RECOMMENDED MOTION: I move to concur with the recommendation of the Zoning
Board of Appeals and approve the requested variation to Section 13-6C-3F.1 and Section
13-6C-3F.3 of the Zoning Ordinance and authorize the Village Attorney to draft the
necessary ordinance for final consideration at the March 8, 2005 Board of Trustees
meeting.
Background/History:
At its meeting on February 1, 2005, the Zoning Board of Appeals reviewed a petition from Anya
Raskin and Joe Sosani, the owners of the home at 42 Yorkshire Woods who have submitted a
petition seeking approval of variations to Sections 13-6C-3-F.1 and 13-6C-3-F.3 of the Zoning
Ordinance to permit a front and rear-yard setback of less than the required 40-ft. in the R-3
District.
The applicants are proposing to construct several additions to the existing single-family home
that already encroaches into the required front and rear yards. The existing home was
constructed in 1947 under the regulations and requirements of DuPage County and has a current
front yard setback of 33.04-ft. and a rear yard setback of just under 5-ft.

Recommendation:
By a vote of 5 to 0, the Zoning Board of Appeals found that the petitioner met the required
standards to recommend approval of the variation request as requested subject to the following
conditions:
1. To reduce the front yard setback from 40 feet to approximately 307" and to reduce the
rear yard setback from 40 feet to approximately 35'9" and the proposed addition is to be

Peter Tromp, Tromp Architects and Joseph Sosani, the petitioner and owner of
the property at 42 Yorkshire Woods were sworn in by Chairman Davis.
Mr. Tromp reviewed the request. On October 22, 2004 the current homeowners,
Joe Sosani and Anya Raskin provided a bid for the property. The following
week on October 27, 2004 their bid was accepted. The property was purchased
with the knowledge that the house would need to be remodeled, updated and
added to in order to accommodate their family, which includes their 3 children,
mother-in-law and live-in nanny. The current plat of survey, which is dated
February 13, 1984, stated that the front building setback is 35 feet. This was
with the knowledge of the homeowner. The house is located as close as 33 feet
to the front property line. They had assumed that the additions would not be a
problem because it appeared that the house was grand fathered because of the
35 foot shown on the plat of survey and the proposed additions would not be
extending any further than the existing house already was.
Mr. Tromp said that he was hired on November 17, 2004 to design and provide
construction for the proposed work. At that time he investigated the site
requirements and noted that the existing house was nonconforming to the
Village of Oak Brook zoning regulations due to the front and rear yard setbacks
and that the existing lot area was less than the required size. After investigating
various design schemes they came to the conclusion that it would be required to
seek a variation to the front and rear yard setbacks, in order to minimize the
impact on the current plan and utilize the existing structure as much as possible.
Joe and Anya became the property owners as of January 18, 2005. Currently
they are paying for two mortgages and hope to sell their current house as soon
as possible in the spring.
The variations the are seeking are to the front and the rear and setbacks. The

front yard variation request is the result of putting on a new second floor onto
the existing one story house. The second floor will have four bedrooms, two
baths, a laundry room and a playroom. In addition, there will be a balcony off
the master bedroom. The front yard is also affected by extending the existing

two-car garage and adding a half car garage to the side of it. The front and rear
yard is affected by putting and filling in between the existing structure for a
walk-in closet and dressing area.
In support of the request the following was stated:
• The existing house was built in 1947 per the county's zoning
requirements. As a result, the existing home is non-conforming with
Oak Brook setback requirements.
• The existing lot size is non-conforming to the R-3 zoning requirement,
which is a minimum of 25,000 square feet. The existing lot is
approximately 17,522 square feet, which is 70% of the required lot size.
• The configuration of the existing lot is unique and quadrilateral in shape.
The lot lines area not parallel resulting in various lengths of setbacks to
the house.
• The homeowners would like to maintain as much of the existing house
as is possible and add to it to gain the area they will need for their
family. There are aspects of the house that are unique, such as the
existing family room and basement. These are unique and worthy to
maintain the economic and characteristics of the house.
• They have investigated different alternatives and in order to work with
as much of the existing house as possible a variation is required.
• In order to have the house conform to the current setback requirements it
would need to be demolished and relocated on the site. The alternative
would be a major financial burden, since the original intention was to
expand the existing house.
• The intent of the proposed additions is to not exceed the current non-
conforming front and rear yard setbacks. The walls will be in line or
behind the remaining existing walls. The required 12-foot side yard
setbacks and the 40-foot height regulations will be in compliance with
the proposed addition.
• They are proposing to extend approximately one-foot over the existing
roof overhang. That is because the existing overhang is one foot in the
front, but is necessitated in order to tie into the rear portion of the house,
which has a two-foot overhang. This is the only extension they are
seeking beyond the existing nonconformity. The walls will be in-line, if
not behind the current conditions.
• The homeowners desire to live in this house that was constructed in
1947.
• In order to accommodate the family size, additions are proposed to

