SUBJECT: Amendments to Title 6 — Police Regulations

RECOMMENDED MOTION: I move for passage of Ordinance G- 920:AN ORDINANCE
AMENDING ORDINANCE G -875 RELATIVE TO CHAPTER 5 (IMPOUNDMENT OF
VEHICLES) OF TITLE 6 (POLICE REGULATIONS) OF THE VILLAGE CODE OF THE
VILLAGE OF OAK BROOK
Background/History:
Per direction from the Police Department, I have prepared an Ordinance which changes the
length of time for the conduction of a vehicle impoundment hearing from forty -five (45) days to
ninety (90) days in Section 6 -5 -6 of the Village Code. After staff met with the hearing officer, it
was felt that the current time frame would be too short, thus the need to change the current
ordinance to allow the appropriate time (within 90 days). That said, the goal is still to stay
within the forty-five (45) day time period when the calendar and hearing schedule permits.
Recommendation:
I recommend that this Ordinance be passed.
ORDINANCE 2010- PD -OF -G -920
AN ORDINANCE AMENDING ORDINANCE G -875 RELATIVE TO CHAPTER 5
(IMPOUNDMENT OF VEHICLES) OF TITLE 6 (POLICE REGULATIONS)
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK
WHEREAS, the President and Board of Trustees determined that the use of motor vehicles
during the commission of criminal activities poses a threat to the public health, safety and welfare; and
WHEREAS, the President and Board of Trustees approved and passed Ordinance G -875 on
November 25, 2008, which provided for the impoundment of motor vehicles used during the commission
of criminal activities and established an administrative hearing process to regulate the release of
impounded vehicles; and
WHEREAS, the Police Department has recommended at this time that the length of time stated in
Ordinance G -875 for a hearing to be conducted regarding the impoundment of a vehicle be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: That the words and numbers "forty five (45)" wherever they appear in Section 6 -5 -6
(Hearing) of Chapter 5 (Impoundment of Vehicles) of Title 6 (Police Regulations) of the Village Code of
the Village of Oak Brook be deleted therefrom and be replaced with the words and numbers "ninety (90) ".
Section 2: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not effect any of the other provisions of this ordinance.
Section 3: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
Section 4. This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.
