The ordinance grants a special use pursuant to the Hawks Soccer Club's
request for soccer fields at Kensington Road and Jorie Boulevard.
This agenda item was approved under Agenda Item 7.A.
C. AWARD OF CONTRACTS:
1) 2004 PAVING PROJECT — ENGINEERING SERVICES
At the Village Board meeting of June 24, 2003, the Board authorized
staff to negotiate a contract with James J. Benes & Associates, Inc. for
Professional Engineering Services for the 2004 Paving Project. Staff
has been working with the consultant and the contract is a culmination
of those efforts. This agreement has been reviewed by Village Attorney
Martens and Purchasing Director Kapff and found to be acceptable as to
form.
Motion by Trustee Miologos, seconded by Trustee Korin, that the
Village Board approve an agreement with James J. Benes & Associates,
Inc. for Professional Engineering Services regarding this project in the
not -to- exceed amount of $125,155.00. ROLL CALL VOTE:
Ayes: 6 - Trustees Aktipis, Caleel, Craig, Korin, Miologos and Yusuf.
Nays: 0 - None.
Absent: 0 - None. Motion carried.

ORDINANCE 2003- ZO- SU -EX1 -S -1050
AN ORDINANCE GRANTING A SPECIAL USE
RELATIVE TO HAWKS SOCCER CLUB
(1315 -1425 Kensington Road/ P I N 06 -26- 102 -008, 06 -26- 102 -009)
WHEREAS, the Hawks Soccer Club has filed an application requesting a special use to allow the
property owned by McDonald's Corporation and located at 1315 -1425 Kensington Road at the southwest
corner of Kensington Road and Jorie Boulevard (hereinafter sometimes referred to as the "Subject
Property ") to be used for soccer fields; and
WHEREAS, at its meeting of July 21, 2003, the Plan Commission unanimously recommended to
the Village Board that the requested special use be granted, and
WHEREAS, upon due and appropriate legal notice, the Zoning Board of Appeals of the Village of
Oak Brook at its meeting on August 5, 2003, made specific findings of fact demonstrating that the
standards for the proposed special use have been satisfied and unanimously recommended that the
requested special use be granted, and
WHEREAS, the Village Board concurs with the recommendation of the Plan Commission and the
Zoning Board of Appeals and adopts the findings of fact made by the Zoning Board of Appeals.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS
Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein
Section 2 That a special use is hereby granted to use the Subject Property, which is legally
described in Section 3, for soccer fields, subject to the following conditions and restrictions
a That the Subject Property be improved in conformity with the attached
site plan, consisting of two sheets,
b That the Hawks Soccer Club furnish the Village with written
authorizations from area property owners for permission to use at least
two hundred (200) overflow parking spaces on game days,
c That the Subject Property not be used by the Hawks Soccer Club before
10 00 a m on any day or after 8.00 p m on any day, and
d That no field lights or sound amplification equipment are allowed at the
Subject Property at any time
Section 3. That this ordinance is limited to property located at 1315 -1425 Kensington Road,
Oak Brook, Illinois, which property is legally described below

SPECIAL USE
13-14-9: SPECIAL USES:
A. Purpose: The development and execution of this Title is based upon the division of the
Village into districts,within any one of which the use of land and buildings and the bulk and
location of buildings or structures, as related to the land, are essentially uniform. It is
recognized, however, that there are special uses which, because of their unique character,
cannot be properly permitted in particular districts without consideration, in each case, of the
impact of those uses upon neighboring lands and upon public need for the particular use or
the particular location. Such special uses fall into two (2) categories:
1. Uses operated by public agency or publicly-regulated utilities, or uses traditionally
affected with a public interest.
2. Uses entirely private in character, but of such a nature that the operation may give rise to
unique problems with respect to their impact upon neighboring property or public facilities
such as,but not limited to, single-family attached and semi-detached dwellings,horizontal
condominiums and other residential developments.
B. Authority: Special uses shall be authorized or denied by the Village Board in accordance
with the statutes of the State applicable to amendments of this Title, and the regulations and
conditions set forth in this Title for special uses.
No application for a special use shall be acted upon by the Village Board until after:
1. A written report is prepared and forwarded to the Board of Appeals and the Village Board
by the Plan Commission in a manner prescribed herein for amendments to this Title; and
2. A public hearing has been held by the Zoning Board of Appeals, after due notice by
publication as provided by the applicable statutes of the State for amendments and upon a
report of the Plan Commission to the Board of Trustees, if such a report is made.
C. Initiation: An application for a special use may be made by any person, firm or corporation
or by any office, department, board, bureau or cominission requesting or intending to request
a zoning certificate.
D. Processing: An application for a special use, in such form and accompanied by such
information as shall be established from time to time by the Plan Commission, shall be filed
with the Village Clerk and thereafter processed in the manner prescribed theretofore for
applications and amendments. Special use applications may be processed simultaneously
with requests for amendment of this Title.
E. Decisions: The Village Board, upon report of the Zoning Board of Appeals and the Plan
Commission, and without further hearing, may authorize or deny an application for a special
use in accordance with the statutes of the State applicable to amendments, or may refer it
i back to the Board of Appeals and the Plan Commission for further consideration.
No special use shall be authorized by the Village Board unless the special use:
1. Is of the type described in subsection Al of this Section, is deemed necessary for the
public convenience at that location;
2. Is so designed, located and proposed to be operated that the public health, safety and
welfare will be protected; and
3. Would not cause substantial injury to the value of other property in the neighborhood in
which it is located.
F. Conditions: The Plan Commission and Zoning Board of Appeals may recommend, and the
Village Board may provide, such conditions and restrictions upon the construction, location
and operation of a special use, including,but not limited to, provisions for off-street parking
and loading as maybe deemed necessary to promote the general objectives of this Title and
to minimize the injury to the value of the property in the neighborhood. (Ord. G-60,

