RECOMMENDED MOTION: Motion for Passage of Ordinance G -889, An Ordinance
Establishing Additional Requirements for the Issuance of a Taxicab Driver's License and
Amending Section 4 -2 -5 of the Village Code of the Village of Oak Brook
BacklZround /History:
During a previous revision of the Village Code regarding Taxicab Driver's qualifications, the
prohibition of issuance of a driver's license to individuals convicted of operating a motor vehicle
under the influence of alcohol was inadvertently deleted. The new phraseology in the previous
revision indicating "an intoxicating compound" was assumed to include alcoholic liquor.
However, definition of "intoxicating compound" in the State Statutes does not include alcoholic
liquor. Therefore, staff feels that it is important to add alcoholic liquor to Village Code in order
to protect the public health, safety and welfare.
Recommendation:
Staff recommends passage of Ordinance G -889 which adds "alcoholic liquor" as a qualifier for
prohibiting the issuance of a taxicab drivers' license.

AN ORDINANCE ESTABLISHING ADDITIONAL REQUIREMENTS
FOR THE ISSUANCE OF A TAXICAB DRIVER'S LICENSE AND AMENDING SECTION 4 -2 -5
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK
WHEREAS, the Corporate Authorities of the Village of Oak Brook have determined that in order
to protect the public health, safety and welfare it is necessary to prohibit the issuance of taxicab drivers'
licenses to individuals convicted of certain offenses pertaining to the operation of a motor vehicle under
the influence of alcohol
NOW, THEREFORE, be it ordained by the President and Board of Trustees of the Village of Oak
Brook, DuPage and Cook Counties, Illinois, as follows
Section 1 The foregoing preamble is restated and incorporated herein by reference as though
fully set forth herein
Section 2 Section 4 -2 -5 D 2 b is amended to read as follows
Unlawful possession of any controlled substance, cannabis, intoxicating compound or
alcoholic liquor within the past five (5) years
Section 3 Section 4 -2 -5 D 3 is amended to read as follows
The applicant has been convicted of driving under the influence of a controlled
substance, cannabis, an intoxicating compound or alcoholic liquor
Section 4 If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not affect any of the other provisions of this ordinance
Section 5 All ordinances in conflict herewith are hereby repealed to the extent of such conflict
Section 6 This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law
