Background/History: At the January 27, 2009 meeting, the Village Attorney was directed to prepare the ordinance granting approval of a text amendment to the Zoning Ordinance to permit off - premises ground signs. Recommendation: Approve Ordinance G -882. /� M Last saved by administrator I \ComDev \GPOLANEK \1 -FROM BOB \Bot - PC - ZBA \BOT -FINAL Action -MCD- Chase -TA -G -882 doc ORDINANCE 2009- ZO -TA -G -882 AN ORDINANCE AMENDING SECTION 13 -11 -7A OF THE ZONING ORDINANCE WHEREAS, at its meeting on November 17, 2008, the Plan Commission reviewed a proposed amendment to Section 13 -11 -7A of the Zoning Ordinance to allow off -site premises ground signs , and WHEREAS, by a vote of 5 to 0 the Plan Commission recommended approval of the proposed amendment, and WHEREAS, on January 6, 2009 the Zoning Board of Appeals conducted a public hearing in connection with a proposed amendment to Section 13 -11 -7A of the Zoning Ordinance, and WHEREAS, by a vote of 5 to 0 the Zoning Board of Appeals recommended approval of the proposed text amendment, and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals, and deem the text amendment, as set forth below, to be in the best interests of the Village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein Section 2 Section 13 -11 -7A of the Zoning Ordinance is hereby amended by adding the following as subsection 8 One or more off -site premises ground sign(s) may be permitted when located on a retail /commercial development with which the benefitted retail /commercial development has entered into a sign and cross access easement agreement providing for the use and operation of the off -site sign and the shared internal vehicle circulation and access to the adjacent public streets over, across and between each of the retail /commercial developments, subject to the following conditions 1 An executed sign and cross access agreement, which shall be binding on the successors of each property, shall be in a form acceptable to the Village and which shall be recorded with the DuPage County Recorder of Deeds 2 Each sign face is not to exceed fifty (50) square feet per side and the total sign area is not to exceed one - hundred (100) square feet 3 One off -site premises ground sign allowed per street frontage Section 3 If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance Section 4 All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict Section 5 This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law Ayes Nays Absent APPROVED THIS 10th day of February, 2009 John W Craig Village President PASSED THIS 10th day of February, 2009 ATTEST Charlotte K Pruss Village Clerk Ordinance 2009- ZO -TA -G -882 Text Amendment —Sign Regulations 131, B3, and B4 District Page 2 of 2