13-12-3: OFF STREET PARKING REGULATIONS:
A. Existing Parking Facilities: Accessory off street parking facilities in existence on the
effective date hereof and located on the same lot as the structure or use served shall not
hereafter be reduced below the requirements for a similar new structure or use under the
provisions of this chapter.
B. Location: After the effective date hereof, all off street parking spaces shall be located on the
same lot as the building, structure or use of land served; however, off street parking spaces
may also be located on a lot other than the lot on which the building, structure or use of land
served is located,provided that said spaces are also within three hundred feet(300')walking
distance of such building, structure, or use of land. All off street parking spaces required for
single-family residences shall be located on the same lot as the residence,provided that no
required spaces may be located in any front or side yard.
C. Size And Aisles: Each required off-street parking space shall have a width and length,
exclusive of access drives or aisles, ramps, columns, or office and work areas in accordance
with standards set forth below. Enclosed parking spaces shall have a vertical clearance of at
least seven feet(7'). Each required off street parking space shall open directly upon an aisle
or driveway of a width and design in accordance with standards set forth below:

13-12-4: DESIGN AND MAINTENANCE:
A. Surfacing: Except in the R1 and R2 single-family residential zoning districts where off-street
parking areas can be either stone or hard surfaced, all off-street parking areas shall be
improved with an all-weather hard surface pavement installed in accordance with the village

of Oak Brook public works construction standards.
B. Screening And Landscaping: The following landscaped and planted areas shall be provided
and maintained for all parking areas:
1. Front Yards: Permanent screening at least four feet(4') high shall be installed in front yard
areas adjacent to parking areas. This screening may consist of a planted earth berm, densely
planted shrubs or trees, or a combination of both.
2. Side And Rear Yards: Permanent peripheral screening at least five feet(5') high shall be
installed in side and rear yards adjacent to parking areas. This screening may consist of a
planted earth berm, densely planted shrubs or trees, or a combination of both. In side and
rear yards,the screening shall be so located and constructed as not to interfere or conflict
with the use of any utility easements or utility installations existing or planned to be installed
in these easement areas.
C. Interior Parking Lot Landscaping: Landscaped areas shall occupy not less than ten percent
(10%) of the total lot area excluding:
1. The building footprint or footprint of other structures,
2. All required front yard or street setback areas, and
3. Any required landscape areas along rear lot lines.
In parking areas which are wider than one bay of double parking, interior shade trees shall be
planted with a maximum spacing of forty feet(40'),provided that at least one tree is located
in the area occupied by every fifteen(15) interior parking spaces. Landscaped dividers with a
minimum width of six feet (6) shall be provided between every three (3)parking bays.
Individual permanent planter areas (minimum size of S feet 6 inches by 17 feet) are required
for interior trees with a minimum caliper of three inches (3"),which shall be of a variety
which do not drop a messy fruit(see village of Oak Brook public works construction
standards for list of appropriate trees).
D. Landscape Plans: Complete detailed landscaping plans shall be submitted for approval
showing type, Latin and common names, size and location of planting material.
E. Lighting: Illumination of an off-street parking area shall be arranged so as not to project
direct rays of light or glare into any roadway or adjacent property. Intensity of illumination
of parking areas shall be in accordance with the village of Oak Brook public works
construction standards. All lighting for business and office uses adjacent to residential
districts shall be extinguished or reduced in intensity, not later than thirty(30)minutes after
the close of business of the use being served.
F. Disposal Of Storm Water: Adequate provision shall be made for the management of storm
water in accordance with village standards so that such water shall not flow into adjacent
property or onto or across sidewalks in a quantity or manner that would be detrimental
thereto or inconvenient to persons using the sidewalks.
G. Permanent Curbing: Continuous permanent concrete curbing conforming to the village of
Oak Brook public works construction standards shall be provided adjacent to all driveway,
loading and parking pavement associated with nonresidential uses.
H. Striping And Traffic Circulation: Parking spaces shall be delineated by a single white or
yellow line. For one-way movements along aisles and driveways, direction of movement
shall be indicated by pavement markings or directional signs or both as determined by the
village.

the McDonald's Corporation. As part of the application the Hawks submitted a check for
$750.00. The Hawks Soccer Club, Inc. "Hawks" is an Illinois not-for-profit corporation
created for the purpose of encouraging and supporting the expansion of competitive
soccer opportunities for children in the Hinsdale, Clarendon Hills,Oak Brook and
surrounding communities. Hawks Soccer is also a 501(c) 3 charitable organization as
defined by the Internal Revenue Service guidelines for educational purposes. Given the

In the past, the Village has received and approved requests for waiver of-fees from other governmental
and non-profit entities.
Section 1-14-2 of the Village Code permits waiver of such fees for other governmental entities.

Any governmental unit or any charitable organization as defined in the act to regulate
solicitation and collection of funds for charitable purposes may request waiver of any fees
established to this chapter. Upon such request the Village President and Board of Trustees
may, in its discretion, waive any such fees imposed pursuant to the terms of this chapter.

SUBJECT: Hawks Soccer Club—McDonald's Autumn Oaks Subdivision

This afternoon I met with Michael Ruszkowski, President of the Board of Directors of the Hawks Soccer
Club, and reviewed the items I have identified to date concerning the above stated subject:
1. To my question of whether any dirt would be moved regarding the proposed soccer fields and
their layouts, Mike responded that no dirt would be moved and the ground elevations would
remain as they are. An exception could be the large international field on the westerly side.
2. We discussed that flood plain exists on this site and that any filling in the flood plain would
require compensatory storage at 1.5 times. We looked at the proposed DuPage County Flood
Map which depicted a revised flood plain of 664.1 for the lower pond and 665.4 for the upper
pond. The proposed flood map depicted a smaller flood plain than the existing flood map. I also
gave Mike the DuPage County website where he and his professional consultants could review
the proposed map (http:\\ec.dupageco.org\dec\floodmaps.html). After Mike left, I pulled out the
existing flood map and noted that the lower lake is elevation 664 and the upper lake is elevation
666.
Mike and I did discuss that staying out of the flood plain would be the best alternative.
3. Mike stated that they would be utilizing boths Lots 1 and 2 and would apply for the largest and
maximum usage now and then perhaps not use all of it in the future.
4. Regarding Item 2 in the Factors document, the barriers that are listed in the second sentence refer
to soccer back stops.
5. I stated that I needed a full-size, to-scale site plan rather than the reduced copy on the 8-1/2 x 11
sheet.
6. We reviewed some items of Title 9 which stated that a permit would be required for the
construction of the parking lot which would have to be prepared, signed and sealed by a

