As you are aware, emergency circumstances forced the cancellation of the December 17 "`
Planning Commission Meeting. The rescheduling of the Planning Commission meeting
will not provide enough time for the Planning Commission, the Zoning Board of
Appeals, the Village President and the Village Board of Trustees to review and approve
our requested changes to the Special Use Permit area before our current Special Use
Permit (S -841) expires on February 13, 2002 via (S -986).
I respectfully request that the President and the Village Board of Trustees approve a 60-
day extension to our current Special Use Permit Extension (S -986) to allow the Planning
Commission, the Zoning Board of Appeals, the Village President and the Village Board
of Trustees adequate time to review and approve the requested changes to our Special
Use Permit area.

Request Extension of Special Use — Forest Preserve District of DuPa e County

RECOMMENDATION: That the Village Board approve the attached ordinance granting a 60-
day time extension for obtaining certificates of occupancy for the
buildings on the property commonly known as 1717 Oak Brook Road,
Oak Brook, IL (Peabody Mansion)
The fifth amendment to Ordinance S -841, approved on February 13, 2001 (as Ordinance S -986)
extended the special use permit for the Peabody Mansion commonly known as 1717 Oak Brook Road.
This most recent extension - expires on February 13, 2002 if occupancy permits have not been issued for
buildings on the property. To date, occupancy permits have not been issued.
As you recall, on November 27, 2001, the Board referred an application from the Forest Preserve
District requesting approval of an amendment to its existing special use. The request would expand the
area covered by the special use to include the breezeway (connects the two structures), foyer and new
restrooms which have been constructed to comply with ADA requirements. The Forest Preserve
District anticipates submitting a future request to further expand the boundaries of the special use in
order to include the entire retreat wing as well as additional site improvements (i.e., new parking lots,
landscaping, etc.).
This matter was referred to the Plan Commission for hearing and recommendation at their December
17, 2001 and to the Zoning Board of Appeals for public hearing at their January 9, 2002 meeting.
hl light of the unplanned cancellation (lack of quorum due to family emergency) of the December 17,
2001 Plan Commission meeting, I have received a request from Mr. Michael Palazzetti, Program
Services Manager for the Forest Preserve District of DuPage County to consider a 60 -day extension of
the special use (see attached letter).
Based on the circumstances, we see no reason to object to a "limited" extension of the current special
use for the Peabody Mansion and recommend Board approval. If the Board wiphes to act on the matter
at this meeting, the appropriate ordinance is attached.

Trustee Korin stated her concern of the additional charges relative to the
meeting room divider since this was always a part of the plans. Library
Director Martin asked Manager Veitch to explain the problems related
to the divider. Manager Veitch responded that the wall as it was
designed was not feasible and that additional steel structure was needed
to support the divider, but that the most costly portion of the change was
the fire sprinkler system adjustments required.
Motion by Trustee Korin, seconded by Trustee Caleel, for approval of
Library Building Project Change Order #19 which results in a contract
increase of $4,437.00 and determine that the circumstances necessitating
the Change Order was not reasonably foreseeable at the time the
contract was signed, that the Change Order is in the best interest of the
Village and are authorized by law.

Expiration Date of the Special Use Permit Granted Therein (1717 Oak
Brook Road, Oak Brook, IL 60523)," as presented and waive the full
reading thereof.

2) ORDINANCE 2002 -B_U -S -1008, AN ORDINANCE AUTHORIZING
A LOAN TO THE SPORTS CORE FUND
The current ordinance authorizing loans from the General Corporate
Fund to the Sports Core Fund expires on January 31, 2002. The prior
ordinance authorized a consolidated loan of up to $790,000 in order to
fund capital and operating needs of the Sports Core dating from 1996-
2000. During November and December, additional loans totaling
$225,000 were needed in order to fund operating expenses at the Sports
Core.

AN ORDINANCE APPROVING SIXTH AMENDMENT TO ORDINANCE S -841
EXTENDING THE EXPIRATION DATE OF THE SPECIAL USE PERMIT GRANTED THEREIN
(1717 Oak Brook Road, Oak Brook, IL 60523)
WHEREAS, the President and Board of Trustees of the Village of Oak Brook, by Ordinance S -841,
passed February 13, 1996, (incorporated herein by reference) granted a special use permit allowing use of the
property commonly known as 1717 Oak Brook Road (the so- called Peabody Mansion or "Special Uses Property ")
as a historic facility within the Village of Oak Brook, subject to certain conditions and restrictions; and
WHEREAS, paragraph 6 of Section 4 of Ordinance S -841, provides that the Special Use Permit
automatically expires if certificates of occupancy for buildings located on the Special Use Property have not been
issued on or before February 13, 1998; and I
WHEREAS, a former licensee of the Special Use Property, the Mayslake Landmark Conservancy, has, on
five prior occasions, asked for and received from the Village Board extensions to the certificate of occupancy
deadlines; the current deadline is February 13, 2002 pursuant to Ordinance 2000- ZO- SU -EXI -S -986; !and
WHEREAS, the owner of the Special Use Property, the Forest Preserve District of DuPage Count;,
Illinois, has requested that the Village Board extend the certificate of occupancy deadline by an additional sixty
days; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem the passage of this

Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully
set forth herein. 1
Section 2: That Section 6 of Ordinance S -841, as amended, is hereby amended to read as follows:
(6) The Special Use Permit shall automatically terminate if certificates of occupancy for buildi
located on the special use property have not been issued on or before April 15, 2002.
Section 3: That all other provisions of Ordinance S -841 are in full force and effect.
Section 4: That this ordinance shall be in full force and effect from and after passage and app
pursuant to law.
