RECOMMENDED MOTION: Move to amend Title 6, Chapter 1, Section 9 of the Oak brook
Code of Ordinances to prohibit the possession and sale of synthetic drugs in the Village of Oak
Brook.
Background/History: Synthetic drugs are chemically laced substances akin to marijuana, cocaine
and methamphetamine that are sold over the counter at convenience stores, gas stations and
tobacco shops throughout Illinois. Based on their chemical make -up, these drugs are commonly
divided into two categories: Cannabinoids Popularly known as K2 or Spice, cannabinoids
contain chemical compounds designed to mimic the effects of THC. Cathinones Often known as
"bath salts," cathinones contain chemical compounds to mimic the effects of cocaine or meth.
Though the drugs' packaging states the products are not intended for human consumption, their
design, labeling and marketing clearly allude to the product being smoked and inhaled. One
reason that synthetic drugs are extremely dangerous is that buyers don't know what chemicals
they are ingesting. Individual products can contain a vast range of different chemical
formulations and potencies, some of which can be two to 500 times stronger than THC.
According to the American Association of Poison Control Centers, calls nationwide indicate a
dramatic rise in synthetic drug abuse. In 2010, poison control centers received 302 calls about
bath salts. In 2011, centers received more than 5,600 reports of bath salt abuse. Synthetic
marijuana use is also on the rise. In 2010, there were more than 2,900 calls from around the
country to poison control centers, and in 2011, there were more than 5,700.
Two years ago the Illinois General Assembly took action to prohibit many of these compounds.
However, the law was somewhat hard to enforce. It defined specific chemical compounds that
would cause law enforcement to perform a scientific analysis on the substance for the exact

compound. No field- testing is available yet. The law was subsequently amended last year to
make it broader and easier to enforce by adding significantly more compounds. Since then many
Illinois municipalities have opted to pass local ordinances to prohibit these substances from
being possessed as well as sold by merchants in the community. The DuPage Mayors' and
Managers Association is also recommending all communities pass local ordinances prohibiting
these substances. There have been several tragic deaths of our young people detailed in the
media the past year right in our suburban area and it is important that we do whatever we can to
heighten awareness of this issue as well as eliminate it in our community. Local ordinances are
much easier to enforce for the police department as well and will allow the violation to be
brought forth through adjudication or local field court.
Recommendation: Staff recommends the passage of the amendment to allow for the
enforcement and prosecution of these violations by local ordinance. This will also bring our
current ordinance prohibiting the possession of cannabis and paraphernalia up to date to include
these synthetic substances that are as dangerous or even more so.

Staying vigilant on synthetic drugs

When the General Assembly enacted a law prohibiting the sale of hallucinogenic "bath salts" last year and
followed that up with a prohibition of synthetic marijuana, effective this January, the torch could have been
passed to law enforcement. Our towns and schools could have washed their hands of it and moved on to other
pressing matters.
Many did not, and for that they deserve praise. To those who have dropped it, get your heads out of the sand.
There is much more to be done.
Last fall after the vote in Springfield we admonished community leaders to stay on top of this issue with anti-
drug events and public awareness campaigns. We urged parents to spell out the dangers to their kids and help
them make smart decisions.
Here are a few examples of those who are advancing the cause and ensuring both kids and their parents are
getting the message about these potentially lethal chemistry-set highs:
The Lake in the Hills, Algonquin and Huntley police departments and Huntley Unit District 158 are inviting
middle and high school students and their parents to Marlowe Middle School in Lake in the Hills April 12 for a
talk on synthetic and designer drugs.
On April 11, a Kane County panel — including Karen Dobner, whose son Max died from crashing his car after
trying synthetic marijuana — and two others who lost their kids will speak at St. Charles East High School. The
father of a Glenbard North High School sophomore who drowned after an underage drinking party also will
participate.
In St. Charles, school board members are considering adding, among other things, possession or use of
synthetic pot to the list of banned student behaviors that already includes such things as bullying and hazing. It
would outlaw versions of synthetic pot that don't technically contain an illegal drug or controlled substance.
St. Charles aldermen voted to ban synthetic marijuana on a citywide basis in November. Many other suburbs
did, too.
But in Mundelein, officials have targeted the manufacture, sale and possession of synthetic drugs by adopting
local rules that far exceed what the state law covers. The village now outlaws more than 200 products and
substances that the U.S. Drug Enforcement Agency has deemed dangerous. It's Police Chief Ray Rose's way
of staying a step ahead of the manufacturers of these drugs who merely tweak their formulas whenever a
particular ingredient is targeted for prohibition.
Under Mundelein's new rules, anyone found guilty of possessing or using any synthetic drug will be fined
between $250 and $750. Anyone found guilty of manufacturing or selling such substances will be fined
between $500 and $750.
The combination of heightened awareness, more conversation with our kids and stiff penalties is sure to make
a dent in this scourge. Bravo, everyone. Now let's not lose the pace.