registered professional engineer. Additionally, a parking area over 25,000 square feet would
require detention. I did mention that the Village is looking to revise its Code to permit a waiver
of detention in certain limited development circumstances as approved by DuPage County.
Professional engineering documentation would have to be generated and submitted to the Village
before such a waiver could take place. I suggested that when Mike contacts his landscape
architect, he find out what professional engineer the landscape architect might recommend and
see if he has the technical qualifications for this type of work and knowledge of the DuPage
County Stormwater Ordinance and our Title 9.
7. 1 stated that 9 foot wide gravel non-striped parking stalls probably would not work and suggested
they plan for 10 foot side stalls. This would make the stalls 10' x 18'.
8. We then reviewed several items within my commercial building permit checklist concerning
driveway and aisle widths, surfacing, screening and landscaping, permanent concrete curbing,
pavement markings, minimum number of parking spaces required, handicap space requirement,
and other miscellaneous stormwater items.
9. Mike discussed the option of reducing the size of the parking area to be within the 25,000 square
foot threshold in order to not have a detention requirement. This would include the driveway and
parking space area. I stated that any type of earth movement or gravel placement would require a
permit for surface disturbance exceeding 2,500 square feet which requires a stormwater
management permit prepared, signed and sealed by a professional engineer.
10. We briefly discussed the procedure of receiving variations to the Stormwater Ordinance. I sent a
notice to DuPage County and all of the communities within the Watershed for their review and
comment. Any stormwater variations would take a certain amount of time and could not be
rushed.
11. The width of the parking area should be increased from 120 feet on the drawing to 126 feet to
match the Zoning Ordinance requirements.
12. 1 concluded the meeting by saying that a temporary gravel drive and parking lot should be
doable,but that there are several requirements that must be met before a permit could be issued.
I recommend that the Hawks Organization work with a professional engineer conversant with the DuPage
County Stormwater Ordinance and our Title 9 in order to save time and cover all the required bases.

I have reviewed the additional information received on July 14, 2003 and offer the following comments:
1. As mentioned in Michael Ruszkowski's recent letter, the following zoning requirements need to
be dealt with:
A. Section 13-12-3.0 — states that non-office parking spaces shall be 9 feet by 18 feet. As
previously mentioned, I believe that 9 foot wide gravel non-striped parking stalls probably
would not work and suggested they plan for 10 foot wide stalls. This would make the stalls
10 feet by 18 feet.
The aisle width for non-office use is 27 feet. The current plan depicts a 24 foot wide aisle.
B. Section 13-12-4.A — requires an all weather hard surface pavement in accordance with the
Village of Oak Brook Public Works Construction Standards.
C. Section 13-12-4.B — requires screening and landscaping in front yard, side yard, and rear
yard areas adjacent to parking areas.
D. Section 13-12-4.0 — requires interior parking lot landscaping in parking areas which are
wider than one bay of double parking.
E. Section 13-12-4.1)—requires a complete detailed landscaping plan.
F. Section 13-12-4.G — requires continuous permanent concrete curbing adjacent to all
driveway, loading and parking pavements associated with non-residential uses.
G. Section 13-124H — requires that parking spaces be delineated by a single white or yellow
line.

2. I understand that you are determining the minimum required number of spaces and handicap
spaces.
3. The site plan needs to be revised to show who prepared it, the date it was prepared, and
dimension the access driveway as being 24 feet wide. The 234 foot dimension needs to be
revised to 162 feet to match the revision (the 234 foot dimension is a carry-over from the
previous plan.
4. The access driveway and the revised parking lot layout totals 22,812 square feet; therefore,
detention is not required.
5. A Stormwater Management Permit will be required since the development involves filling with
stone of more than 16 cubic yards and the development disturbs more than 2,500 square feet of
ground cover. It is my opinion that the permit submittal is not required to be prepared, signed,
and sealed by a professional engineer for the following reasons:
A. There is no design of stormwater facilities, calculations for the determination of the
regulatory floodplain,or calculations of the impacts of development.
B. The existing,relatively flat grass area between Ginger Creek and the proposed gravel parking
area is greater than 400 feet which allows for infiltration and riparian benefits.
C. The proposed gravel parking lot will be placed on top of the existing grass and top soil which
will allow a certain degree of perviousness.
D. The development meets the requirements of Section 9-5-2.A.
E. Utilizing the existing relatively flat grass area between Ginger Creek and the proposed gravel
parking lot incorporates a Best Management Practice.
F. The proposed design will result in no sediment and erosion.
G. The development is of a temporary nature.
6. It is my understanding that no dirt would be moved and the ground elevations would remain as
they are regarding the proposed soccer fields and their layout. A possible exception could be the
large international field on the westerly side. If that is the case, flood plain considerations, such
as compensatory storage, would come into play since the plan has a portion of that field within
the floodplain. In that case, detailed topography and flood plain calculations, in addition to any
other flood plain requirements,would come be needed.

DISCUSSION: The Hawks Soccer Club, through a license agreement (see pages H_

Autumn Oaks property), have submitted a petition requesting
approval of a special use to permit the use and development of the
property for youth soccer fields.
As part of this special use request, the petitioner is seeking a number
of allowances to the Zoning Ordinance regarding off-street parking
requirements. The requested allowances are as follows:

Key elements of this request for the property include: the construction
of: seven (7) soccer fields, removable barriers to minimize potential
conflicts between soccer balls and vehicles, a crushed limestone
parking for 57 cars, and a small storage shed at the southend of the
property. Additional aspects include: provisions for trash and
sanitation services, player benches, fan bleachers, and provisions to
accommodate over-flow parking on adjacent properties.

information is a list of conditions that would be applicable to the to
the requested activities.
Village Engineer Durfey's comments on the proposed special use and
proposed site improvements in his memorandums dated July 11 and

Staff Comments
Reviewing the proposed special use, I have identified a number of
issues that you may want to discuss as part of your deliberations:
1. The provision to use off-site parking lots for overflow parking
needs the approval of the owner of the off-site parking lot.
2. Any future signage for the site must meet the provisions of
Chapter 11 —Sign Regulations in the Zoning Ordinance.
3. The proposed use and planned activities on the property should
be in accordance to the hours of operation identified by the
applicant.

