At the January 23, 2001 Village Board meeting there was concern that
the nature and scope of activities currently contemplated for the special
use property might exceed the provisions and limitations of Ordinance
S -841. Although the uses do not seem to be inconsistent with the
original grant, the special use property does not include the "retreat
wing" area, as that structure was not part of the Mayslake ,
Conservancy's original plans. Although staff believes the District still
desires an extension of the existing special use, staff also understands
the District will file an application for an amendment to the special use

7. B.I. to expand its area and revise its site plan. Probable site plan revisions
include additional parking, which will raise issues related to stormwater
management and impact on neighboring property. The special use
amendment process will be more complicated than a simple change in
the legal description.
Village Attorney Martens explained that the Forest Preserve District's
request before the Village Board is a request to extend their existing
special use for one year. The second segment of their relief request is
an amendment to the existing special use. He noted, in discussions I
with the District's Attorney, that the District will soon address in a
filing efore the Village this amendment and
g g preceding the filing'
perhaps engage in meetings with their neighbors regarding this project.
Trustee McInerney commented that he felt this should be the last"
extension offered the Forest Preserve District as they have previously]
had three extensions and requested they go forward with completion.
Trustee Caleel stated he had toured the facility and noted considerable
progress has been made. He suggested that due to a shortfall of
funding the project had been delayed but that the project is worthwhile
being completed. He requested that if office space is being developed
that it not be for commercial use and asked that this be clarified when
the District returns for their second request. Trustee Butler noted that
consideration of additional parking must be discussed when they)
present their second request.
Ms. Audrey Muschler, 55 Yorkshire Drive, addressed the Village
Board in support of the request made by the Forest Preserve District of
DuPage County. She indicated that the proposal would benefit the
Village for both residents and businesses, as the site is listed on the;
National Registry of Historical Places.
Trustee Savino inquired as to the feasibility of the building being
completed in one year and their fundraising efforts to acquire
approximately one -half of their anticipated budget to complete the
project.
Mike Palazzetti, Program Services Division Manager for the Forest
Preserve District of DuPage County, indicated that the building project
is to be completed at the end of December 2001 or by early January
2002. He explained that funds have been secured for compliance of life
safety issues and the Americans with Disabilities Act requirements. A
grant proposal for additional funds has been submitted to the ' state

legislature and the Mayslake Conservancy is also assisting them in
acquiring private donations.
Motion by Trustee Savino, seconded by Trustee McInerney, to approve
Ordinance #2001- ZO -SU -S -986, "An Ordinance Approving Fifth
Amendment to Ordinance S -841 Extending the Expiration Date of the
Special Use Permit Granted Therein (1717 Oak Brook Road, Oak
Brook, IL 60523)," as presented and waive the full reading thereof.
ROLL CALL VOTE:
Ayes: 4 - Trustees Butler, Caleel, McInerney and Savino.

AMENDING SECTION 4 -1 -25A OF THE VILLAGE CODE OF
THE VILLAGE OF OAK BROOK ILLINOIS RELATIVE TO
FINES FOR VIOLATIONS OF THE LIQUOR CONTROL
ORDINANCE
House Bill 4043, (Public Act 91- 0854), increases the fines that may b I
imposed by a Local Liquor Commissioner from $1,000 per violation to
$1,000 for a first violation within a twelve (12) month period, $1,500
for a second violation and $2,500 for a third or subsequent violation
within a twelve (12) month period. The bill also increases the
maximum annual amount of fines from $10,000 to $15,000.
Motion by Trustee Savino, seconded by Trustee Caleel, to adopt
Ordinance #2001- AL -RR -G -670, "An Ordinance Amending Section 4-
1 -25A of the Village Code of the Village of Oak Brook, Illinois
Relative to Fines for Violations of the Liquor Control Ordinance," as
presented and waive the full reading thereof. ROLL CALL VOTE:
Ayes: 4 - Trustees Butler, Caleel, McInerney and Savino.

AN ORDINANCE APPROVING FIFTH AMENDMENT TO ORDINANCE S-841
EXTENDING THE EXPIRATION DATE OF THE SPECIAL USE PERMIT GRANTED THEREIN
(1717 Oak Brook Road, Oak Brook, IL 60523)
WHEREAS, the President and Board of Trustees of the Village of Oak Brook, by Ordinance S -841,
passed February 13, 1996, (incorporated herein by reference) granted a special use permit allowing use of the
property commonly known as 1717 Oak Brook Road (the so- called Peabody Mansion or "Special Use Property ")
as a historic facility within the Village of Oak Brook, subject to certain conditions and restrictions; and
WHEREAS, paragraph 6 of Section 4 of Ordinance S -841, provides that the Special Use Permit
automatically expires if certificates of occupancy for buildings located on the Special Use Property have not been
issued on or before February 13, 1998; and
WHEREAS, a former licensee of the Special Use Property, the Mayslake Landmark Conservancy, has, on
four prior occasions, asked for and received from the Village Board extensions to the certificate of occupancy
deadlines, the current deadline is February 13, 2001 pursuant to Ordinance 2000- ZO- SU -EX1 -S -960; and
WHEREAS, the owner of the Special Use Property, the Forest Preserve District of DuPage County,
Illinois, has requested that the Village Board extend the certificate of occupancy deadline by one year; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem the passage of this
Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully
set forth herein.
Section • That Section 6 of Ordinance S -841, as amended, is hereby amended to read as follows:
(6) The Special Use Permit shall automatically terminate if certificates of occupancy for buildings
located on the special use property have not been issued on or before February 13, 2002.
Section 3: That all other provisions of Ordinance S -841 are in full force and effect.
Section 4: That this ordinance shall be in full force and effect from and after passage and approval
pursuant to law.
