SUBJECT: Ordinance Regarding Parking Spaces for Disabled Persons

RECOMMENDED MOTION: I move to pass Ordinance 2007 G 825 entitled "An
Ordinance Amending Section 7 -1- 1301.1 of Chapter 1 of Title 7 of the Village Code of the
Village of Oak Brook"
Background/History:
The State of Illinois has modified its laws concerning parking for persons with disabilities. This
ordinance will bring our code into compliance with the state law. The main modification to the
state statute is the fine amount. The current fine in the Village Code is $100; under the new
ordinance the fine for parking in places reserved for persons with disabilities shall be $250; and
$500 for those displaying plates or decals of disabled persons when they are not authorized to
use those plates, decals or other such devise.
The matter of the discrepancy in fine amounts between our ordinance and the state law occurred
when the Police Department and the Secretary of State Police issued tickets at our area shopping
centers for vehicles improperly using parking spaces reserved for the disabled. The State Police
issued tickets with the higher fine amount while our Police issued the tickets according to the
current Village code. The adoption of this ordinance will keep us in line with the state fines.
Recommendation:
Staff recommends passage of the proposed ordinance.
