Pursuant to your direction, I have drafted the attached ordinance amending Ordinance 5 -729
and S -919 and granting an amended special use permit which would allow additions to the
church building including two new nurture rooms, an audio - visual center, an expanded kitchen
and a new pre - school atrium.
Please note the conditions and restrictions set forth in Section 3 of the special use perry
ordinance. The proposed 30 -space parking facility is specifically excluded.

AN ORDINANCE AMENDING ORDINANCES S -729 and S -919
AND GRANTING AN AMENDED SPECIAL USE PERMIT
(Christ Church of Oak Brook, 501 Oak Brook Road, Oak Brook, IL 60523)
WHEREAS, on August 10, 1971 the corporate authorities of the Village of Oak Brook
Ordinance S -237, which approved a special use for the property hereinafter described ( "SubjE
for construction of a church sanctuary and steeple; and

WHEREAS, on October 28, 1975 and October 25, 1983, the corporate authorities of the Village of
Oak Brook passed Ordinances S -346 and S -511, respectively, which amended the aforementioned
special use by permitting additional parking; and
WHEREAS, on April 22, 1986, the corporate authorities of the Village of Oak Brook passed
Ordinance S -583, amending the aforementioned special use by permitting construction of two additions to
the church, 136 additional parking space and various roadway and grading modifications; and
WHEREAS, on March 10, 1992, the corporate authorities of the Village of Oak Brook passed
Ordinance S -729 granting an amendment to the aforementioned special use by permitting construction of
a choir rehearsal room and additional classrooms; and
WHEREAS, on December 8, 1998, the corporate authorities of the Village of Oak Brook passed
Ordinance S -919 which granted an amendment to the aforementioned special use by permitting the use of
an existing building as a temporary office for not more than five years and regulating the use of the
volleyball courts; and
WHEREAS, Christ Church has proposed further amendments to the aforementioned existing
special use which would allow use of the Subject Property for construction of additions to the church
building which would include two new nurture rooms, an audio - visual center located above the bridge, an
expanded kitchen and a new preschool atrium pursuant to the plans which were submitted with the
application, and
WHEREAS, the Plan Commission on January 15, 2001, recommended approval of the requested
amendments, not including the proposed 30 -space parking lot, to the special use; and
WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the
Village of Oak Brook on February 6, 2001, pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by both the said Zoning Board of Appeals and
Plan Commission that the amendments to the aforementioned special use set forth below be granted, and
WHEREAS, in an unrelated application for a text amendment to the extraordinary setback
requirement along York Road, which is now under consideration by this Board, the Plan Commission and
Zoning Board of Appeals have recently recommended that the setback requirement along York Road be
reduced from 100 feet, as measured from the property line, to 100 feet, as measured from the centerline
of York Road, and
WHEREAS, the President and Board of Trustees concur with the recommendations of the Zoning
Board of Appeals and Plan Commission and deem the passage of this ordinance to be in the best interest
and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions set forth
below,

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1 - That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That the special use granted pursuant to Ordinances S -237, S -346, S -382, S -511, S-
583, S -728 and S -919 is hereby further amended to allow use of the property described in Section 4 for
construction and maintenance of additions to the church building for two nurture rooms, an audio visual
center above the bridge, and an expanded kitchen and new preschool atrium
Section 3. That the amendments to the special use herein granted pursuant to Section 2 of this
ordinance are expressly subject to the following conditions-
(1) That construction shall be in substantial conformity with the site and elevation plans
drawn by Larson & Darby, Inc and dated November 27, 2000, consisting of Sheets A2
and C1 and the plans which were submitted in a brochure accompanying the application,
except for plans pertaining to additional parking facilities which are specifically exIcluded,
(2) That consistent with the proposed amendment to text of the Zoning Ordinance now under
consideration by this Board, the proposed addition may encroach thirty feet (30') into the
required yard;
(3) That the proposed addition shall be consistent with the architecture of the existing
building, and
(4) That the proposed addition is subject to final engineering approval.
Section 4- That this ordinance is limited to property located at 501 Oak Brook Road, Oak
Brook, Illinois, which property is legally described as:
Lot 1 in the Christ Church Resubdivision of part of the Northwest Quarter of Section 36,
Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County,
Illinois, recorded on the 9th day of September, 1986 as Document No. R86- 107588 in the
Recorder's Office of DuPage County, IL Also, Lot "B" (except the North 250 feet thereof
measured along the East line) according to the survey of part of the West half of Section
36, Township 39 North, Range 11, East of the Third Principal Meridian, recorded
November 16, 1897 as Document 65421 in the Recorder's Office of DuPage County,
Illinois Also, Lot 2 in Henrickson's Resubdivision of that part of the West half of Section
36, Township 39 North, Range 11, East of the Third Principal Meridian, according to the
Plat thereof recorded October 4, 1982 as Document No R82 -45443 in the Recorder's
Office of DuPage County, IL. Permanent Parcel Nos. 06 -36- 107 -001 and 002 (501 Oak
Brook Road), 06 -36- 100 -004 (3212 York Road), and 06 -36- 103 -006 (3306 York Road) all
in Oak Brook, Illinois 60523
Section 4- That except as amended hereby, the special use granted pursuant to Ordinan
237, S -346, S -382, S -511, S -583, S -729 and S -919 be and the same is hereby ratified and confirr
respects.
Section 5- That this ordinance shall be in full force and effect from and after passage an
approval pursuant to law.
