SUBJECT: Liquor License Fee Increase

RECOMMENDED MOTION: Motion for passage of Ordinance G -881, An Ordinance
Inreasing the Annual License Fee for Liquor Licenses and Amending Section 4 -1 -8 of the
Village Code of the Village of Oak Brook
Backj!round/History:
Liquor License Fees have not been increased since 1996. During budget discussions a survey
was done to determine comparative fees for local municipalities. It is difficult to be assured that
the comparisons are 100% accurate due to the fact that classifications vary and frequently the
definitions for the classifications are not exactly the same. However, similar classifications have
been shown on the attached survey that indicates that Oak Brook is slightly above the average in
fees. 0
In addition, during the review of licenses in Oak Brook it was determined that the number of
licenses issued was somewhat inaccurate due to the fact that Macy's discontinued the sale of
liquor and those licenses were not decreased from the table. During a previous review and
correction an additional B license has been listed that cannot be accounted for. Therefore this
ordinance also corrects the number of licenses to reflect these changes.
Recommendation:
It is recommended that the Board approve increasing Liquor License fees by 10% which would
raise approximately $12,000.00 in revenues and still maintain a competitive license fee. In
addition, it is recommended that the number of liquor licenses be corrected.

ORDINANCE 2009- 1-C -AL -G -881
AN ORDINANCE INCREASING THE ANNUAL LICENSE FEE
FOR LIQUOR LICENSES AND AMENDING SECTION 4 -1 -8
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK
WHEREAS, the President and Board of Trustees have determined that the expenses attributable
to the inspection and regulation of liquor licensees has increased thereby necessitating a corresponding
increase in the annual fee for liquor licenses, and
WHEREAS, Title 4, Chapter 1, Section 8A (4 -1 -8A) of the Village Code of the Village of Oak
Brook authorizes certain numbers of liquor licenses and the number of such licenses issued for each
class of license may be increased or decreased from time to time by ordinance approved by the President
and Village Board due to changes in ownership of licensed premises, the creation of a new and deserving
business enterprise, or the abandonment, revocation, surrender or other termination of an existing license,
and
WHEREAS, the President and Board of Trustees of the Village deem it advisable and in the best
interest and in furtherance of the general welfare of the citizens of the Village that the Village Code of the
Village of Oak Brook be amended to eliminate one (1) Class A -1 license and one (1) Class B license
currently issued to Marshall Field's Chicago, Inc , d /b /a Macy's, due to the fact that Macy's is no longer
selling liquor, and
WHEREAS, the Village Clerk, after careful searching of records has determined that an error was
made previously regarding the number of Class B licenses and recommends that the number of Class B
licenses be reduced by two (2), which will correct the previous error and reflect the elimination of the
license held by Macy's detailed above
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 The foregoing preamble is restated and incorporated herein by reference as though
fully set forth herein
Section 2 Section 4 -1 -8A of the Village Code of the Village of Oak Brook, Illinois is hereby
amended to read as follows

Section 3 If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance
Section 4 All ordinance in conflict herewith are hereby repealed to the extent of such conflict
Section 5 This ordinance shall be in full force and effect from and after its passage, approval and
publication as required by law