expand and update the house while maintaining the established flow of
the existing floor plan. The design will enhance the neighborhood and
is consistent with the context and character of the neighborhood. There
have been additions constructed next to and across the street that are
similar in scope and size to what they have proposed.
• The proposed design will enhance the utility and value of the property.
• The proposed variation will not impair an adequate supply of light and
air to adjacent property, or substantially increase the danger of fire, or
otherwise endanger the public safety or substantially diminish or impair
property values within the neighborhood.
• The adjacent neighbors have reviewed the plans and have approved the
proposed expansions.
• A letter of approval for the requested variations has been provided from
the Yorkshire Woods Property Owners Association.
Chairman Davis summarized that there is an existing nonconformity and the
proposed additions only go beyond the existing nonconformity by one foot
along the front of the house. Mr. Tromp agreed.
Chairman Davis asked how they viewed the nonconformity of the size of the
lot. Mr. Tromp responded that he considered that the size and shape of the lot
was the reason the house was placed on the lot the way that it was. If it were a
larger lot, then it probably would have been behind the setbacks.
Chairman Davis asked why they received a 1984 survey. Mr. Sosani responded
that is what was given to them. When they purchased the house the new survey
still showed 35 feet.
Chairman Davis noted that was something that should be remedied with the
surveyor. Mr. Sosani said that the bank had to verify it for the loan approval.
Chairman Davis noted that there was an approval letter from the homeowners
association. He also noted that the homeowner association also represented the
approval of the adjacent neighbors.
Mr. Sosani said that he went to the neighbors and spoke with them. He said
that they walked around the house and he showed them exactly what he wanted
to do. He said that they looked at it and they all approved it.
Chairman Davis asked Mr. Sosani if he showed all his surrounding neighbors
the plans. Mr. Sosani responded that he had shown them the plans. He also

noted that one of the neighbors is an architect and is on the homeowner's
association review committee.
Member Young asked if the other properties that were granted variations were
for similar shaped properties. Mr. Tromp responded that he .did not know
whether variations were granted to the other properties. He just noted that they
had built similar additions. Mr. Sosani added that his lot is the smallest lot in
the neighborhood, so he did not think that the other lots would have required a
variation.
No one in the audience spoke in support of or in opposition to the requested
variation.
Chairman Davis said that it appears the petitioner has addressed the standards
as required in great detail and they are provided in writing on pages E-E.1 of
the case file. It appears that the situation is unique by reason of an existing
nonconforming use and an odd lot size and there is a hardship that is not of the
present owners own making. In addition to satisfying the standards, the
homeowners association and neighbors do not object. The request does not
appear to jeopardize the public health, safety or general welfare of any party.
Motion by Chairman Davis, seconded by Member Shah to recommend approval
of the variations as requested subject to the following conditions:

Reviewing this requested variation, I have several comments that you
may want to consider as part of your deliberations:

1. The lot located at 42 Yorkshire Woods encompasses 17522 sq.ft.
which is significantly smaller than the 25,000 sq.ff. minimum lot size
required in the R-3 Zoning District.
2. The applicant is proposing an additional 1'2" encroachment in
the front yard for a roof overhang.
RESPONSIBILITIES OF THE HEARING BODY:
The Zoning Board of Appeals has the responsibility to hold the required public
hearing and make a recommendation on the requested variation. Please include in
your consideration, your findings with respect to the standards specified in the
Zoning Ordinance for a variation. The materials submitted by the applicant
specifically address each of the standards.
CONCLUSION: Based on the information provided by Staff, if it is the opinion of the Zoning
Board of Appeals that the applicant has satisfied all applicable Ordinance
requirements and factors for a variation, a recommendation would be in order to
approve this request. The following conditions might be appropriate for inclusion
in a recommendation:
1. The development shall be in substantial conformance with the
plans (prepared by Tromp Architects dated 12/29/04) as
submitted.
2. Also, the Zoning Board of Appeals is authorized to recommend
additional conditions as they see fit.
However, if it is the opinion of the Zoning Board of Appeals that the applicant has
not fully satisfied the applicable ordinance requirements and factors for a
variation, a recommendation would be in order to deny this request.

