SUBJECT: Sale of Surplus Vehicles and Public Works Equipment via DuPage Mayors &
Managers Conference

RECOMMENDED MOTION: I move that the Village Board Board pass the attached
ordinance declaring five vehicles and various Public Works equipment as surplus and
authorizing their sale through the DuPage Mayors and Managers Conference public
auction.
Background/History:
The attached ordinance declares five vehicles and various Public Works equipment as surplus
and authorizes their sale at the DuPage Mayors and Managers Conference surplus vehicle and
equipment auction. The vehicles declared surplus will be four Public Works vehicles: unit
numbers 510, 512, 521, and 603, and one Fire Department vehicle: unit number 913. The
attached ordinance contains the age and the approximate current mileage for these vehicles. The
Public Works equipment is either outdated, needs repair, or parts are not available. The
Conference charges a 15% administrative fee, which will be subtracted from the gross receipts.
Also, a $50 charge is imposed on any vehicle or piece of equipment that is brought to the auction
and does not sell.
The auction is scheduled for Saturday, June 19, 2004 at the College of DuPage, with bidding
beginning at 10:00 am. As in past years, the Village is required to supply one staff person
(usually a Police Officer) to assist the Conference with the-auction. Village officers, employees
and their families are not allowed to bid on Oak Brook surplus vehicles and equipment, but are
allowed to bid on items from other organizations.

Recommendation:

3. President Quinlan also requested that selective police enforcement be instituted for the
street along with the speed wagon including Spring Road.
Trustee Konn remarked that there are very stringent rules for installation of stop signs.
She asked that staff work on this project as soon as possible due to the playground area,
playing fields and park being used after school and the weekends.
4. APPROVAL OF MINUTES:
Regular Board of Trustees Meeting of May 11, 2004
Motion by Trustee Caleel, seconded by Trustee Korin, to approve the minutes of the May
11, 2004 Regular Board of Trustees meeting. VOICE VOTE: Motion carried.

All items on the Consent Agenda are considered to be routine in nature and will be
enacted in one motion.
Trustee Korin asked that Agenda Items 5. C. Community Development Referrals, 1)
McDonald's Corporation - 22nd /Spring - Final Subdivision; 2) McDonald's Corporation -
22nd /Sptnng - Text Amendments and 3) McDonald's Corporation - 22nd / Spnng - Special
Uses be removed from the Consent Agenda for further discussion.
Motion by Trustee Aktipis, seconded by Trustee Caleel, to approve the Consent Agenda
and authorize expenditures as amended. ROLL CALL VOTE:
Ayes: 6 - Trustees Aktipis, Caleel, Craig, Korin, Yusuf and Zanms.
Nays: 0 - None.
Absent: 0 - None. Motion carried.

Trustee Konn asked that this Agenda Item 5. C. 1, 2 and 3 be removed for further
discussion. She explained that the wording should be changed in the motion. It states to
refer to the Plan Commission with verbiage to review and recommend on the same day
rather than allowing them as much time as possible.
Motion by Trustee Konn, seconded by Trustee Zannis, to refer to the Plan Commission
for review at its June 21, 2004 meeting the request form the McDonald's Corporation for
a final plat of subdivision for the property located at the northeast of 22' Street and
Spring Road, and to the Zoning Board of Appeals for Public Hearing at its July 2004
meeting for text amendments to the Zoning Ordinance in order to construct a new
restaurant at the corner of 22nd Street and Spring Road and for two special uses in order to
construct a new restaurant at the corner of 22nd Street and Spring Road. ROLL CALL

AN ORDINANCE AUTHORIZING THE SALE
BY PUBLIC AUCTION OF PERSONAL PROPERTY
OWNED BY THE VILLAGE OF OAK BROOK
WHEREAS, in the opinion of at least a simple majority of the corporate authorities of the
Village of Oak Brook, it is no longer necessary or useful to or for the best interests of the Village
of Oak Brook to retain ownership of the personal property hereinafter described; and
WHEREAS, it has been determined by the President and Board of Trustees of the
Village of Oak Brook to sell said personal property at the DuPage Mayors and Managers
Conference public auction to be held on Saturday, June 19, 2004.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES,
ILLINOIS as follows:
Section 1 • That the provisions of the preamble hereinabove set forth are hereby adopted
as though fully set forth herein
Section 2- That pursuant to 65 ILCS 5/11 -76 -4, the President and Board of Trustees of
the Village of Oak Brook find that the personal property, described in Exhibit A and attached
hereto and made a part hereof, now owned by the Village of Oak Brook, is no longer necessary
or useful to the Village of Oak Brook and the best interests of the Village of Oak Brook will be
served by its sale.
Section 3: Pursuant to said 65 ILCS 5/11 -76 -4, the Village Manager is hereby
authorized and directed to sell the aforementioned personal property now owned by the Village
of Oak Brook at the DuPage Mayors and Managers Conference public auction, on Saturday,
June 19, 2004 at the College of DuPage, Glen Ellyn, Illinois, to the highest bidder on said
property.
Section 4: The Village Manager is hereby authorized and may direct the DuPage
Mayors and Managers Conference to advertise the sale of the aforementioned personal
property in a newspaper published within the county before the date of said public auction
Section 5• The Village Manager is hereby authorized and may direct the DuPage
Mayors and Managers Conference to enter into an agreement for the sale of said personal
property The Conference will charge an administrative fee that will come out of the proceeds
from the sale of surplus vehicles and equipment described in Exhibit A.
Section 6: Upon payment of the full auction price, the Village Manager is hereby
authorized and directed to convey and transfer title to the aforesaid personal property to the
successful bidder.
Section 7: This ordinance shall be in full force and effect from and after passage, by a
simple majority vote of the corporate authorities, and approval pursuant to law