ILLINOIS CONTROLLED SUBSTANCES ACT, 720 ILCS 570/100, ET SEQ., INCLUDING
PRODUCTS CONTAINING THE FOLLOWING CHEMICALS, IS A FELONY. PRODUCTS THAT
CONTAIN THESE CHEMICALS MAY ALSO VIOLATE THE ILLINOIS FOOD, DRUG AND
COSMETICS ACT, 410 ILLS 620/19 ET SEQ.:

• Any compound structurally derived from 1 (1 naphthylmethyl) indene by substitution at the 3

ORDINANCE 2012- PD -OF -G -971
AN ORDINANCE AMENDING TITLE 6, CHAPTER 1, SECTION 9
OF THE VILLAGE CODE REGARDING OFFENSES RELATING TO SYNTHETIC DRUGS
WHEREAS, Section 11 -20 -5 of the Illinois Municipal Code, 65 ILCS 5/11 -20 -5, authorizes
municipalities to adopt regulations that may be necessary or expedient for the promotion of health or the
suppression of disease; and
WHEREAS, the Federal Drug Enforcement Administration ( "DEA") has determined that the
consumption of synthetic cannabinoids can cause adverse health effects such as agitation, anxiety,
nausea, vomiting, tachycardia, elevated blood pressure, tremors, seizures, hallucinations, paranoid
behavior and non- responsiveness; and
WHEREAS, the DEA has further determined that consumption of synthetic stimulants affects
alertness, and has been linked to severe psychotic episodes, increased heart rates, panic attacks and
hallucinations; and
WHEREAS, the President and Board of Trustees of the Village of Oak Brook ( "Village ") find that
products containing synthetic cannabinoids, synthetic stimulants and synthetic psychedelic hallucinogens
(collectively, "Synthetic Drugs") adversely affect the health of people who use or consume them; and
WHEREAS, the President and Board of Trustees find that products containing Synthetic Drugs
are marketed, and pose a particular health hazard, to children and young adults; and
WHEREAS, the President and Board of Trustees deem it necessary and expedient for the
promotion of health and the general welfare of the citizens of the Village to prohibit the sale, delivery,
possession and use of products containing Synthetic Drugs,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are incorporated into, and made a part of, this
Ordinance as the findings of the Village President and Board of Trustees.
Section 2: Amendment to Title 6, Chapter 1, Section 9 of the Village Code. Title 6, Chapter
1, Section 9, entitled "Offenses Relating to Drugs," of the Village Code of the Village of Oak Brook,
Illinois, as amended, shall be amended as follows:
"A. Definitions
CANNABIS: Includes marijuana, hashish and other substances which are identified
as including any parts of the plant Cannabis sativa, whether growing or not; the
seeds thereof, the resin extracted from any part of such plant; and any compound,
manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin,
including tetrahydrocannabinol (THC) and all other cannabinol derivatives, including
its naturally occurring or synthetically produced ingredients, whether produced
directly or indirectly by extraction, or independently by means of chemical synthesis
or by a combination of extraction and chemical synthesis; but shall not include the
mature stalks of such plant, fiber produced from such stalks, oil or cake made from
the seeds of such plant, any other compound, manufacture, salt, derivative mixture,
or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil
or cake, or the sterilized seed of such plant which is incapable of germination.

