RECOMMENDATION: That the Village Board pass, and the President approve,
Ordinance 2003 -ZO -S- , as submitted herewith, authorizing the
variation for the Warner property at 26 Baybrook Lane.
At the last Village Board meeting, the Board accepted the positive recommendation made by the
Zoning Board of Appeals with reference to this variation and directed the Village Attorney to prepare
the ordinance implementing same. This would allow the installation of driveway gates at 26 Baybrook
Lane.

AN ORDINANCE GRANTING A VARIATION FROM THE
PROVISIONS OF SECTION 13 -3 -14 OF TITLE 13
( "ZONING REGULATIONS") OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK RELATIVE TO
DRIVEWAY GATES
(Warner - 26 Baybrook Lane, Oak Brook, IL 60523 / P.I.N. 06 -28- 212 -006)
WHEREAS, the Village of Oak Brook has heretofore adopted an ordinance setting forth
the Zoning Regulations for the Village of Oak Brook in Title 13 of the Village Code; and
WHEREAS, Section 13 -14 -6 of the Village Code sets forth the authority and standards of
the granting of variations to the Zoning Regulations;
WHEREAS, Ty Warner ( "Petitioner ") is the owner of certain property legally described
as follows:
LOT 60 IN GINGER CREEK, BEING A SUBDIVISION OF PARTS OF
SECTIONS 27 AND 28, TOWNSHIP 39 NORTH, RANGE 11, EAST OF
THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT
THEREOF RECORDED DECEMBER 30, 1980 AS DOCUMENT 9920575
IN DUPAGE COUNTY, ILLINOIS.
P.I.N. 06 -28- 212 -006
commonly known as 26 Baybrook Lane, Oak Brook, Illinois ( "Subject Property "); and
WHEREAS, the Subject Property is less than one acre and does not abut a thoroughfare
and the zoning regulations do not permit the installation of a driveway gate on a property that is
less than one acre and does not abut a thoroughfare;
WHEREAS, the Petitioner has submitted a petition for variation to allow the installation
of driveway gates on the Subject Property,
WHEREAS, the Petitioner has offered to remove the gates upon the sale of the property =_
or upon moving from the property and has agreed to a deed restriction requiring the removal of
the gates if the Petitioner sells the property or if the Petitioner no longer resides at the property;
WHEREAS, on August 5, 2003, the Zoning Board of Appeals of the Village of Oak
Brook conducted a public hearing at the Oak Brook Village Hall, 1200 Oak Brook Road, Oak
Ordinance 2003- ZO -V -S -1054

Brook, Illinois in connection with the aforesaid petition, after due notice and appropriate legal
notice was given;
WHEREAS, the Zoning Board of Appeals specifically considered the standards set forth
in Section 13 -14 -6 (D) of the Village Code and made the following findings of fact, as follows:
(1) that the Petitioner has satisfied the standards for variations required by the Zoning
Ordinance; and
(2) that the Petitioner has demonstrated unique circumstances; and
(3) that the hardship of the Petitioner is not of his own making;
WHEREAS, the Zoning Board of Appeals recommended approval of the requested
variation;
WHEREAS, the Village President and Board of Trustees concur with the findings and
recommendations made by the Zoning Board of Appeals;
WHEREAS, all applicable requirements of Section 13 -14 -6 of the Village Code relating
to the granting of variations to the Zoning Regulations have been met.
NOW THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Oak Brook, DuPage and Cook Counties, Illinois as follows:
SECTION 1. That the recitals hereto are incorporated as part of this ordinance.
SECTION 2. That a variation to Section 13- 3 -14(A) of the Zoning Regulations of the
Oak Brook Code is hereby granted to permit the installation of driveway gates on the Subject
Property subject to the following conditions:
a) that the gates be constructed in conformance with the plans prepared by Matocha
Associates, dated July 3, 2003, and entered into evidence for consideration by the Zoning
Board of Appeals, and
b) that petitioner executes an agreement, within thirty (30) days of the date that this
ordinance is passed, restricting the Subject Property that the gates will be removed from
the Subject Property if Petitioner sells the property or no longer resides at the property,
and
c) that the existing dense landscaping be maintained in its current condition such that the
gates will be very unobtrusive and minimally visible from Baybrook Lane.

SECTION 3. That this Ordinance is limited and restricted to the property commonly
known as 26 Baybrook Lane, Oak Brook, Illinois, P.I.N. 06 -28 -212 -006.
SECTION 4. All ordinances or parts of ordinances in conflict with this ordinance are
hereby amended to the extent of the conflict.
SECTION 5. This ordinance shall be in full force and effect after passage and
publication according to law.

