 6 July 11, 2016 Comment 2) "Approved by the Director of Development Services" There had been some discussion about this. As it is now worded, the permitting power is in the hands of an individual. The individual may be sick or on vacation; or the position is temporarily unfilled. Would "Approved by the Office of... " work better? Mr. Savoy agreed that the language could read, "Approved by the Office of Development Services ". Comment 3) In 13 -7 -3 B -6 b., why is there this exception to the Director of Development Services for approval? In additional standards, perhaps an indication that the building owner /manager's permission has been approved and must be provided in writing. Also, it might be advisable to have different "Hours of Operation "for the two different locations as described in 6a and 6 b. Mr. Savoy noted that Comment Five also related to Food Trucks and suggested that the Commission have a further discussion about the issue. Comment 4) Would like an explanation of rationale for "Structural Height" in the various districts. He questioned why there was a difference, between BI and B3 districts. Mr. Savoy agreed that the reversing the heights in the BI and B3 districts was appropriate. Comment 5) Under "Mobile Food Vending (Food Trucks): unless the intention is that only restaurants in the Village can operate Food Trucks, the following modification might be considered "be owned and operated (1) by the owner or (2) by the agent of a licensed food establishment in the Village". Even this wording would preclude a company with a fleet of Food Trucks from operating in the Village. Comment 6) A minor thing. Retail Store reads so that a 100,000 square foot store is not included. It should read something like less than "100,000 square feet" and "100, 000 square feet or more ". "Above" and "Below" are related to height. Mr. Savoy accepted this suggestion. Comment 7) More seriously, under Public /Institutional Land Uses — the term "Religious Institutions" applies to structures like convents, seminaries and a number of other types. Perhaps the term "Places of Worship". which is more restrictive, would be more appropriate. In the interest of inclusivity, I would recommend including "Mosques" among the examples. Mr. Savoy disagreed that convents and seminaries were the same type of land use as churches and temples because people reside in the former. Member Doyle noted the ambiguity in the terms convents /seminaries but argues that VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 2 of 6 July 11, 2016 they were in his opinion examples of institutional land uses. Mr. Savoy agreed to add "mosque" in the listed examples of Religious Institutions within the Land Use table. He thanked Member Doyle for the comments and encouraged the Commissioners to forward comments or suggestions in the future. Director of Community Development Kallien requested that with any standards, within the text, where graphics could be included as the visual cues are often more helpful than text. Chairwoman Tropinski suggested the Commission return to the discussion of the Food Truck requirements. Member Sheers inquired if the hours needed to be all day. He observed that if a truck was not making sales that it would probably move on. Member Iyer offered that he had seen the trucks in other parts of the country and did not object to them outright. He agreed that hours of operation from 7 am to 5 pm would be acceptable. Member Wilczak asserted that the text should limit the Food Trucks from being within 500 feet of a brick and mortar restaurant. Member Lal questioned what value Food Trucks would bring to the Village, he noted that he had seen examples of them in Carmel, Indiana. He added that although the existing conditions are not carved in stone he emphasized the need to keep with the vision and mission of the community. Member Doyle stated that he felt the Food Trucks requirements should be left in the Zoning Ordinance update and allows the trucks to operate within the community. Chairwoman Tropinski reported that she had done an informal survey of individuals working within the community and found that there was need and desire for such a service. Director of Community Development Kallien reminded the Commission that the current Zoning Ordinance does not allow for Food Trucks. Mr. Savoy reviewed with the Commission the outdoor storage standards and bulk setback requirements. He informed the Commission that the FAR standards had been removed, he noted that if a development met the height and setback requirements that the Floor Area Ratio was irrelevant. Director of Community Development Kallien asked the Commission to consider and respond to the height restrictions within some of the commercial districts. Chairwoman Tropinski asserted that allowing taller structures in some Districts would be appropriate. