SUBJECT: Sale of Surplus Vehicles via DuPage Mayors and Managers Conference

RECOMMENDATION: That the Village Board pass the attached ordinance declaring five
vehicles surplus and authorizing their sale through the DuPage
Mayors and Managers Conference public auction.
The attached ordinance declares five vehicles as surplus and authorizes their sale at the DuPage Mayors
and Managers Conference surplus vehicle and equipment auction. The vehicles declared surplus will
be five former Police Department vehicles: unit numbers 200, 304,'311, 408 and 924. New
replacement police vehicles were delivered in June, 2002. The attached ordinance contains the age
and the approximate current mileage for these vehicles. The Conference charges a 15% administrative
fee, which will be subtracted from the gross receipts. Also, a $50 charge is imposed on any vehicle
that is brought to the auction that does not sell.
At the most recent auction in June, the Village disposed of four vehicles (one was inoperable) and
received net proceeds of $8,415.00.
The auction is scheduled for Saturday, September 7, 2002 at the College of DuPage, with bidding
beginning at 10:00 am. As in the past years, the Village is required to supply one staff person (usually
a Police Officer) to assist the Conference with the auction.

3. Trustee Savino noted that September 11 h was soon approaching and he
suggested that the flags currently flying on 22 "d Street remain until after
September 11, 2002. Public Works Director Meranda indicated there would not
be any problem with leaving the flags in place.
President Bushy reported that the bill permitting an upward adjustment of the
non -home rule sales tax for property tax relief had been signed by the Governor
as Public Act 92 -0739. She suggested a special Village Board meeting for
Thursday, August 22, 2002 to discuss options available to the Village. She
asked that the Board check their schedules and let staff know their availability.
In response to Trustee Aktipis' comments at a previous meeting regarding
wheeled containers for recyclables, President Bushy provided information
relative to the 30 gallon wheeled toters available through our waste hauler, BFI.
President Bushy acknowledged that Howard Trier, President of the Oak Brook
Park District; Kathy Manofsky, Treasurer of the Oak Brook Park District and
Barbara Benezra, President of the Friends of the Oak Book Library were in
attendance of the meeting.

Motion by Trustee Atkipis, seconded by Trustee Korin, to approve the Minutes cow 7 /22/02
of the Committee -of -the -Whole Meeting of July 22, 2002 as presented and
waive the full reading thereof. VOICE VOTE: Motion carried.
Motion by Trustee Caleel, seconded by Trustee Korin, to approve the Minutes PEG MTG 07123/02
of the Regular Board of Trustees Meeting of July 23, 2002 with an amendment
on page 5 that would clarify that only the section of the old Library building
that will be occupied by the Historical Society would need to be made ADA
compliant and waive the full reading thereof. VOICE VOTE: Motion carried.

Agenda as amended and that the Board has determined that the circumstances
necessitating the change orders were not reasonably foreseeable at the time the
contract was signed and that the change orders are in the best interest of the

AN ORDINANCE AUTHORIZING THE SALE BY PUBLIC AUCTION
OF PERSONAL PROPERTY OWNED BY
THE VILLAGE OF OAK BROOK
WHEREAS, in the opinion of at least a simple majority of the corporate authorities of the
Village of Oak Brook, it is no longer necessary or useful to or for the best interests of the Village
of Oak Brook to retain ownership of the personal property hereinafter described; and
WHEREAS, it has been determined by the President and Board of Trustees of the
Village of Oak Brook to sell said personal property at the DuPage Mayors and Managers
Conference public auction to be held on Saturday, September 7, 2002.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES,
ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted
as though fully set forth herein.
Section 2: That pursuant to 65 ILCS 5/11 -76-4, the President and Board of Trustees of
the Village of Oak Brook find that the following described personal property:
now owned by the Village of Oak Brook, is no longer necessary or useful to the Village of Oak
Brook and the best interests of the Village of Oak Brook will be served by its sale.
Section 3: Pursuant to said 65 ILCS 5/11 -76-4, the Village Manager is hereby
authorized and directed to sell the aforementioned personal property now owned by the Village
of Oak Brook at the DuPage Mayors and Managers Conference public auction, on Saturday,
September 7, 2002 at the College of DuPage, Glen Ellyn, Illinois, to the highest bidder on said
property.
Section 4: The Village Manager is hereby authorized and may direct the DuPage
Mayors and Managers Conference to advertise the sale of the aforementioned personal
property in a newspaper published within the county before the date of said public auction.
Section 5: The Village Manager is hereby authorized and may direct the DuPage
Mayors and Managers Conference to enter into an agreement for the sale of said personal

property. The Conference will charge an administrative fee that will come out of the proceeds
from the sale of surplus vehicles and equipment described in Section 2.
Section 6: Upon payment of the full auction price, the Village Manager is hereby
authorized and directed to convey and transfer title to the aforesaid personal property to the
successful bidder.
Section 7: This ordinance shall be in full force and effect from and after passage, by a
simple majority vote of the corporate authorities, and approval pursuant to law.
