RECOMMENDATION: That the Village President and Board of Trustees approve the attached
ordinance granting a flood plain special use permit to the property at 824 Merry Lane
Pursuant to your direction, I have drafted the attached ordinance which grants a flood plain special use
to permit construction of a new driveway for the proposed new single - family residence at 824 Merry
Lane located within the flood plain
I understand you will consider this ordinance at your regular meeting on Tuesday, July 9, 2002.

8. B. 1) At the present time the Village will not differentiate charges between
BLS, ALS 1, and ALS2 until the Medicare rates for any of these levels of
service exceed the new $300.00 rate. Once this occurs appropriate
revisions in the rate will be recommended.
Motion by Trustee Caleel, seconded by Trustee Craig, to pass Ordinance
2002 -FD- EMS -G -700, "An Ordinance Amending Section 3 -2 -6A of the
Village Code of the Village of Oak Brook and Increasing Fees For Use of
Emergency Medical Service Provided by the Oak Brook Fire
Department" which decreases the fee for an ambulance transport to $300
for residents, increases the fee for an ambulance transport to $500 for
non - residents and implements a mileage charge of $5.47 per mile. ROLL
CALL VOTE:
Ayes: 6 - Trustees Aktipis, Caleel, Craig, Korin, Miologos and Savino.
Nays: 0 - None.
Absent: 0 - None. Motion carried.

This ordinance grants a flood plain special use to permit construction of a

Motion by Trustee Savino, seconded by Trustee Caleel, to pass
Ordinance 2002- ZO- SU -FP -S -1020, "An Ordinance Granting a Flood

AN ORDINANCE GRANTING A FLOOD PLAIN SPECIAL USE PERMIT
PURSUANT TO SECTION 9 -1 -8 OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK, ILLINOIS
(824 Merry Lane, Oak Brook, IL 60523)
WHEREAS, the owner of certain property described herein has petitioned the corporate
authorities of the Village of Oak Brook, DuPage and Cook Counties, Illinois, for a Flood Plain Special Use
Permit under Section 9 -1 -8 of the Village Code of the Village of Oak Brook, relating to flood plain and
wetland regulations; and
WHEREAS, the Plan Commission of the Village of Oak Brook has considered the petition; and
WHEREAS, a public hearing on such petition has been conducted by the Zoning Board of
Appeals of the Village on May 7, 2002, pursuant to due and appropriate legal notice; and
WHEREAS, the Zoning Board found that the proposed use satisfies the requirements of and is
consistent with each of the factors set forth in Section 9 -1 -5 of the Village Code of the Village of Oak
Brook; and
WHEREAS, both the Plan Commission and Zoning Board of Appeals have recommended
approval of the petition, because the proposed use is consistent with the best use of the flood plain; and
WHEREAS, the corporate authorities of the Village of Oak Brook concur with the
recommendations of the Plan Commission and Zoning Board of Appeals and deem the passage of this
ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That pursuant to Section 9 -1 -8 of the Village Code of the Village of Oak Brook, Illinois,
a Flood Plain Special Use Permit is hereby granted to permit construction of a new driveway in substantial
conformity with the Topographical Survey and Site Development Plan prepared by Landmark Engineering
Corporation dated April 19, 2002, said property being legally described as:
Lot 11 in Merry Lane Subdivision, being a subdivision of part of the East Half of Section
23, Township 39 North, Range 11 East of the Third Principal Meridian, according to the
plat thereof recorded on December 15, 1964 as Document No. R64 -4691 in DuPage
County, Illinois.
