SUBJECT: An Amendment to Title 4, Solicitors and Peddlers of the Village Code of the
Village of Oak Brook, Illinois

RECOMMENDATION: That the Village Board of Trustees approve Ordinance 2003 -
LC-SOL-G, "An Ordinance Amending Title 4, ( "Solicitors and Peddlers "), of
the Village Code of the Village of Oak Brook, Illinois By Amending Sections
4 -4A -3( "TERM; RENEWAL "), 44A -7 ( "FEES ") and 4411-3 ( "Term,
Renewal ")
Staff has recommended an increase in the fees for a commercial solicitor and peddler permit
from $50.00 to $125.00. It is also recommended a change in the length of a commercial or non-
commercial solicitation permit from thirty (30) days to ninety (90) days. Previously, the permit
was for thirty (30) days with a renewal up to six (6) months. Staff has recommended these
changes due to the amount of time involved processing each application as the commercial
solicitation permit could be renewed at no cost. Each time a renewal permit is issued,
identification badges have to be printed and the Police Department processes a background
check. Presently, three companies have a commercial solicitation permit at this time. The
Village Attorney has drafted the appropriate ordinance for Village Board consideration at this
time.

the Retreat Wing. All other provisions of the existing special use will
continue. Specific conditions attached to the recommendations of the Plan
Commission and Zoning Board include:
• The development shall be in substantial conformance with the plans as
submitted.
• The new stormwater management plan for the site will be designed so
that it is not detrimental to the existing water features located on the
Mayslake property.
• The new production kitchen will be designed to limit the emission of
cooking odor as well as meet all requirements of the DuPage County
Health Department.
• All lighting to be located within the new parking lot and along the new
entrance drive shall be properly shielded in accordance to Village Code
• Final engineering approval.
• All other provisions of Ordinances S -1015, S -986 and S -841 are
maintained in full force and effect.
In making these recommendations, both the Plan Commission and Zoning
Board of Appeals found that the petitioner has satisfactorily addressed the
applicable factors for approval of an amendment to a special use.
Trustee Aktipis explained that this process must be reviewed and approved
by the Illinois Historic Preservation Society before the Village Board could
address this request.
Motion by Trustee Aktipis, seconded by Trustee Caleel, to continue this to a
further date in time. VOICE VOTE: Motion carried.

Trustee Caleel voiced his opposition to commercial solicitors within the
Village. Clerk Gonnella explained that any resident who does not wish
to have solicitors may request a "No Solicitors" sign from the Village
and that our ordinance reads that if a solicitor does not heed the sign,
they are in violation of Village Code.
Motion by Trustee Aktipis, seconded by Trustee Craig, to approve
Ordinance 2003- LC -SOL -G -723, "An Ordinance Amending Title 4
( "Solicitors and Peddlers ") of the Village Code of the Village of Oak
Brook, Illinois by Amending Sections 4 -4A -3 ( "Term; Renewal "), 4-
4A-7 ( "Fees ") of Article A and Section 4 -4B -3 ( "Term; Renewal ") of

Effective January 1, 1982 ILSC 120/2.306 required that all public bodies
shall keep written minutes of all their meetings, whether open or closed.
The public body shall periodically, but no less than semi - annually, meet
to review minutes of all closed sessions that had not been released to the
public.
The Closed Meeting minutes of January through June, 2003 have been
reviewed by Attorney Martens and items still pending and requiring
continued confidentiality have been redacted.
Motion by Trustee Korin, seconded by Trustee Caleel, to approve
Resolution 2003- BD -CL- MIN -EXI -R -853, "A Resolution Approving
the Release of Closed Meeting Minutes — January through June, 2003."
