AN ORDINANCE REPEALING ORDINANCE 2004- TC -OUi -G -745 [AN
ORDINANCE AMENDING TITLE 7, CHAPTER 1 (MOTOR VEHICLES
AND TRAFFIC) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK,
ILLINOIS (DUI PROSECUTION)] AND RE- ESTABLISHING THE
PROSECUTION OF DUI VIOLATIONS BY
THE DUPAGE COUNTY S'TATE'S ATTORNEY
WHEREAS, on March 23, 2004, the President and Board of Trustees of
the Village of Oak Brook (the 'Village "), a non home rule municipality, enacted
Ordinance 2004 -TC- DUI -G -745 [entitled, "Ordinance Amending Title 7, Chapter 1
(Motor Vehicles And Traffic) of the Village Cade of the Village of Oak Brook,
Illinois (DPI Prosecution)'], which transferred the responsibility for the
prosecution of Driving Under the Influence (''DUl ") violations from the Office of
the DuPage County State's Attorney to an "assistant prosecutor" who is
appointed by the Village Prosecutor and enacted certain related amendments to
the Oak Brook Village Code; and
WHEREAS, the Illinois statutes allow the County State's Attorney to
prosecute DUI traffic citations written by local law enforcement officers based on
the DUl offenses listed in the Illinois statutes; and
WHEREAS, the President and Board of Trustees of the Village of Oak
Brook deem it advisable and in the best interest and in furtherance of the health,
welfare and safety of the Village residents, property owners, business owners
and the general public that Ordinance 2004 -TC- DUI -G -745 (entitled, 6'Ordinance
Amending Title 7, Chapter 1 (Motor Vehicles And Traffic) of the Village Code of
the Village of Oak Brook, Illinois (DUI Prosecution)'] in its entirety be repealed so
that all DU I offenses be prosecuted by the Offices of the'DuPage County State's
Attorney and the Cook County State's Attorney,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE AND
COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION 1; That each whereas paragraph set forth above is incorporated
by reference into this Section 1.
SECTION 2_ The President and Board of Trustees of the Village of Oak
Brook approve the repeal of Ordinance 2004 -TC -DUI -G -745 [entitled, "Ordinance
Amending Title 7, Chapter 1 (Motor Vehicles And Traffic) of the Village Code of
the Village of Oak Brook, Illinois (DUI Prosecution) "] in its entirety, including the
Code amendments to the Oak Brook Village Code contained in Section 1 of said
Ordinance.

SECTION 3; The President and Board of Trustees of the Village of Oak
Brook direct that all DUI traffic citations written by Oak Brook police of;icers,
based on the DUI offenses listed in the Illinois statutes, be prosecuted by the
Offices of the DuPage County State's Attorney and the Cook County State's
Attorney, as appropriate.
SECTION 4; The President and Board of Trustees of the Village of Oak
Brook direct the Village Clerk to send certified copies of this Ordinance to the
Offices of the DuPage County State's Attorney and the Cook County State's
Attorney by July 30, 2004.
SECTION 5: All ordinances, or parts of ordinances, in conflict with the
provisions of this Ordinance, to the extent of such conflict, are repealed.

SECTION 6: Each section, paragraph, clause and provision of this
Ordinance is separable and if any provision is held unconstitutional or invalid for
any reason, such decision shall not affect the remainder of this Ordinance, nor
any part thereof, other than that part affected by such decision.
SECTION 7: Except as to the repeal of the Code amendments set forth
'above in this Ordinance, all Chapters and Sections of the Oak Brook Village
Code, as amended, shall remain in full force and effect.
SECTION 8: That this Ordinance shall be in full force and effect from and
after its adoption, approval and publication in pamphlet form as provided by law.

The Village Attorney has drafted an ordinance that increases the number of A -1
liquor licenses by one. Provided that all ordinance requirements are met, the
Local Liquor Commissioner Kevin Quinlan would presumably issue a class A -1
liquor license to Jagmohan, LLC d /b /a India House, located at 2809 Butterfield
Road.
Motion by Trustee Korin, seconded by Trustee Yusuf, for passage of Ordinance
2004- LC -AL -6-751, "An Ordinance Amending Title 4, Chapter 1, Section 8A of
the Village Code of the Village of Oak Brook, Illinois Relative to the Number of