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 3 of 6 July 11, 2016 Member Doyle did not object to taller structures provided adequate landscaping and setbacks could be met to prevent structures from dominating an area. Director of Community Development Kallien observed that in some municipal codes "bonuses" are offered when developers will consider certain allowances like additional open space or parking that then allows the development to exceed build standards. He added that this type of flexibility might only be appropriate in 03, ORA2, and B2 Districts; more or less areas adjacent to the mall, where there are already buildings of considerable height. Member Lal stated that he did not object to office buildings when they are grouped in an area. The Commissioners briefly discussed offering flexibility for structure height for applicants as part of a building permit. Mr. Savoy offered to draft some height bonus language for the Commission's consideration. Jason Engberg, Teska Associates, reviewed the Land Use Tables as revised. The Commissioners reviewed the proposed changes. Mr. Savoy observed that it was a best management practice to avoid over regulating business development. Director of Community Development Kallien suggested that Teska also draft a list of prohibited uses to include within the Land Use Tables. Mr. Savoy highlighted a proposed revision to allow outdoor dining by permit rather than require existing restaurants to seek a Special Use to place a few tables outside of their buildings. The Commissioners agreed. Member Doyle observed that the Commission had met too many times regarding outdoor dining for restaurants. He questioned in what district it could be a permitted use for outdoor dining with the specifications conditions attached to the Code. He added that the way it is done now is crazy. Instead of just saying that there are certain things that one needs to do in order to be allowed approval for outdoor dining. The idea of drive -thru versus no drive -thru was based on one event, where there is a lot of time spent. The broader view would be to get something out of the Commission and become part of a regulated process. Director of Community Development Kallien agreed. He noted that Roti and Chipotle in order to be allowed to have four tables located outside their restaurant for outdoor dining is the same process used for Christ Church to add a huge facility plan for its property. He noted that one was not equal to the other, but the process is exactly the same. He encouraged creating great standards and in order to apply for an outdoor dining permit the standards must be met and would then not need to come through the boards. VILLAGE OF OAK BROOK Regular Plan Commission Minutes Page 4 of 6 July 11, 2016 Mr. Savoy said that it sounded as if there were standards that had been used. Chairwoman Tropinski said that the same principle may apply to banks and financial facilities requesting a drive -thru, which have also been through the Plan Commission numerous times. Mr. Savoy and Mr. Engberg agreed that certain conditions could be required especially in regards to stacking requirements, coverings, and awnings. Director of Community Development Kallien agreed with the drive -thru providing that the drive -thru adjacent to or within a specified distance from a residence district should be required to go through the special use process. At that point, screening, light, sounds coming through a speaker box, etc., that should be reviewed through the special use process. He noted that the drive -thru for the Hyatt Hotel was an issue for the neighboring residential community. Mr. Savoy suggested the same parameter be set for outdoor dining adjacent to residential areas. There was a brief discussion in regards to mixed use in the 0-4 District. Mr. Engberg responded that a mixed -use development in the 0-4 District could be a mix of any type of land use, subject to the Planned Development Regulations. While it could be a commercial use with apartments on top, it could also be a research facility and hotel. Mr. Savoy responded that the evolution of 0-4 has been more of a mixed -use district. The proposed change was trying to reflect the history of the district and not introducing a new idea. Chairwoman Tropinski questioned the topics for review at the next meeting. Mr. Savoy responded that Planned Developments have modest changes, along with changes to telecommunication towers and other items. Chairwoman Tropinski asked for an agenda prior to the meeting. Director of Community Development Kallien said that the goal would be to have the material prior to the meeting so that they can be talked about at the meeting. There was a brief discussion regarding delivery of the content when the quorum call is made along with providing a zoning map for the members to use. Member Doyle motioned, seconded by Member Iyer to continue the zoning ordinance updated review to August 15, 2016. VOICE VOTE: Motion carried. OTHER BUSINESS Director of Community Development Kallien reviewed possible new case in regards to overflow parking from another town into Oak Brook. 5.