DELIVER OR DELIVERY: The actual, constructive or attempted transfer of
possession, with or without consideration, regardless of whether there is an agency
relationship between the deliverer and deliveree.
DRUG PARAPHERNALIA: All equipment, products and materials of any kind which
are peculiar to and marketed for use in planting, propagating, cultivating, growing,
harvesting, manufacturing, compounding, converting, producing, processing,
preparing, testing, analyzing, packaging, repackaging, storing, containing,
concealing, injecting, ingesting, inhaling or otherwise introducing into the human
body cannabis or a controlled substance. It includes, but is not limited to:
1. Kits peculiar to and marketed for use in manufacturing, compounding, converting,
producing, processing or preparing cannabis or a controlled substance;
2. Isomerization devices peculiar to and marketed for use in increasing the potency
of any species of plant which is cannabis or a controlled substance;
3. Testing equipment peculiar to and marketed for private home use in identifying or
in analyzing the strength, effectiveness or purity of cannabis or controlled
substances;
4. Diluents and adulterants peculiar to and marketing for cutting cannabis or a
controlled substance by private persons;
5. Objects peculiar to and marketed for use in ingesting, inhaling, or otherwise
introducing cannabis, cocaine, hashish, or hashish oil into the human body
including, where applicable, the following items:
Air driven pipes;
Bongs;
Carburation tubes and devices;
Carburetor pipes;
Chillums;
Electric pipes;
Ice pipes or chillers;
Miniature cocaine spoons and cocaine vials;
Smoking and carburetion masks;
Water pipes;
6. Any item whose purpose, as announced or described by the seller, is for use in
violation of this Section.
PRODUCT CONTAINING A SYNTHETIC ALTERNATIVE DRUG: Any product
containing a synthetic cannabinoid, stimulant or psychedelic /hallucinogen, as those
terms are defined herein. The following products have been determined to contain
a synthetic cannabinoid, stimulant or psychedelic/hallucinogen, but the list below is
not exhaustive and violations of this section described in subsection E are not
limited to the possession, sale, delivery or use of products listed herein:

SYNTHETIC STIMULANT: any compound that mimics the effects of any federally controlled
Schedule I substance such as cathinone, methcathinone, MDMA and MDEA, including, but

preparation, substance and their analog (including salts, isomers, and salts of isomers)
containing substances which have a stimulant effect on the central nervous system, such

17. Any compound that is structurally derived from 2- amino -1 - phenyl -I- propanone by
modification or substitution in any of the following ways:
a. in the phenyl ring to any extent with alkyl, alkoxy, alkylenedioxy, haloalkyl, or
halide substituents, whether or not further substituted in the phenyl ring by one
or more other univalent substituents;
b. at the 3- position with an alkyl substituent;
c. at the nitrogen atom with alkyl, dialkyl, benzyl, or methoxybenzyl groups; or
d. by inclusion of the nitrogen atom in a cyclic structure.
B. Cannabis: It shall be a violation of this Section for any person knowingly to
possess any quantity of any substance containing Cannabis, except that the
effect of this Section shall be limited to persons knowingly possessing less
than thirty grams (30 g) of any substance containing Cannabis.
C. Drug Paraphernalia: It shall be a violation of this Section for any person to
knowingly possess any drug paraphernalia.
D. Inhaling Or Drinking Certain Substances: No person shall possess, inhale,
breathe or drink any compound liquid or chemical containing nitric oxide,
toluol, hexane, trichloroethylene, acetone, toluene, ethyl acetate, methyl ethyl
acetone, trichloroethane, isopropanol, methyl isobutyl ketone, methyl
cellosolve acetate, cyclohexanone, or any other substance for the purpose of
inducing symptoms of intoxication, elation, dizziness, paralysis, irrational
behavior, or in any manner to change, distort or disturb the audio, visual or
mental processes. For the purpose of this Section, any such condition so
induced shall be deemed to be an intoxicated condition, provided, however,
that the provisions of this subsection shall not apply to any person who
inhales, breathes or drinks such material or substances pursuant to the

direction or prescription of any doctor, physician, surgeon, dentist or
podiatrist authorized to so direct or prescribe. (Ord. G -577, 10 -22 -1996)
E. Product Containing A Synthetic Alternative Drug: No person shall:
Knowingly possess a Product Containing a Synthetic Alternative Drug,
including, without limitation, the products listed in Section 6 -1 -9.A of this
Code;
2. Sell, offer for sale or deliver any Product Containing a Synthetic
Alternative Drug, including, without limitation, the products listed in
Section 6 -1 -9.A of this Code;
3. Be under the influence of a Product Containing a Synthetic Alternative
Drug, including, without limitation, the products listed in Section 6 -1 -9.A
of this Code."
Section 3: Severability. If any provision of this Ordinance or part thereof is held invalid by a
court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and
effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose
and intent of this Ordinance to the greatest extent permitted by applicable law.
Section 4: Effective Date. This ordinance shall be in full force and effect from and after its
passage, approval and publication as required by law.