13-6C-3: LOT AREA REQUIREMENTS:
A. Reduction Of Lot Area: Not less than twenty five thousand(25,000) square feet, except that
in subdivisions of eighty(80) acres or more in area, the lot area may be reduced to one-half
(1/2) acre provided that lands equal to ten percent(10%) of the total area be dedicated to the
Village, or agency approved by the Village Board, for park or recreational uses and no
portion of which shall be less than four(4) acres. The dedicated land shall be appropriate for
park or recreational uses, and shall not include wet drainageways in excess of twenty five
percent(25%) of the total dedicated area.
B. Lot Width: Not less than one hundred feet (100')within the buildable area.
C. Floor Area Ratio: Not to exceed 0.4 for nonresidential uses.
D. Structure Height:
1. Residential Uses: Not more than forty feet (40') except for continuous flat roofs, which
shall be not more than thirty feet(30') to the top of any parapet wall. However,where
residential building heights exceed thirty feet(30'), the highest space that can be occupied
must have an emergency escape and rescue opening at a maximum elevation of thirty two
feet(32') above grade.
2. Institutional And Other Nonresidential Uses: Not more than forty five feet (45').
E. Ground Floor Area Per Dwelling:
1. One Story: Not less than one thousand five hundred(1,500) square feet.
2. Bilevel: Not less than one thousand three hundred(1,300) square feet (floors at grade and
above basement).
3. Dwellings Having More Than One Story: Not less than one thousand (1,000) square feet.
F. Yom`: Except as required in subsections B and D under"accessory uses and structures" in
section 13-6A-1 of this chapter, yards shall be provided as follows:
1. Front: Not less than forty feet (40') in depth, except front yards abutting York Road and

