RECOMMENDATION: That the Village Board approve the attached revised ordinance granting a
variation from the provisions of Section 13 -6C -3F of the Zoning
Ordinance of the Village of Oak Brook relative to side yard requirements
Through a misunderstanding, we neglected to include a condition in the Hartmann variation which
required planting evergreen plant material alongside the proposed addition facing Palisades Drive.
The attached ordinance corrects this understanding.
I understand this matter is on the consent agenda for your April 23, 2002 meeting.

3. President Bushy stated the York Township Assessor's Office total assessed
value of the Village of Oak Brook is $1,181,452,575, which is an increase of
7.36% from last year.
4. APPROVAL OF MINUTES:
Motion by Trustee Caleel, seconded by Trustee Korin, to approve the minutes
of the Regular Board of Trustees Meeting of April 9, 2002 as presented and
waive the full reading thereof. VOICE VOTE: Motion carried.

will be enacted in one motion.
Motion by Trustee Caleel, seconded by Trustee Craig, to approve the Consent

Variation — The Zoning Board of Appeals, by a vote of 4 to 1, has
recommended approval of the request from Mr. Ty Warner for a variation to
allow the installation of driveway gates on a residential property of less than
one acre.
In recommending approval of this request, the Zoning Board of Appeals
found that the petitioner has satisfactorily addressed the factors required for
approval of a variation. This motion was based on the consensus that, in
particular, it was found that the hardship of the property owner is not of
their own making; unique circumstance; threats that have been made upon
the petitioner; the lot having 250 feet of frontage and the presence of
significant landscaping that limits the view of the driveway and home from
Baybrook Lane. It was also found that the variation, if granted, would not
alter the essential character of the locality. In making this recommendation,
the Zoning Board attached the following conditions:
1. The petitioner obtains the required permit.
2. The swing of the gates meets the intent of the Village Code.
3. That any encroachment of the gates onto other properties is
resolved.

A REVISED ORDINANCE GRANTING A VARIATION FROM
THE PROVISIONS OF SECTION 13 -6C -3F
OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK
RELATIVE TO SIDE YARD REQUIREMENTS

WHEREAS, an application has been filed requesting a variation from the provisions of Section 13-
14-6 of the Zoning Ordinance of the Village of Oak Brook to permit the construction of an addition
encroaching approximately 29 feet into the required 40 -foot side yard on the property hereinafter
described; and
WHEREAS, a public hearing on such application has been conducted by the Zoning Board of
Appeals on March 5, 2002 pursuant to due and appropriate legal notice; and
WHEREAS, the said Zoning Board of Appeals made explicit findings of fact that the variation
requested conforms to the standards set forth in Section 13 -14 -6 of the Oak Brook Zoning Ordinance; and
WHEREAS, the corporate authorities have reviewed the recommendation and findings made by the
Zoning Board of Appeals and deem the granting of the variation requested to be appropriate and in the
best interest and in furtherance of the public health, safety and welfare; and
WHEREAS, on March 26, 2002, this Board passed Ordinance 2002- ZO -V -S -1012 which approved
the requested variation, but through inadvertence, a condition regarding landscaping was omitted; and
WHEREAS, the Board wishes to include the condition regarding landscaping as set forth below.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though
fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of Section 13 -6C -3F of the Zoning
Ordinance of the Village of Oak Brook so as to permit construction of an addition encroaching
approximately 29 feet into the required 40 -foot side yard, provided that the addition is constructed in
substantial conformity with plans as depicted on the Plat of Survey, labelled Exhibit "K", and dated
December 10, 1997, a copy of which is incorporated herein by reference, and evergreen plant material is
planted along the long wall of the addition facing Palisades Drive.
Section 3: That this Ordinance is limited and restricted to the property located at 44 Meadowood
Drive, Oak Brook, IL, which property is legally described as follows:
Lot 44 in Woodside Estates, a subdivision in the West Half of the Northeast Quarter of
Section 24, Township 39 North, Range 11, East of the Third Principal Meridian, according to
the plat thereof recorded October 26, 1948 as Document No. 556874 in DuPage County, IL.
Permanent Parcel No. 06 -24- 204 -001.