President Quinlan remarked that this is an Ordinance that was passed previously as
part of another effort to bring revenue into the Village. Trustee Aktipis stated that
the Village Attorney previously had indicated that this would produce more
revenue for the Village He believes that the revenue is at the expense of the
safety of Village residents Revenue is produced if charges are negotiated down
and fines paid so that those involved in DUI (Driving Under the Influence) may
negotiate with the Village Attorney and obtain a higher fine that the record is not
permanent as a DUI and that person may continue to recycle into the community
without ever being stopped as the record does not reflect repeated DUI's. He
stated he does not believe this is correct and asked that the ordinance be repealed
and have the prosecution with the DuPage County State Attorney's Office.
President Quinlan stated that the Village Attorney does not process the

prosecution. Attorney Kubiesa indicated it is done by the Assistant Prosecutor for
this purpose and the prosecution negotiating any pleas is the same as the State's
Attorney's office. He remarked that Trustee Aktipis' statement that compromising
the safety of the Village is incorrect. Trustee Aktipis noted that the Village
Attorney appoints the prosecutor and he asked that Pat Larson, an Oak Brook
resident and State Director of AAIM (Alliance Against Intoxicated Motorists),
address the Village Board on this issue. It is the oldest anti -drunk driving group in
the State of Illinois. Since AAIM was founded in 1982, DUI crash deaths and
injuries on Illinois roads have greatly decreased. There are over 600 lives lost over
Illinois highways annually and thousands of serious injuries. Many of these are in
DuPage County and AAIM has noticed that in some areas there is a growing
apathy to this vary serious problem. Drunk driving is not treated as the serious
crime that it is as it kills more people annually in America than any other crime
More people lose their lives to this preventable crime than were tragically killed on
September 11, 2001. In fact 17,000 lives are lost because of drinking and driving
in the United States.
Ms. Larson indicated that drunk driving laws are the most complicated set of laws
in the State of Illinois. Drunk drivers have traditionally been prosecuted by the
County State Attorney's office in which these officers of the court have been
trained and are supervised by the local State Attorney. They are accountable to the
elected person. Over the years a disturbing trend has taken place as some
municipalities have hired attorneys to prosecute DUI's. The reason for this is
based solely on revenue as fines come directly to the municipality rather than
being shared by the State of Illinois. Unfortunately, some municipal prosecutors
have been reducing DUI charges to lesser charges at an alarming rate and putting
more dangerous drivers back on the roadways In DuPage County an informal
survey was taken for the first quarter in 2004 comparing 600 random cases, 300
were from municipalities, 300 from the Assistant State Attorney prosecutors. The
study showed that the municipalities reduced five times more cases than the
State's Attorney office Further, the study showed that the summary suspensions
of these persons driving privileges were rescinded in twice as many cases with
municipal prosecutors than in the State's Attorney cases. It is even more serious
with repeat offenders as they have much more to lose and will do whatever it takes
to get their charges reduced. This crime is far too serious and complicated to be in
the hands of Village attorneys as there is too much of a chance for favors to be
doled out on the local level and the perception of corruption might be noted. By
giving these drivers a pass it reinforces the message that it is o.k. to drink and
drive again. Justice cannot be for sale and as an Oak Brook resident she
encouraged the Board of Trustees to treat drunk driving as a serious crime. She
requested that Oak Brook DUI offenders be prosecuted by the DuPage County
State Attorney's

Trustee Yusuf asked that a review be done of the Village cases since the Village
ordinance has been enacted to determine the results and compare them with the
State's Attorney office to determine if there is a disparity
Trustee Caleel asked for a report of DUI's between the time the ordinance was
implemented to the present time and the outcomes of those cases and were the
cases reported to the State Police. Trustee Zannis stated she asked for that report
but the statistics are limited as the Village just began in April prosecuting. A
report on the disposition of the case until it is finalized would takes months and
there are privacy issues also

C. AWARD OF CONTRACTS
1) AN ENGAGEMENT LETTER DATED JULY 22, 2004, RELATIVE TO
KLEIN, THORPE AND JENKINS, LTD
President Quinlan announced that this was stricken according to Judge Wheaton's
ruling in DuPage County Circuit Court and will not be addressed by the Board of
Trustees.
2) SELF - CONTAINED BREATHING APPARATUS UNITS
It would be appropriate for the Oak Brook Fire Department to replace 100% of
their SCBA inventory by taking advantage of a limited -time volume discount
through MSA. The Fire Department would trade in their current equipment for
complete fleet -wide replacement with new equipment. This would reduce
maintenance costs by making the Fire Department eligible for limited lifetime
warranty coverage (currently applicable only to roughly 1/3 of the Fire Department
units). This would also bring the Fire Department in compliance with NFPA 1981
(2002) standard for SCBA. The special purchase would make use of the current air
cylinders in lieu of the cylinders that would normally be provided with a new
SCBA. This feature of the program is an attractive incentive that would preclude
the Fire Department from entertaining bids from other SCBA suppliers. The MSA

