RECOMMENDED MOTION: I move that the Village Board approve ORDINANCE
G -976 .
Background/History:
Du Page County adopted a new stormwater ordinance on April 24, 2012. The new ordinance
creates a less restrictive environment for commercial re- development. Instead of all commercial
sites needing to build detention, they will not need to do so if they are able to decrease the
impervious area of the lot from the existing conditions.
The new ordinance also improves water quality and quantity. More care is given to wetland and
buffer areas, and best management practices will be implemented on most sites. These help filter
and infiltrate more water which reduces run -off and removes more pollutants.
The development of the new stormwater ordinance was a two year effort with several in- progress
reviews. Every municipal engineer in the County had several opportunities to provide input.
As a full waiver community, the Village of Oak Brook must adopt a stormwater ordinance at
least as strict as the County ordinance. A full waiver community is one which may issue most
stormwater permits without County review. The attached ordinance meets the required criteria
for strictness.
The Village stormwater ordinance is contained in Title 9 of the Village Code. The proposed
ordinance will become the new Title 9 of the Code. The current version of Title 9 contains a
definition and restrictions on the construction of berms. This section is not being included in the

new version. This type of development restriction has no technical stormwater management
basis and is more properly dealt with in the zoning section of the code (Title 13). The berm
restrictions currently in place will not be in effect until/unless the modifications are made to Title
13. The staff recommends that the berm restrictions not be reinstituted at this time.

I recommend approval of the attached ordinance.
