February 2, 1999
1. CALL TO ORDER
The meeting was called to order at 7:37 p.m.

Member Ascher moved, seconded by Member Aldini, to waive the reading of the January 5, 1999,
regular Zoning Board of Appeals meeting minutes and to approve them as written.
VOICE VOTE: All in favor. Motion carried.
Ill. BARBARA — 25 BREAKENRIDGE FARM - AN APPEAL OF A BUILDING
INSPECTOR DETERMINATION
A letter was received from John Brechin, attorney for Barbara, advising the Board that Mr. Barbara
will not be able to appear at this meeting and that he was seeking a continuance to the next regular
Zoning Board of Appeals meeting on March 2, 1999.
Member Ascher questioned the many continuances and length of time this file has been brought
before the Zoning Board of Appeals. A brief history of the file was given by Tom Hawk adding that
there was no urgency to the matter during the winter months.
Member Aldini moved, seconded by Member Butler to continue the hearing on the Appeal to the next
regular Zoning Board of Appeals meeting on March 2, 1999.

IV. VILLAGE OF OAK BROOK- 1999 PAVING AND WATER MAIN PROJECT -
YORKSHIRE WOODS SUBDIVISION RIGHT OF WAY - FLOOD PLAIN SPECIAL
USE
Dale Durfey, Village Engineer reviewed the Villages request for Flood Plain Special Use in the
Yorkshire Wood Subdivision. Some parts of the Subdivision are in the flood plain and he reviewed the
flood plain map showing these sections in the northeast, west and south areas. The roads in the area
vary from 16 to 22 feet, edge to edge. There will be a uniform 20 -foot width of the pavement from
edge of asphalt to edge of asphalt with two -foot concrete shoulders on both sides as in the Ginger
Creek Subdivision and which was requested by the residents. It will require, pavement widening,
installation of concrete shoulders and ditching. By Ordinance we are required to compensate for the
fill at 1.5 times the amount. It is difficult to crowd this within the 66' foot right of way, so it can only be
accomplished with ditches. There will be some tree loss and they are aware that no one is happy
about it, but they understand the need for it. During the construction stage, they will try to save as
many as possible. In the petition file the standards for the eleven factors for flood plain special use
have been answered.
Chairman Davis questioned whether compensatory storage can be given anywhere along the
roadway onto to private property. Dale Durfey answered that it can be anywhere rights are given by
the property owner, however no one has done that. Chairman Davis also asked whether the use of
ditches as planned were normal or whether there were necessary due to the flood plain. Dale Durfey
answered that they are more complex because of the compensatory storage requirements.
Chairman Davis questioned the tree removal and Durfey said that even without the requirements
within the flood plain, the need for proper drainage and the right of way would cause some tree
removal.
There was no public comment in support of or in opposition to the request.
Tom Hawk, said that the Village is following the same procedure as if this were a private request with
the oversight of outside professional engineers. James J. Benes & Associates, Inc. did the design
work on the project. The Village's stormwater consultant, Earth Tech and Dale Durfey reviewed the
project to see that the flood plain special use is done appropriately.
Dale Durfey addressed the standards set forth in his memo on page 7 of the petition file.
Chairman Davis acknowledged receipt of the Plan Commission recommendation for approval.
Member Ascher questioned the composition of the ditch and was advised that they will be sodded
with a two -foot flat bottom and sloped sides.
Member Butler stressed making every effort to save as many trees as possible.
Chairman Davis questioned the Village timetable for this project. Dale Durfey said they were hoping
to get the bids out by February 24, 1999 and are projecting to begin work around April 1,1999. The
project will last all summer.

Member Butler moved, seconded by Member Aldini, finding that the petitioner having satisfied the
Standards as required by the Ordinance relating to a Flood Plain Special Use, recommended
approval of the request with the following conditional elements:
1. During construction an effort will be made to preserve as many trees as possible.
2. Final Engineering approval.