Director of Community Development Kallien said the Hawks Soccer Club is a not-for-profit group
petitioning for a special use at the Autumn Oaks property to utilize it for soccer facilities. The
current owner of the property is McDonald's Corporation, and they have a license agreement that is
contained in the case file, which details all of the particulars between the two parties.
Mike Ruszkowski, President of the Hawks Soccer Club, provided the background of the
organization. He said that their club is about six years old. They started with one team and have
grown to almost 19 teams, primarily for girls, but they do have 3 boys teams. They have over 330
children from various communities, including Oak Brook that play in the club. They have been
sharing Park District space with a variety of other clubs in Hinsdale, Clarendon Hills, Burr Ridge
and Oak Brook. One of the most important things is that the fields are becoming so overused that
they are almost to the point of being dangerous in some conditions. It was announced in the spring
of last year, that the Village of Hinsdale would be closing down 4-5 more fields, which would
probably mean that things would be even tighter and the field use would be greater than it currently
is. They were fortunate to speak with Joe Endress from McDonald's Corporation and over a period
of time have reached an agreement for the Hawks to develop 7 soccer fields on the Autumn Oaks
property located on the southwest corner of Jorie Boulevard and Kensington Road,just across from
the Oak Brook Park District.
They are hoping to build four large fields and three small fields. The large fields are approximately
60x110 yards and the smaller youth fields would be approximately 50x60 to 70 yards. The
distances can vary a little. It is hoped that in the spring they will be able to afford to build an
international size field, which would be approximately 70 wide x 120 yards long. There are some
flood plain considerations so they are going to hold off to see how the flood plain map may change
with DuPage County, which would also give them some time to raise money to do a nice job.
One of the key elements of the plan is that along Kensington Road each of the fields (that back up
to that road) will have a series of backstops. The backstops are designed to keep the ball from
going onto the street and to keep the children from running out into the street after a ball. The
backstops are anticipated to be 20 feet high and 65 feet wide. The manufacturer recommends that
this is an adequate backstop system for what they are seeking.
They are seeking an allowance to develop a soft parking lot. The whole thrust behind their
relationship with McDonald's is that this is a temporary/nonpermanent situation, but they still have
to solve the parking needs. They had hoped to construct a limestone parking lot. The dimensions
have changed since a meeting with the Village Engineer and they have modified the size slightly
(page 15 of the case file). The dimensions are approximately 126 feet wide by 170 feet long. The

size of the parking spaces been changed from 9 feet to 10 And increased the aisle width
from 26 to 27 feet wide. The parking lot has been made smaller to avoid drainage issues. If the lot
falls under 25,000 square feet, then there is less work required and still accomplish what they need.
They are also seeking allowances from curbing, landscaping, screening, and striping requirements.
These allowances are requested because they are trying to keep the cost down and maintain the
temporary nature as required by McDonald's. It is McDonald's intention, at some point, to return
the property for commercial development.
Hawks Soccer Club has reached an agreement with Ace Corporation to allow parking in the Ace
parking lot (located on Kensington Rd) on Sunday only. They believe the limestone parking lot is
sufficient for practice days and would be designed in a circular pattern so that the children can be
dropped off in the lot and not on the street, then the cars can return onto the street. On Sunday,
when there may be more traffic, they have made arrangements for parking at Ace Hardware. If
need be, there is additional parking at the Oak Brook Park District, but they do not anticipate the
need for its use. On game day, at any given time, there may be no more than 60 cars and they are
anticipating being able to accommodate 57 cars, so between the lot and the availability of parking
at Ace, they do not believe it will be needed.
The designated player and fan benches, which by league rules, fans and players must be on the
opposite ends of the fields, are located on the field. They intend to place some of those shown on
the plan, but it depends on the fundraising by spring. An overview was provided that shows exactly
what they are trying to do.
The final issue, is that of the storage shed. They are required to maintain the property, so they will
need to have a commercial grade lawnmower and a place to store it. They plan to buy a 25-foot
storage unit, it would be stored behind the trees and painted green so that it blends into the
landscape. They have do some research and have found that the units are very secure and can be
locked (so as to minimize any vandalism or theft). They will also be able to store other equipment
in the unit.

Is the Hawks Soccer Club a professional club? - Response: No. It is a not-for-profit group
and designated as a 501 c3, under the Internal Revenue Service rules that also defines it as
a charitable organization. One of the key elements of the group, is that no one in the club
profits from anything that the club does, except for the few professional trainers that are
hired. It is mostly girls ages 7 to 14. The founders of the club had daughters so it evolved
into a girls club. With the passing of time, the girls have grown a little, have siblings that are
boys, so they now have several boys team.
What is the age limit of the players? - Response: The group has children that are
approximately 7 to 14 years of age. They will add two youth teams that would be for 14 and
15 year olds, but they only would play half the year, because during the rest of the year they
play at their high school. The maximum age through the league is 18 years of age, which is
through high school. The Hawks do not have anyone that old yet.
How long is the season?— Response: There are actually two seasons, the first season runs
from April to mid-June, maybe a summer program, and resumes around September 1 —
through November 1.
Is it a new league? — Response: No, IWSL (Illinois Women Soccer League), which is the
parent league, is about 25 years old. There are approximately 980 teams in the league.

The league goes as forth as the Wisconsin border and aQr south as Bourbonnais.

