G-810 - 09/12/2006 - ALCOHOL - Ordinances Supporting Documents• ITEM 6.H. AGENDA ITEM Regular Board of Trustees Meeting of September 12, 2006 SUBJECT: Correction of Liquor Ordinances FROM: Kenneth T. Kubiesa, Village Attorney BUDGET SOURCE /BUDGET IMPACT: N/A RECOMMENDED MOTION: I move for passage of Ordinance G -810, "An Ordinance Amending Title 4, Chapter 1, Section 8a Of The Village Code Of The Village Of Oak Brook, Illinois Relative To The Number Of Authorized Liquor Licenses And Correcting Ordinances G -806, G -807 And G -809 Background /History: In the past three months, the following ordinances pertaining to liquor licenses have been passed by the Board: ;OrdinanceF umber z -0 3 Date passedr ; ,,, £ - :s=, =' s,►escription, -` G -804 6/13/2006 Nieman Marcus — corporate name change G -805 6/27/2006 Special Event License — new Class F G -806 7/25/2006 Kona Sushi — addition to Class A- I, from 19 to 20 G -807 7/25/2006 McCool's — corporate name change- G-809 8/22/2006 Marshall Field's — corporate/business name , change G -804 and G -805 are included in the table above merely for reference purposes and do not need to be corrected. However, G -806, G -807 and G -809 need to be corrected as the table of classifications in these ordinances failed to include the Class F license created by G -805, or the 1,41 Class G license. In addition, G -809 identified the number of Class A -1 licenses incorrectly as nineteen (19) instead of the twenty (20) currently issued. The legal department has been working diligently to better track new licenses issued due to naive or corporate changes in the Clerk's records, and the new ordinance form has created some confusion that is hopefully now resolved by this ordinance. Even though several sets of eyes reviewed these ordinances, the use of a previous computer form and the inadvertent exclusion of the bottom of the table of classifications resulted in the errors. This Ordinance G -810 serves to correct the inadvertent errors in G -806, G -807 and G -809 to reflect the addition of the new Class F and correct the number of Class A -1 licenses to twenty (20). Recommendation: I recommend that Ordinance G -810 be passed.