Application for Variation

Reason for Variation Requested
On October 22, 2004 the current homeowners, Joe Sosani and Anya Raskin,provided a bid
for the house at the above addressed property. It was accepted the following week on
October 27. This property was purchased with the knowledge that the house would need to
be remodeled, updated and added to, in order to accommodate their 3 children, mother-in-law
and live-in nanny. The current plat of survey, dated February 13, 1984, states that the front
building setback is 35 feet. The house is located as close as 33.04 ft. to the front property
line. They assumed that these additions would not be a problem because it appeared that the
house was "grand-fathered"because of it's location beyond the 35 ft. requirement and the
proposed additions would not be extending any further than the existing house.
Peter Tromp of Tromp Architects, was hired on November 17, 2004 to design and provide
construction documents for the proposed work. At this time the architect investigated the site
requirements and noted that the existing house was non-conforming to the Village of Oak
Brook zoning regulations due to the front and rear yard setbacks and that the existing lot area
was less than the required size. After investigating various design schemes it was determined
that a variation is required to the front and rear yard setbacks in order to minimize the impact
on the current plan and utilize the existing structure as much as possible.
Joe and Anya became the owners of this property on January 18, 2005. Currently they are
paying for two mortgages and hope to sell their current house as soon as possible this spring.
Explanation of Variation Requested
The owners seeks a variation from the provisions of Section 13-6C-3.F-1 &
13-6C-3.F-3 of the Oak Brook Building Code for the purpose of remodeling an existing
home and increasing the square footage by:
1. Providing a second floor addition in order to accommodate 4 bedrooms, 2
bathrooms, laundry room,playroom and balcony from master bedroom.
2. Extend the existing garage to provide a two and a half car garage.
3. Relocate the existing kitchen and provide a new eating area and mud room.
4. Construct a walk in closet for bedroom#1.
Per section 13-6C-3.F-1 the front yard setback cannot exceed 40 ft. The petitioner is
requesting a variation of this setback for a length of 89 ft. (the entire length of the existing
house including the addition). The requested setback varies along this length because of the
configuration of the existing lot.
Maximum proposed setback is approximately 30'-7". The encroachment is
9'-5" into the required 40 ft. setback.
Minimum proposed setback is approximately 32'-4". The encroachment is
7'-8" into the required 40 ft. setback
Per section 13-6C-3.F-3 the rear yard setback cannot exceed 40 ft. The petitioner is
requesting a variation of this setback for a length of 10 ft. (the width of the proposed walk in
closet for bedroom#1). The requested setback varies along this length because of the
configuration of the existing lot.
Maximum proposed setback is approximately 35'-9". The encroachment is
4'-3" into the required 40 ft. setback.
Minimum proposed setback is approximately 37'-0". The encroachment is
3'-0" into the required 40 ft. setback
Pertinent Information:
1. The existing house was built in 1947 per the county's zoning
requirements. As a result, the existing house is non-conforming with
current Oak Brook setback requirements. The front and rear of the house
extend beyond the 40 ft. setback requirements.
2. The existing lot size is non-conforming to the R-3 zone min. requirement
of 25,000 sq. ft. The existing lot size is approximately 17,522 sq. ft.,
which is 70% of the required lot size.
3. The configuration of the existing lot is unique and quadrilateral in shape.
The lot lines are not parallel resulting in varying lengths of setbacks to the
house.
4. The homeowner would like to maintain as much of the existing house as is
possible and add to it to gain the area they will need for their 3 children,
mother-in-law and live-in nanny. There are aspects of the house, such as
the existing family room and basement, that are unique and worthy to
maintain for economic and character reasons. We have investigated
different alternatives, and in order to work with as much of the existing
house as possible a variation is required.
5. In order to have this house conform to the current setback requirements a
it would need to be demolished and an entire new house would have to be
constructed. This alternative would be a major financial burden, since the
original intention was to expand the existing house. Please note that the
existing lot size would still be non-conforming.
6. The intent of the proposed additions is to not exceed the current non-
conforming front and rear wall setbacks. The walls will be in line or
behind the remaining existing walls. The required 12 ft. side yard
setbacks and the 40 ft. height restriction will be in compliance with the
proposed addition.
7. Please note that the face of the existing overhang closest to the front
property line is approximately 31'-8". The face of the proposed overhang
is approximately 30'-6". This increase of 1'-2" is to match the existing
rear addition overhang dimension of 2'-0".
8. The existing house exceeds the rear yard setback for a length of 37 ft. The
existing setback varies along this length. The maximum encroachment is
8'-0" for a 32'-0"rear yard setback. The minimum encroachment is 13'-6"
for a 26'-6"rear yard setback.
9. The homeowners desire to live in this house that was constructed in 1947.
In order to accommodate the family size, additions are proposed to expand
and update the house while maintaining the established flow of the
existing floor plan. The design will enhance the neighborhood and are
consistent with the context and character of the neighborhood. There have
been additions constructed of similar scope and scale in the area.
Summary of Applicable Issues:
1. The existing house is non-conforming due to the existing front and rear
yard set backs and the existing lot area is smaller than the minimum
required for a lot in the R-3 Zoning District. The owner and architect have
designed the project's exterior walls so that they will not exceed the two
current non-conforming conditions. The height and side-yard
requirements will be in compliance with the proposed design..
2. The proposed design will enhance the utility and value of the property.
3. The proposed variation will not impair an adequate supply of light and air
to adjacent property, or substantially increase the danger of fire, or
otherwise endanger the public safety or substantially diminish or impair
property values within the neighborhood.
4. The adjacent neighbors have reviewed the plans and have approved the
proposed expansions.
5. A letter of approval for the requested variations has been provided from
the Yorkshire Woods Property Owners Association.

(13-14-6-D) Standards
(1) The Zoning Board of Appeals shall not recommend a variation of the provisions of
this Title as authorized in this Section unless it shall have made fmdings of fact
based upon the evidence presented to it on the following specific issues that:
(a) The property in question cannot yield a reasonable return if, permitted to be
used only under the conditions allowed by the regulations governing the
district in which it is located.
The existing house constructed in 1947 per the county's requirements is
non-conforming to the current Oak Brook R-3 zoning regulations. In
order for the house to be in compliance the existing house would need to
be demolished and relocated on the lot.
(b) The plight of the owner is due to unique circumstances.
The existing house is non-conforming due to front and rear yard
setbacks. The existing lot area is non-conforming. The current lot size is
17522 s.f., less than the required 25000 s.f. In addition, the lot
configuration is irregular.
(c) The variation, if granted, will not alter the essential character of the locality.
The proposed additions will not exceed the existing front and rear yard
non-conforming conditions. The side yard setbacks and height
restrictions for the neighborhood will be met per the R-3 requirements.
Also there have been projects constructed in the neighborhood that are
similar in scope and scale to the proposed project. The adjacent
neighbors have reviewed the plans and approved the proposed
expansions. A letter is provided from the neighborhood association.
(2) For the purpose of supplementing the above standards, the Zoning Board of
Appeals, in making the determination whether there are practical difficulties or
particular hardship, shall also take into consideration the extent to which the
following facts, favorable to the applicant, have been established by the evidence
that:
(a) The particular physical surroundings, shape, or topographical conditions of
the specific property involved would bring a particular hardship upon the
owner as distinguished from a mere inconvenience if the strict letter of the
regulations were to be carried out.
The existing location of the house and the lot area is non-conforming. In
order to expand and up date the house with a second floor addition,
larger kitchen and expand the garage a variation is required.