of Oak Brook find it as no longer necessary to keep them confidential to protect the public
interest or to protect the privacy of any individual. As to any minutes or recordings or
portions thereof not released the corporate authorities of the Village of Oak Brook shall
find that the need for confidentiality still exists as to those meetings or recordings or
portions thereof. The corporate authorities may require the Village Attorney's opinion
regarding the release or non - release of the respected recordings and minutes.
Clerk Gonnella indicated that there is one set of minutes that need to be reviewed by the
Board in order to be released to the public that is required by the Village Code and the
Open Meetings Act. She stated that if the one set of minutes are to be released in open
session that they would be released as printed and not as redacted as there are confidential
matters that should not be released to the public.
Trustee Aktipis stated that those minutes have been fully abridged and he believes that the
other Board members have also reviewed them and he has no difficulty releasing those
minutes in open session.
Motion by Trustee Aktipis, seconded by Trustee Korin, to release the set of closed
meeting minutes of June 30, 2004 as redacted. VOICE VOTE: Motion carried.
Trustee Aktipis asked that Agenda Item 12, Adjourn to a Closed Meeting also be removed
from the Agenda. Trustee Korin explained that she had asked for the closed meeting to
discuss litigation regarding IRMA representatives, as they were not in attendance of the
meeting. It was a consensus of the Village Board that Agenda Item 12 be removed from
the agenda.
President Quinlan also announced that Agenda Item 9. B. 2), An Ordinance Amending
Title 1 ( "Administration "), Chapter 5 ( "Appointed Village Officials ") of the Village Code
of the Village of Oak Brook to Provide for Limits to Temporary Appointments of Village
Officials has been removed from the Agenda by consensus of the Village Board.
4. RESIDENTNISITOR COMMENT:
President Quinlan announced that the Villa Board of Trustees at their last regular
meeting changed the method of prosecuting UI's in the Village. He has reviewed this
process as several residents asked if he would veto the DUI (Driving Under the Influence)
ordinance. He stated that he would not take such action. He voiced his concern of
repealing that ordinance as he indicated it was adopted for the right reasons. The
ordinance was designed to improve police officer and attorney relationships and the
Village's police officers would have a better working relationship with the prosecutor. It
would allow the Village to control the qualifications of whoever was prosecuting the DUI
cases. It also would create a revenue stream for the Village in creating funds to

4. strengthen the Police Department for better enforcement. He indicated that he did not
believe those three things would happen with the repealing of the ordinance. He did agree
that some cases would be negotiated to a lower penalty. The intent was not to subvert the
prosecution process but to allow the Village to negotiate where a not guilty was found and
find some benefit to the Village.
He also addressed a rumor and innuendo that some misuse of power surrounding DUI
prosecutions has taken place. He has researched this and the Village Attorney has found
no evidence of that type of behavior from any member of the Board of Trustees or the
Village's Police Department. He indicated that he met with the Homeowner Association
Presidents that represent a fair number of the Village's homeowner associations on July
275 2004. He stated that they sent a letter to him when he had surgery and he explained
that he will respond to them in writing within the next couple of days.
He stated that he is in receipt of a letter from the Illinois Department of Labor. He had
requested on behalf of the Village of Oak Brook to address the prevailing wage rate as the
Village must contract at a higher rate for landscape contracts involving the Oak Brook
Public Library. A hearing has been set for Friday, August 201h in which the Village will
address their case on this issue.
Trustee Zannis requested an opening comment in which she stated that two Village Board
meetings prior she indicated she was upset because of an incident at her home that she
found very distressing. Yesterday a similar incident occurred at her home and she filed a
police report and she wanted to share it with the Village residents. A police officer
arrived within five minutes and was attentive to detail and accommodating. They both
agreed that what is happening in Oak Brook is not beneficial to the Village or staff and
she empathized with' him. She stated that used tampons were found at her front and rear
doors as this incident also had occurred two weeks prior. Previous to that incident another
item was left at her front door that was intimidating and alarming to her. She believes that
the discord that is happening in Oak Brook today was not happening at the beginning of
June. She has never had an incident at her home let alone repeated and of such an
offensive nature. She stated she has had many disagreements in the Village Board Room.
In the beginning of June the Village Board was working well together and she does not
understand what went wrong and would like it to end. She offered that neighbors are
arguing over this issue and hoped it would end. She stated it is the most paramount issue
that the Village Board must face and stated that President Quinlan has the ability to end
this. She requested as a teammate, a neighbor and someone who loves Oak Brook that
President Quinlan address the situation.
President Quinlan stated he regrets any losses that Trustee Zannis is suffering at her home
and glad that she filed a police report. He hopes that the perpetrator is captured and
punished to the full extent of the law but that the Board must move forward with the
business of the Village.
