SUBJECT: Sale of Surplus Vehicles via DuPage Mayors & Managers Conference

RECOMMENDED MOTION: I move that the Village Board pass the attached ordinance
declaring one vehicle as surplus and authorizing its sale through the DuPage Mayors and
Managers Conference public auction.
Background /History:
The attached ordinance declares one vehicle as surplus and authorizes its sale at the DuPage
Mayors and Managers Conference surplus vehicle and equipment auction. The vehicle declared
surplus is Police Unit # 307. The attached ordinance contains the age and the approximate
current mileage for this vehicle. The Conference charges a 15% administrative fee, which will
be subtracted from the gross receipts. Also, a $50 charge is imposed on any vehicle or piece of
equipment that is brought to the auction and does not sell.
The auction is scheduled for Saturday, September 11, 2004 at the College of DuPage, with
bidding beginning at 10:00 am. As in past years, the Village is required to supply one staff
person (usually a Police Officer) to assist the Conference with the auction. Village officers,
employees and their families are not allowed to bid on Oak Brook surplus vehicles and
equipment, but are allowed to bid on items from other organizations.

come up in the fall and spring which require quick action so they are not lost to
other employers. He indicated that a telephone poll could be done of the Board
members with ratification at a subsequent meeting if that is allowed
Trustee Korin asked to consider exempting seasonal employees to this. Trustee
Zannis concurred with this at it is not a permanent situation
Motion by Trustee Aktipis, seconded by Trustee Zannis, to amend the original
motion for passage of Ordinance 2004 -PL -G -754 "An Ordinance Amending Title
1 ( "Administration ") of the Village Code of the Village of Oak Brook with
Respect to the Responsibilities, Duties and Authority of the Village Manager
(Chapter 5, Article A) with the exemption of seasonal employees " ROLL CALL
VOTE:
Ayes: 4 - Trustees Aktipis, Craig, Korin and Zarinis.
Nays: 1 - Trustee Yusuf
Absent: 1 - Trustee Caleel. Motion carried

5. APPROVAL OF MINUTES:
REGULAR BOARD OF TRUSTEES MEETIING OF JULY 27, 2004
Motion by Trustee Aktipis, seconded by Trustee Korin, to approve the Minutes of the
Regular Board of Trustees Meeting of July 27, 2004 for the purpose of discussion.
Trustee Aktipis stated there are many areas of the minutes that do not accurately reflect
what was discussed as they are extensive. He asked to consult with the Village Clerk for
further discussion. It was a consensus of the Board to remove the first motion of approval
of the minutes.
Motion by Trustee Aktipis, seconded by Trustee Korin, to postpone the approval of the
Minutes of the July 27, 2004 Regular Board of Trustees meeting until the minutes are
revised. VOICE VOTE. Motion carried.

Trustee Aktipis asked that Agenda Item 6., C. Community Development Referrals, 2) 970

Regulations be removed from the Consent Agenda for further discussion
Motion by Trustee Korin, seconded by Trustee Yusuf, to approve the Consent Agenda

ORDINANCE 2004 -PP -S -1079
AN ORDINANCE AUTHORIZING THE SALE
BY PUBLIC AUCTION OF PERSONAL PROPERTY
OWNED BY THE VILLAGE OF OAK BROOK
WHEREAS, in the opinion of at least a simple majority of the corporate authorities of the
Village of Oak Brook, it is no longer necessary or useful to or for the best interests of the Village
of Oak Brook to retain ownership of the personal property hereinafter described, and
a
WHEREAS, it has been determined by the President and Board of Trustees of the
Village of Oak Brook to sell said personal property at the DuPage Mayors and Managers
Conference public auction to be held on Saturday, September 11, 2004
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES,
ILLINOIS as follows
Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted
as though fully set forth herein.
Section 2: That pursuant to 65 ILCS 5/11 -76 -4, the President and Board of Trustees of
the Village of Oak Brook find that the personal property, described below, now owned by the
Village of Oak Brook, is no longer necessary or useful to the Village of Oak Brook and the best
interests of the Village of Oak Brook will be served by its sale

Section 3- Pursuant to said 65 ILCS 5/11 -76 -4, the Village Manager is hereby
authorized and directed to sell the aforementioned personal property now owned by the Village
of Oak Brook at the DuPage Mayors and Managers Conference public auction, on Saturday,
September 11, 2004 at the College of DuPage, Glen Ellyn, Illinois, to the highest bidder on said
property
Section 4: The Village Manager is hereby authorized and may direct the DuPage
Mayors and Managers Conference to advertise the sale of the aforementioned personal
property in a newspaper published within the county before the date of said public auction
Section 5: The Village Manager is hereby authorized and may direct the DuPage
Mayors and Managers Conference to enter into an agreement for\the sale of said personal
property The Conference will charge an administrative fee that will come out of the proceeds
from the sale of surplus vehicles and equipment above - described
Section 6 Upon payment of the full auction price, the Village Manager is hereby
authorized and directed to convey and transfer title to the aforesaid personal property to the
successful bidder
Section 7 This ordinance shall be in full force and effect from and after passage, by a
simple majority vote of the corporate authorities, and approval pursuant to law