(b) The condition upon which the petition for variation is based would not be
applicable generally to the other property within the same zoning
classification.
This property is legal non-conforming because the lot size is sub-standard
and the house location is within the required setbacks in accordance to
current R-3 Zoning District requirements.
(c) The granting of the variation will not be detrimental to the public welfare or
injurious to other property or improvements in the neighborhood in which the
property is located.
The proposed expansion of this house will enhance the value of the
surrounding property. A letter of approval for the requested variations
has been provided from the Yorkshire Woods Property Owners
Association.
(d) The proposed variation will not impair an adequate supply of light and air to
adjacent property, or substantially increase the danger of fire, or otherwise
endanger the public safety or substantially diminish or impair property values
within the neighborhood.

(e) That the purpose of the variation is not based exclusively upon a desire to
make more money out of the property.
The petitioners are the owners of the property and would like to expand
and remodel this house in order to accommodate the needs for their
family.
(f) That the alleged difficulty or hardship has not been created by any person
presently having an interest in the property.
The current hardship is due to the fact that the house was constructed in
1947 per county requirement. The current Oak Brook R-3 Zoning
regulations differ so the house is legal non-conforming due to lot area and
front and rear yard setbacks.

AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF SECTIONS 13- 6C -3F(1) AND 13- 6C -3F(3)
OF TITLE 13 ( "ZONING REGULATIONS ") OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK RELATIVE TO
FRONT AND REAR YARD SETBACK REQUIREMENTS

WHEREAS, an application has been filed requesting a variation from the provisions of Sections
13- 6C -3F(1) and 13- 6C- 3 -F(3) of Title 13 (`Zoning Regulations ") of the Village Code, which requires a
forty foot (40') front yard setback and a forty foot (40') rear yard setback, to permit the construction of
several additions to the existing single - family home which would have a thirty foot, seven inch (307") front
yard setback and a thirty -five foot, nine inch (35'9 ") rear yard setback on the property commonly known
as 42 Yorkshire Woods, Oak Brook, Illinois, legally described below, and - -
WHEREAS, a public hearing of such application has been conducted by the Zoning Board of
Appeals of the, Village of Oak Brook on February 1, 2005 pursuant to due and appropriate legal notice,
and
WHEREAS, the said Zoning Board of Appeals made explicit findings of fact that the variation
requested conforms to the standards set forth in Sections 13- 6C -3F(1) and 13- 6C- 3 -F(3) of the Village
Code, and
WHEREAS, the Village President and Board of Trustees concur with the recommendations and
findings made by the Zoning Board of Appeals,

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein
Section 2 That a variation is hereby granted from the provisions of Section 13- 6C -3F(1) of the
Village Code of the Village of Oak Brook to permit construction of several additions to the existing single -
family home and allow a front yard setback of thirty feet, seven inches (307")
Section 3 That a variation is hereby granted from the provisions of Section 13- 6C -3F(3) of the
Village Code of the Village of Oak Brook to permit construction of several additions to the existing single -
family home and allow a rear yard setback of thirty -five feet, nine inches (35'9 "), in substantial
conformance with the site plan labeled Sheet 1, dated December 29, 2004 on page K of the case file
Section 4 That this Ordinance is limited and restricted to the property known as 42 Yorkshire
Woods, Oak Brook, Illinois, which property is legally described as follows
Lot Forty -Two in Yorkshire Woods, A Subdivision in Section 24, Township 39 North, Range 11
East of the Third Principal Meridian, according to the plat thereof recorded November 14, 1947 as
Document 534056 and rerecorded as Document 535991, in DuPage County, Illinois

Failure to complete the several additions to the existing single - family home described in Sections 2
through 4 within two years from the date of passage of this ordinance shall render this variation null and
void without further notice or action by the Village
Section 5 All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of the conflict
Section 6 This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law