There are roughly 12,000 girls playing in the league.
Are there any other fields in the area or close by? — Response: There is one full size and a
smaller youth field in the Oak Brook Park District. They go back to Hinsdale, Clarendon
Hills.
How many cars will there be? — Response: They are building a lot for 57 cars. The idea is
that there is a coach and assistant coach for every team so for practice purposes they
assume there would be roughly 40 maximum cars there, because parents rarely stay for
practice. They practice is shifts so half the kids would be there 4-5:30 and the other half
5:30-7 p.m. At any given time, there probably would be no more than 20 cars during
practice.
Will there be any night games, lights, loudspeakers or amplification?— Response: No to all.
How late will the practice and games be? — Response: Practices go until 7 p.m. dependent
on light conditions. Sunday games are usually from noon until 5 p.m.
How long is the contract?— Response: The license agreement is for two years.
How much will the Village be obligated to cover monetarily for police and fire protection? —
Response: They were paying the not-for-profit rate at the Park District, which is half of the
normal rate. Hopefully, it will open some Park District space for full rate usage so it will
increase the park district revenue. They do not anticipate an impact on police and fire.
What would the International Field be used for? — Response: It is called an International
sized field because it is built to international specifications. It is 70 wide by 120 long, which
is the maximum by regulation. The idea was to have one very nice field, with the best
possible grass, to use for a championship game or as a showpiece. .
Charlie Blum, 3000 Coolidge, said that his daughter and friends are part of the Hawks
organization and said that it would be a nice amenity to have a facility like this within the village.
Peter Delaportes, resident, said that he has three daughters and a son and that his daughters
have just started in the Hawks program. For McDonald's to allow these fields to be built on
their land, is amazing. It is the best thing he has seen for this Village in a long time, so they are
very much in support of it.
Marie Kokenis, 10 York Lake Court, said that she is an assistant coach with the Hawks and she
is also an Oak Brook Park District Commissioner. Her daughter is going into the 6th grade at
Butler. She said that this is an important community need. As a commissioner, they have
started lacrosse programs at the Park District, which takes away the use of the soccer fields by
outside organizations so that it can be offered to the children of the community. It has become
a big sport; therefore, lacrosse and soccer are vying for the same space. This use helps the
Park District and AWSO is able to use the fields at the Park District more so it would open more
time for everyone. She is the Oak Brook Park District Soccer liaison, and everyone on the
board is in support of the proposal and thinks that McDonald's has done a wonderful thing for
the community.
Member Braune questioned whether the license agreement with McDonald's was exclusive and
whether other groups would try to use the facility believing that the property may be part of park
district. Mr. Ruskowski responded that it is an exclusive agreement and that McDonald's is
requiring signage be placed on the property stating that the soccer fields are designated for

considered trespassing. There is a similar sign in place on the property now that indicates it is
not for public use. There will be a fair amount of self-policing, but the Oak Brook police
department, would police it as they are now. McDonald's Corporation also regularly polices the
property.
Member Wolin said that this is a very positive program and it behooves them to support it. He
said that the parking lot appears small for the number of fields. He q uestioned what the traffic
is like in the area during the week at peak times? — Response: In regards to the parking lot it
is important to remember is that not all of the teams will be there at any given time. On the
practice schedule, it appears the most teams practicing at the same time would d be about 6-7
teams, which would be roughly 12-14 cars. On Sundays, at any given time, there would be six
games going on and at any given time, there would be 40-45 cars coming and going. With 57
spaces, they believe that a fair amount is covered. The Ace property will handle any overflow.
Most of the games are held on Sunday between noon and 5 p.m. In regards to the traffic. Over
the last several months of driving in that area he has observed that because Kensington is not a
through road, there is not a lot of passerby traffic. It appears to be mostly traffic to and from the
office buildings on that road. The congestion appeared to be more on Jorie Blvd than on
Kensington.
Member Bulin asked if parking is allowed on Kensington Road. Response: No, there is
signage indicated that parking is not allowed.
Member Tropinski questioned how the liability issues would b handled. Response: The league
they belong to, The Illinois Women's Soccer League has a master insurance policy with limits of
one million dollars per occurrence. They are considering raising the number.
Member Bulin asked why the International field would be done the following year. Response:
They want to do a nice job on it to make it a showpiece field. Right now, they do not have the
money to do it and it will take a fair amount of work.
Member Bulin asked what the renewal terms were with McDonald's. Response: The prevailing
opinion is that if they (Hawks) behave themselves, the fields look good and everyone
(community) likes it, they may be able to use it as soccer fields until the land is developed.
Member Wolin moved, seconded by Member Braune to recommend approval of the request from
the Hawks Soccer Club for a special use including several allowances to the Zoning Ordinance for
soccer fields and related site improvements as depicted on pages 11 and G-1 thru G-4 of the case
file on the property known as Autumn Oaks located at 1315 and 1425 Kensington Road. In making
this recommendation, the Commission finds that the applicant has satisfied the applicable
standards required for a special use including:
1. The proposed use is consistent with the recently adopted special use for "parks and open
field recreational activities" in the ORA-1 District.
2. The McDonald's Corporation as owners of the property have approved the project through a
license agreement between them and the Hawk's Soccer Club.
3. The use of the Autumn Oaks property for recreational purposes is consistent with the
surrounding land uses including being located adjacent to existing recreational uses

REVIEW OF RECONFIGURATION OF
DETENTION BASIN ON LOT 1
Louis Wehrspann, Roake and Associates, said that the previously approved Sue Boon Subdivision,
a three-lot subdivision located near the southeast corner of Oak Brook Road and York Road. The
owner of Lot 1 in the subdivision is going to construct his personal residence on the property. With
the construction, a reconfiguration of the detention facility located within the rear yard is required.
The detention facility is located on private property and the maintenance of the facility is solely the
responsibility of the homeowner. The proposed detention facility consists of a small pond that will
provide an attractive water feature for the rear yard. A graded grass slope of varying degrees
generally surrounds the pond. Along the East Side of the pond, a 2%Z-foot high landscape block
retaining wall is proposed. The wall is nine feet away from the edge of the pond to provide a safety
buffer between the wall and the pond. The design of the proposed pond incorporates several
safety features as required by the Village. Both an above water safety ledge and underwater safety
ledge are provided. In addition to the village's requirements, a safety water ledge at the high water
level has also been incorporated into the pond design adjacent to the retaining wall. The proposed
pond will be owned and maintained by the homeowner. There is no public access to this lot and
the perimeter of the lot will be fenced. The wall is separated from the pond by nine-foot landscape
buffer. They believe that they have met or exceeded all of the safety requirements of the Village.
The owner is looking forward to making his home in Oak Brook.
Michael Castaldo said that he represented his brother, Nick Castaldo in this matter. He reiterated
that this is the responsibility of the homeowner and will have the appropriate insurance policy in
place. They do not see any liability or exposure for the Village of Oak Brook.
No one in the audience spoke in support of or in opposition to the proposed request.
Village Engineer said that he brought the issue up because it was variation from the village
standard, which has no walls in a residential subdivision detention facility, and also that some of the
Village Board and some commissions have had some concerns with various walls over the last
several ears. The wall the are proposing is about 2 % feet high,

By a vote of 5 to 0, with one abstention, (Member Adrian noted that he supported

Director of Community Development Kallien said the Hawks Soccer Club is a not-for-profit group
petitioning for a special use at the Autumn Oaks property to utilize it for soccer facilities. The current
owner of the property is McDonald's Corporation, and they have a license agreement that is contained in
the case file,which details all of the particulars between the two parties.
Acting Chairman Mueller swore in all parties testifying.
Richard Marcheschi, Hawks Board Member spoke on behalf of the Hawks Soccer Club and provided the
background of the organization. He said that the Hawks purpose is to seek a special use to utilize 34
acres of undeveloped land owned by the McDonald's Corporation. The property is located adjacent
to the Oak Brook Park District and is on Jorie Blvd and Kensington. The proposed use of the land is
to develop soccer fields for use by the Hawks Soccer Club which is an Illinois not-for-profit
organization 501(c) 3, and is primarily a girls soccer organization. They have added two boys' teams.

