Let me note a number of matters: (1) As I understand it, the roughly six special events held at Graue Mill all end on or before 5:00 p.m. (2 ) The special events referred to in Section 3 pertain only to the Graue House. Rather than a tt m pt to estimate the number of special events at the house, we have attempted to allay any concerns about unmanageable events by restricting the number of attendees to the maximum occupancy permitted on the first floor of the Graue House, as determined by the applicable building and fire codes. (3) As I understand it, the District has no need to keep the house open past 11:00 p.m. The original recommendation provided that on weekends the house could be kept open until midnight. (4) We have attempted to respond to the "nuisance" concerns raised by Trustee Savino andl others by including subparagraph D in Section 3 which addresses noise concerns. Marten, Village Attorney RAM:sps 2) RDINANCE #2000 -ZO -SU -970 AN ORDINANCE RANTING A SPECIAL USE PERMIT TO ALLOW USE OF THE GRAUE HOUSE AS A HISTORIC FACILITY OFFERING CULTURAL AND EDUCATIONAL OPPORTUNITIES TO VISITORS (GRAUE HOUSE, 3800 YORK ROAD, OAK BROOK, IL): Trustee Kenny arrived at 7:37 p.m. The Village Attorney drafted an ordinance, which grants a special use permit allowing the use of the Graue House as a historic facility offering cultural and educational opportunities to visitors. This special use permit is subject to the conditions set forth in Section 3 of the ordinance. In consultation with Robert Mork, Attorney for the Forest Preserve District of DuPage County, the Village has revised the conditions set forth in Section 3 of the ordinance. Motion by Trustee Savino, seconded by Trustee Caleel, to approve Ordinance #2000 -ZO -SU -970, "An Ordinance Granting a Special Use Permit to Allow use of the Graue House as a Historic Facility Offering Cultural and Educational Opportunities to Visitors ( Graue House, 3800 York Road, Oak Brook, IL)," as presented and waive the full reading thereof. AWARD OF CONTRACTS: 1) 2001 PAVING AND DRAINAGE PROJECT - DESIGN AND CONSTRUCTION SERVICES: Following Village Board discussion of this subject at its June, 2000 Committee -of -the Whole meeting, staff has negotiated a professional services contract with James J. Benes & Associates, Inc., to provide final design and construction services for the 2001 paving project. The 2001 -2005 Roadway Maintenance Plan (nearing completion) assumes 14% for design and construction services. Based on the Village's estimated construction cost of $1,991,794 staff would expect the engineering services for the 2001 project to cost approximately $278,000. The proposed total fees ($291,363) are slightly higher and staff feels it is justified due to new more complicated and costly IDOT material testing procedures. Village of Oak Brook 1200 Oak Brook Road ORDINANCE 2000- ZO -SU -S- 970 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW USE OF THE GRAUE HOUSE AS A HISTORIC FACILITY OFFERING CULTURAL AND EDUCATIONAL OPPORTUNITIES TO VISITORS ( Graue House, 3800 York Road, Oak Brook, IL) WHEREAS, the Forest Preserve District of DuPage County has applied to the Village of Oak Brook for a special use which would permit the use of the Graue House at 3800 York Road to be used as a historic facility available to the public for educational, cultural and /or historic activities; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject 9 P f J application to the Zoning Board of Appeals and the President and Board of Trustees and recommended approval of the Special Use for a historic facility open to the public, subject to certain conditions and restrictions; and ' WHEREAS, a public hearing on the application has been conducted on July 6, 2000 by the Zoning Board of Appeals of the Village of Oak Brook pursuant to due and appropriate legal notice; and I - WHEREAS, a recommendation was made by the said Zoning Board of Appeals that the Special Use requested be granted subject to certain conditions; and WHEREAS, the President and Board of Trustees have reviewed these recommendations an, d concur with the recommendation of the Zoning Board of Appeals and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as `though fully set forth herein. The normal hours of operation of the Graue House shall be 8 00 a.m. to 5.00 p m. days a week (to coincide with the regular hours of operation of the Graue Mill). C. Closing hours for special events at the Graue House and for meetings of the Graue (Mill Corporation shall be extended to 11:00 p.m , provided that the total number of attendees at Ordinance 2000-ZO-SU-S-9 7 0 Special Use Permit Graue House, Page 2 these special events and meetings shall not exceed the maximum occupancy of the first floor of the Graue House as determined pursuant to applicable codes. D. Noise coming from the special use property shall be subject to the performance standards set forth below: At no point on or beyond the westerly boundary line of the special use property shall the sound pressure level of any activity taking place on the special use property (other than background noises produced by sources not under control of the Forest Preserve District, such as operation of motor vehicles or other transportation facilities) exceed the decibel limits as set forth in the table below: OCTAVE BAND FREQUENCY IN CYCLES PER SECOND MAXIMUM PERMITTED SOUND LEVEL IN DECIBELS 20 to 75 72 75 to 150 76 150 to 300 59 300 to 600 52 600 to 1,200 46 j 1,200 to 2,400 40 2,400 to 4,800 34 Above 4,800 32 Sound levels shall be measured with a sound level meter and associated octave band filter manufactured according to standards prescribed by the American Standards Association. Measurements shall be made using the flat network of the sound level meter. Impulsive type noises shall be subject to the limitations set forth below, provided that such noises shall be capable of being accurately measured and for the purpose of this special use permit, shall be those noises which cause rapid fluctuations of the needle of the sound level meter with a variation of no more than plus or minus two decibels. Noises incapable of being so measured, such as those of an irregular and intermittent nature, shall be controlled so as not to become a nuisance to adjacent uses. If the applicant or its agents fail to meet any of the conditions of this section within ten (10) days notification, the Village Manager or his /her designee may bring enforcement action. Section 4: This Ordinance is limited and restricted to the property located at 3800 York Road, Oak Brook, Illinois, as legally described as follows Lot 1 in Graue's Assessment Plat No. 2, a Subdivision in part of the West half of the Southeast Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded March 19, 1947 as Document 517568, in DuPage County, Illinois.
