SUBJECT: Ordinance amending the Fees and Operations of the Sports Core:
Bath and Tennis, Fields, and Golf Club
In accordance with the direction of the Village Board, and consistent with Ordinance G -738
establishing the 2004 Golf Club rates, and the fees and rates approved by the Village Board on
February 24, 2004 for the Bath and Tennis Club, attached is a copy of an ordinance that would replace
existing Title 12 of the Village of Code of the Village of Oak Brook with an updated version of Title
12, reflecting the 2004 rates and changes in text under Bath and Tennis to allow for operational
changes. This revision was produced by the management staff of the Bath and Tennis Club,
Administrative staff, and reviewed by Barbara Gosselar, attorney with Kubiesa, Spiroff, Gosselar,
Acker &Kern, P.C., Village Attorney.
Revisions to Title 12, Recreational Facilities
Chapter 1:
1. Chapter 1 serves as an umbrella ordinance for this Title. Therefore, a new
section was added simply to define what is contained under the Sports Core.
2. Definitions Section: In the existing Title 12, there are definition sections under
Chapter 2 and under Chapter 3. The revised Title 12 simply pulls all the
definitions for Title 12 into Chapter 1 for consistency throughout Title 12. The
definitions were revised to reflect structure changes with rates. Major changes
to the definitions include:
NONRESIDENT: Any person residing outside the corporate limits of the Village who is not a
corporate resident.
SENIOR: Any person sixty (60) years of age or older. (Senior under Bath and Tennis is 62
years old and would change by way of this ordinance to 60 years old, consistent with golf.)
UNLIMITED BATH AND TENNIS MEMBERSHIP — SENIOR, FAMILY (TYPE C):
Will include husband and/or wife, one or both over the age of sixty (60), and all grandchildren
under the age of twenty -one (21). Membership will entitle the participant to utilize all the
facilities, subject to rules governing use of the facilities by children.

SUBJECT: Ordinance Amending Title 12, Recreational Facilities (Sports Core):
Revision to the Proposed Ordinance
As you are aware, on March 8, 2004, the Bath and Tennis Committee met for a final review of the proposed
Ordinance for the Bath and Tennis Club that incorporates the new 2004 Rate Schedule approved by the Village
Board on February 24, 2004. The following are the final revisions as directed by the committee which have
been incorporated in to the proposed ordinance attached hereto:
1 12 -1 -3 B (1): Not - For - Profit was clanfied to state that the organization is 501 C (3).
2. 12 -1 -3 B (3) "Other" use... of the fields replaced "Nonsporting" use... to broaden the definition of
users under this category.
3. 12 -1 -4, Fees: The approval of separate agreements under this section was changed back to Village
Manager to stay consistent with current practice.
4. 12 -3 -2 B, Reductions: This section has been corrected to make the proposed ordinance consistent with
the rates set by the Village Board on February 24, 2004. Residents, Non - residents and Corporate
Residents are eligible for a $100.00 reduction in fees for a family or individual unlimited membership if
paid by May 15, 2004. The senior memberships pricing has been reduced to reflect a discount and shall
be in effect all season.
5. 12 -3 -2: Non - resident Senior Memberships for both Family and Individual unlimited use were
inadvertently omitted from the Fee and Rate Schedule. These two memberships have been added to the
schedule with the following membership rates: Non - resident Senior — Family, $1,000.00; Non - resident
Senior - Individual, $600.00; Corporate Senior — Family, $900.00; and Corporate Senior — Individual,
$700.00. Similar to the Senior Resident category, no additional early bird reductions are available.
6. 12 -3 -4C (10): This section was revised to reflect a change in financial procedures and that said payments
are subject to an annual appropriation approved through the budget.

RECOMMENDED MOTION: I move to approve an ordinance adopting a comprehensive
amendment to Title 12 entitled, "Village Recreational Facilities" of the Village Code of the
Village of Oak Brook, Illinois.
Background /History:
The proposed ordinance constitutes a comprehensive amendment to Title 12 of the Village Code
which provides for the fees charged, policies and procedures for the Oak Brook Sports Core,
including Golf, Bath & Tennis and open fields. In addition to the revisions outlined in the
memorandum dated March 5, 2004, to Richard Boehm, Village Manager, Title 12 which stands
as Exhibit A to the proposed ordinance, was revised on March 8, 2004 per the direction of the
Bath and Tennis Committee. These minor revisions are noted on the attached memorandum
dated March 8, 2004, RE Ordinance Amending Title 12, Recreational Facilities (Sports Core):
Revision to the Proposed Ordinance.
Recommendation:
Staff recommends that the Village Board approve the ordinance adopting a comprehensive
amendment to Title 12 entitled, "Village Recreational Facilities" of the Village Code.