The club's purpose is to encourage and support the expansion of competitive soccer opportunities for
the children in the Hinsdale, Clarendon Hills, Oak Brook and several other surrounding communities
in the area. There are as many as 14 surrounding suburbs!The vast majority of children are from
the Hinsdale, Oak Brook and Clarendon Hills area. Over the last five years, they have experienced
incredible growth. They started with one team of 14 girls, the second year grew to four teams and
now they have a total of 18 girl's teams and 2 boys teams.
Philosophically, their focus is on the individual child's development as well as well as the development
of the development of that child both as a good soccer'as well as a good team player. They compete
in a very strong soccer league, the Illinois Women's Soccer League that is part of the Illinois Youth
Soccer Association. Although they strive to win, they want to create a positive lifelong attitude and
value for the children to take with them. At the coaching level, the parent volunteers almost
exclusively support the team. The girls do receive professional training once a week from a staff of
professional trainers they have hired.
The development of the fields and property as soccer fields for use by children from age 8 to 16 years
of age. Currently, they practice and play home games at six different fields in three different
communities. They are really spread out. A lot of for profit organizations have the ability with
financial resources to both purchase property and development their own fields, they do not have that
luxury. Through the generosity of McDonald's the opportunity to do that with a two-year initial
agreement. It is a temporary use license agreement with McDonald's allowing the development of six
fields and an international field that will be developed at a later time.
They are requesting that the Village of Oak Brook permit a special use to Chapter 10, of the Office-
Research-Assembly District, Section 10A-2 and to consider the special use factors as provided in the
petition. As part of the special use they area requesting allowances to the parking standards, in
particular, hard surface parking lots, parking lot stall dimensions, landscaping and screening, curbing
of access drives and parking lot striping. They are also asking that the soft parking in the form of
crushed limestone in unmarked parking spaces, in keeping with the easily removable and temporary
nature of the proposed changes to the property as required by McDonald's.
Acting Chairman Mueller asked that the special use factors be addressed.
Mr. Marcheschi reviewed the factors as follows:
1. Is of the type described in subsection Al of this Section, is deemed necessary for the public
convenience at that location.
Response: The intended special use for the property as described in this application is
recreational or specifically described, the development and use of soccer fields for the Hawks
Soccer Club, a not for profit organization incorporated under the laws of the State of Illinois,
and a 501 (c) 3 charitable organization as defined by the Internal Revenue Service Code
serving over 300 of the areas children. The club intends to develop seven non-permanent
soccer fields for the practice and games. Given the scarcity of playing fields in the western
suburbs of Chicago, the proposed location provides relief from the overuse of park district
facilities while providing and improved green space in the area adjacent to the Oak Brook
Park District. The Park district may also gain additional revenue by renting current park
district fields at a greater rate than the current not for profit rate currently paid by Hawks
Soccer.

Response: Hawk Soccer will provide landscaping services in great excess of the current
situation, provide sufficient sanitation services, and p ovide for garbage disposal. Sanitation
and trash containers will be obscured from the general public view. Barriers are assembled to
prevent the interference with traffic. Parking is designed so that there is sufficient off street
parking during the week and that there will be an off-street drop off area for the children
participating in activities on the property.
3. Would not cause substantial injury to the value of other property in the neighborhood in which
it is located.
Response: The facility is designed so that there are no permanent structures. All field
construction is intended to be movable and removable. All other structures and facilities are
easily disassembled. Changes to the landscaping would be a substantial improvement to the
current conditions and would enhance the value of the surrounding properties by improving
the appearance of the area. The development of the property would also give the appearance
of a great park district facility due to its location adjacent to the Oak Brook Park District
facilities.
Marie Kokenis, 10 York Lake Court, said that she is an Oak Brook Park District Commissioner and
also has a child in the Hawk Soccer Club. She is the Oak Brook Park District Soccer liaison and is
familiar with the overuse, not only of the Oak Brook Park District soccer fields, but all the soccer fields
in the adjacent communities. In Hinsdale several parks have closed a number of its fields for
reseeding and are not available. The Park District is reseeding its smaller fields, so they are also
unavailable right now. This proposal has allowed the Park District to free up its property to service
AYSO, which is also a non-profit organization, which is in dire need of fields. They will probably use
the Park District fields now. There is a domino effect. Soccer has exploded in the western suburbs as
well as the entire state. They are in very short supply of soccer fields and this allows families to drop
off their children at one location, versus running around to different soccer fields.
Susan Fitch, representative of CarAmerica, which owns properties at 1420 and 1520 Kensington.
She had concerns and questions that she wanted to address. She asked about the location and
service of the port-a-potties at the facility.
Mr. Marcheschi responded by showing her the location of the facilities on the southwest corner of the
lot. It will be serviced weekly as well as the trash.
Ms. Fitch expressed her concerns for congestion and safety for the children and her clients as they
leave work in the evening on Kensington Road.
Mr. Marcheschi said that the parking lot is designed to have a circular drop off area for the children for
safety, with parking. There is a 25-foot setback at the drive. There will also be removable aluminum
barriers to keep the children from going onto Kensington.
Joann Cascio, she is a soccer mother and coach and thinks it will be a fantastic plan. Some of the current
fields can be dangerous. As far as congestion, many of the children carpool .
Member Ascher asked what is different about this soccer league than the league playing by the polo field.
Mr. Marcheschi said that it is a different club. The other club is the Hurricane Soccer Club, both are
traveling programs, but they are a for profit organization and Hawks is a not for profit organization.

that there are mounds on the site that may need to be moved. Mr. Marcheschi responded that they are
fortunate in that the current layout the mounds will not be disturbed at all. No back filling will be required
to accommodate the initial development. There are mounds and berms, but they are lucky in the sense
that it will provide added protection for the children from Jorie Bivd., but will not interfere with the layout of
the fields as proposed.
Member Ascher noted that the license agreement with McDonald's is for two years. It has been indicated
during the presentation that there has been an "explosion" in the growth of the Hawks Soccer Club. At the
end of two years, where will they go, if the agreement is not continued. Mr. Marcheschi, said that they will
have to deal with it when the time comes. As far as the growth over the last five years, they have
managed the growth and they are as big as they can get. People have gravitated toward the club because
of its philosophies and the focus and development of the children and both the highly competitive level as
well as the children who do not want that same amount of practice. They will probably add two teams next
year, simply because the children in the program area getting older. They will reach a point where the kids
will graduate high school and that will be the upper age limit, so the growth will manage itself.
Member Ascher noted, that the Village boards have gone through a great deal of trouble to change the
zoning for the property some time ago.
Director of Community Development Kallien said that the most significant change was at the Campus
Facility next door. The Autumns Oaks property had extensive discussion in terms of traffic study and site
plans that showed what could be built on the site. However, the zoning did remain ORA-1.
Joe Endress, McDonald's Corporation said that ORA-1 is still the zoning for that property and their
intentions for that property is still the same. It is an expansion space for the corporation. While they are
not growing at the rate they were growing earlier, the property is sitting vacant and they thought this would
be a great use for the Hawks Soccer Club.
Member Ascher added that his experience with McDonald's is that they are a great corporate resident and
lauded them for that but did not want to lose site of that and let the Hawks believe it was the end all for
them.
Mr. Endress responded that is why it is a two-year agreement. At this point it is not McDonald's intention
is not to develop the property because of the current growth, however, they did specify with the Hawks
Club that it was a two year agreement and at the end of the two years, they formally get together and
renegotiate the contract so that there is a tentative nature to the arrangement that it is not a permanent
arrangement. In the event, they expand the corporation they may have to take the property away, then
there would not be a lot of screaming children and parents.
Mr. Endress mentioned to CarAmerica that there is specific mention in the license agreement about clean
up of that space. They will be policing it more than anyone else will be.
Mr. Marcheschi said that they entered the agreement with McDonald's fully aware of the two year
limitation, which is why everything in the plan is movable and removable from the premises.
Acting Chairman Mueller said that the Zoning Board of Appeals is in receipt of the report from the Plan
Commission and that they unanimously recommended approval of the request subject to several
conditions. The petitioner has addressed the standards and they are set forth in the file.
Member Ascher moved, seconded by Member Shah to recommend approval of the request from the
Hawks Soccer Club for a special use including several allowances to the Zoning Ordinance for soccer
fields and related site improvements as depicted on pages 11 and 15, and G-1 through G-4 of the
case file on the property known as Autumn Oaks located at 1315 and 1425 Kensington Road. In
making this recommendation, the Zoning Board of Appeals finds that the applicant has satisfied the
applicable standards required for a special use including:

1. The proposed use is consistent with the recently adopted special use for "parks
and open field recreational activities" in the ORA-1 District.
2. The McDonald's Corporation as own s of the property have approved the
project through a license agreement between them and,the Hawk's Soccer
Club.
3. The use of the Autumn Oaks property for recreational purposes is consistent
with the surrounding land uses including being located adjacent to existing
recreational uses operated by the Oak Brook District.
4. The proposal to construct soccer fields and related improvements will provide
for the public benefit and convenience of the community and its residents,
5. The proposal to provide on-site parking, trash/sanitation facilities, installation of
temporary barriers and limiting the hours of operation will protect the public
health, safety and welfare of the community and those utilizing the facilities.
6. The temporary nature of the improvements will not negatively impact the value
of adjacent property.
7. No lighting or amplification is allowed.
8. Final Engineering approval.

Christine Potts, J. B. Architecture Group reviewed the background of the proposal. Originally, the project
started out as a remodel of the residence. They are investing so much into the project that they have
decided it would be much more worth their while to demolish the existing home and replace it with a new
structure. The existing home is a legal nonconforming structure that is extremely outdated, located in a
gorgeous neighborhood and they enjoy living there. Rather than doing a remodel that would hamper the
integrity of the aesthetics to the architecture, they have decided to put up a new residence that would fit in
better with the subdivision and in doing so they are requesting a variation.
Ms. Potts said that as the schematics submitted indicate, the need for a reduction in the sideyard
requirements is requested based upon the response to the standards, which are on page F of the case file
and as follows:
1-a. The property in question cannot yield a reasonable return if permitted to be used only
under the conditions allowed by the regulations governing the district in which it is
located.
Designing the proposed residence to current zoning regulations will greatly detract form the resale
value due to the current home location, which limits the front facade width.

The purpose of this letter is to request a special use exception to utilize 34 acres of
undeveloped property owned by McDonalds Corporation adjacent to the Oak Brook Park
District currently zoned for commercial use. The proposed special use is to develop soccer
fields for the Hawks Soccer Club. The Hawks Soccer Club, Inc. "Hawks" is an Illinois
not-for-profit corporation created for the purpose of encouraging and supporting the
expansion of competitive soccer opportunities for children in the Hinsdale, Clarendon
Hills, Oak Brook and surrounding communities. The Hawks have achieved substantial
growth in the last five years placing tremendous pressure finding sufficient playing fields
for the children.
The Hawks Soccer Club philosophy is to focus on the individual child and the development
of that child as both a skilled soccer player and a good team player. While competing in a
strong league soccer program and striving to win, we also want to create positive life-long
attitudes and values among our team players. Although the practice and game schedules
are still quite demanding, we endeavor to maintain an over all family centered focus by
holding costs down and keeping play to a more local area and workable time schedule. We
depend on parental involvement in support of our teams and look to parents to assist in
various capacities.
Our team coaches are all volunteers who enjoy working with youth and helping them to
increase their soccer skills. The Illinois Youth Soccer Association licenses all our coaches.
The coaches are geared toward providing a positive learning environment and to helping
the players develop a positive attitude towards the game of soccer, its rules, their
teammates, their opponents, their coaches, the referees, and most importantly, themselves.
Our players also receive the benefits of weekly instruction from professional trainers.

20 girl's teams for the 2003-2004 seasons, including two U-16 teams, two U-15 teams, one
U-14 teams,two U-13 teams,three U-12 teams, two U-11 teams, three U-10 teams, two U-
9 teams,three U-8 team and two new boy's teams. As a result,there are currently over 300
children and their families involved with the Hawks. Players on the Hawks teams come
from many western suburban communities including Brookfield, Burr Ridge, Clarendon
Hills, Darien, Downers Grove, Elmhurst, Hinsdale, LaGrange, LaGrange Park, Lake in the
Hills North Riverside Oak Brook Westchester, Western Springs, Westmont, Willowbrook
and Woodridge. The Hawks participate in the Illinois Women's Soccer League,competing
in both the fall and spring outdoor seasons, and also various regional tournaments. With
such phenomenal growth in our club, the strain on local park districts and schools to
provide fields for practice and play has been great. Unlike most other clubs in the area, the
Hawks have no particular home.
Currently,the Hawks practice and play their home games on six different fields in three
different communities. Although some for-profit soccer clubs have the financial resources
to purchase property to develop facilities, other clubs rely on the generosity of corporate
partners to provide real estate for athletic fields. Currently,Motorola provides fields to the
Libertyville Soccer Association,United Airlines provides fields for the Green White
Soccer Club, and Lucent Technologies provides fields for Wheaton Wings Soccer Club.
Although the Hawks function well without their own fields and facilities, it is critical to the
future growth and development of the Club to find a location that the Hawks can call home.
McDonald's Corporation has generously agreed to allow us to utilize property across from
their Corporate Campus to develop a number of soccer fields.
Recently,the Hawks have signed a license agreement with McDonald's Corporation that
allows the Hawks to develop the aforementioned property for soccer fields. (Exhibit A)
This is of course dependent upon the Hawks obtaining a special use exemption from the
Village of Oak Brook. In the agreement,the Hawks will develop the fields,utilize
removable equipment, and provide for regular grounds maintenance,parking, sanitation,
and garbage removal. The initial renewable term is for two years and the intent is to return
the property to a condition suitable for commercial development when necessary with
minimum effort. Currently zoned for commercial development,the Hawks Soccer Club
requests that the Village of Oak Brook permit a special use exception to Chapter 10-Office
—Research-Assembly Districts in particular Section 13-10A-2 considering the Special Use
Factors(Exhibit B) as provided in the Petition Application for a Public Hearing. As
part of the Special Use we are requesting allowances to the Zoning Ordinance and rational
for the request:
a. 13-124A Hard Surface Parking lots.
b. 13-12-3C Parking lot stall dimensions.
c. 13-12-4B,C&D Parking lot landscaping, and Screening
d. 13-12-4G Curbing of access drives and parking lots.
e. 13-124H Parking lot stripping.
The Hawks also ask for these allowances to provide"soft parking"in the form of crushed
limestone and unmarked spaces keeping with"easily removable"and temporary nature of

Special Use Factors
1. Is of the type described in subsection Al of this
Section, is deemed necessary for the public
convenience at that location.
The intended "special use" for the property as described in this Application
is recreational or specifically described, the development and use of soccer
fields for the Hawks Soccer Club, a not for profit organization incorporated
under the laws of the State of Illinois, and a 501(c) 3 charitable organization
as defined by the Internal Revenue Service Code serving over 300 of the
areas children . The club intends to develop seven non-permanent soccer
fields for the practice and games. Given the scarcity of playing fields in the
western suburbs of Chicago, the proposed location provides relief from the
overuse of park district facilities while providing an improved green space in
the area adjacent to the Oak Brook Park District. The Park district may also
gain additional revenue by renting current park district fields at a greater rate
than the current not for profit rate currently paid by Hawks Soccer.

operated that the public health, safety and welfare

Hawk Soccer will provide landscaping services in great excess of the
current situation, provide sufficient sanitation services, and provide for
garbage disposal. Sanitation and trash containers will obscured from the
general public view. Barriers are assembled to prevent the interference
with traffic. Parking is.designed so that there is sufficient off street
parking during the week and that there will be an off-street drop off area
for the children participating in activities on the property.

located.
The facility is designed so that there are no permanent structures. All
field construction is intended to be movable and removable. All other
structures and facilities are easily disassembled. Changes to the
landscaping would be a substantial improvements to the current
conditions and would enhance the value of the surrounding properties by
improving the appearance of the area. The development of the property
would also give the appearance of a greater park district facility due to its
location adjacent to the Oak Brook Park District Facilities.

Parkin
Practice day parking(Monday through Saturday) shall be provided by a 57
space crushed limestone parking lot utilizing current curb cut located on the
premises. At any given time a maximum of 10 teams will be practicing.
Each team will have at maximum two coaches who will require parking at
any given time. Parking lot in the site plan is designed in a horseshoe so that
children can be dropped off safely away from Kensington Drive.
Game Day maximum volume of traffic will occur on Sunday between the
hours of 11:30 am and 5:00 pm. At any given time three to four games may
be taking place. (The Hawks have nineteen total teams of which half will
play away on any given Sunday. Nine teams over three time slots or three
games occurring at any given time. An average of 14 children per team and
six teams participating in games at any given time yield a total of 84
children. With two children per car approximately 42 spaces are needed at
any given time on Sunday).The development has planed 57 total parking
spaces with two designated handicapped parking spaces. If there is any
additional parking required, the cars will be directed to the Oak Brook Park
District Lots and by arrangement, the adjacent office parking lots across
from the fields.
Tournaments. Once per year the Hawks may sponsor a Soccer tournament
where parking for approximately two hundred cars may be necessary. At
that time special arrangement with McDonald's Corporation may be made
for use of their parking lots in addition to the aforementioned parking lots.
Equipment
Goals. 8'H x 24'W x 3'D. 4" aluminum tube construction with ground
anchors. All white polycoat painted exterior.
Benches. 21'x 10" wide aluminum bench and frame. (see appendix)

Backstop System. 20' H x 65' W. Four, four-inch aluminum tubes with
hoist system for the nets, installed in ground sleeves. Backstop system are
removed at the end of the game day and in-ground sleeves will be caped.
The backstop is installed 20' behind the goals backing up to Kensington.

Training Goals. Four 8' x 24' training goals are installed at the center line