WHEREAS, il•ae Vi.l,lage of Oak Brook has heretofore adopted an ordinance setting forth
the Zonixag Regulations for tlae Village of Oak Brook in Title 13 of the Village Code; and
WHEREAS, Section 13-14-6 of tlae Village Code sets forth the authority and standards of
the granting of vaiiations to the Zoning Regulations;
WHEREAS, Ty Warier (" Petitioner") is the owner of certain property legally described
as follows:
LOT 60 IN GINGER. CREEK, BEING A.. SUBDIVISION OF PARTS OF
SECTIONS 27 AND 28, TOWNSHIP 39 NORTH , RANGE 11, EAST OF
THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT
THEREOF RECORD - ED DECEMBER 30, 1980 AS DOCUMENT 992057,

WHEREAS, the Petitioner has subinitted a petition for variation to allow the installation
of d6veway gates on the Subject Property,
WHEREAS, the Petitioner has offered to remove the gates upon the sale of the property -_
or upoaa moving from the property and has agreed to a deed restriction requiring the removal of
the gates if the Petitioner sells the property or if the Petitioner no longer resides at the property;

There have been some questions raised recently regarding the Ty Warner Variation for Driveway Gates
at 26 Baybrook Lane Ordinance /Covenant that was done in October of 2003.
I have attached a copy of the ordinance and a response from our Attorney's office regarding the
documents.
It appears the Ordinance is in place and was recorded with DuPage County thereby placing the certain
conditions on the title of the property should the petitioner sell the property or no longer resides at the
property. We -have not been able to locate a signed covenant which is being handled by our Attorneys;
as you will see in the attached, the Ordinance is legal and binding above all agreements.

I have reviewed the file concerning the variation granted to Ty Warner for driveway gates
at 26 Baybrook Lane, and I have determined the following:
1. Ordinance 2003- ZO -V -S -1054; "An Ordinance Granting a Variation from the
Provisions of Section 13 -3 -14 of Title 13 ( "Zoning Regulations ") of the Village
Code of the Village of Oak Brook Relative to Driveway Gates (Warner -- 26
Baybrook Lane, Oak Brook IL 60523/P.I.N. 06 -28- 212 - 006) ", was passed and
approved on September 23, 2003, and recorded on October 29, 2003. Section 2 of
the Ordinance specifically provides as follows:
SECTION 2. That a variation to Section 13- 3 -14(A) of the Zoning
Regulations of the Oak Brook Code is hereby granted to permit the installation of
driveway gates on the Subject Property subject to the following conditions:.. .
b) that petitioner executes an agreement within thirty (30) days of the date
that this ordinance is passed, restricting the Subject Property that the gates
will be removed from the Subject Property if Petitioner sells the property
or no longer resides at the property....
This Ordinance binds the Petitioner /Owner to its requirements, including the
requirement to execute and abide by such an agreement, and remove the gates if
the Petitioner /Owner sells the property or no longer resides at the property. In
effect, if an agreement is not executed, or if the gates are not removed when
required, the variation could be deemed-voided, and the Village could require the
removal of the gates.
2. Notwithstanding the recording of Ordinance 2003- ZO -V -S -1054, and its binding
and enforceable effect on the Petitioner/Property Owner, this office has prepared,
and transmitted to the Petitioner's representative for execution, an "Agreement for
Restrictive Covenant for Driveway;, Gates on ;the Property at 26 Baybrook Lane,
Oak Brook, Illinois, P.I.N. #06 -28- 212 - 006", and a "Declaration of Restrictive
Covenant ". Upon receipt of these executed documents, they will also be
recorded. Although it is my opinion that, these documents do not significantly add
to the obligations of the Petitioner/Property Owner with respect to the removal of
the gates if the Subject Property is sold or he no longer resides at the Subject
Property, they will serve to provide a modicum of additional protection to the
Village of Oak Brook in enforcing these obligations.
I trust that this opinion will lay to rest any concern or controversy regarding the
obligations of the Petitioner /Owner with respect to the gate installed pursuant to the variation
granted under Ordinance 2003- ZO -V -S -1054. If there are further questions, please feel free to
ask.

On December 20, 2006, I sent you a copy of Ordinance 2003- ZO -V -S -1054, "An
Ordinance Granting a Variation from the Provisions of Section 13 -3 -14 of Title 13 ( "Zoning
Regulations ") of the Village Code of the Village of Oak Brook Relative to Driveway Gates" (tile
"Ordinance "), which granted a variation for an entrance gate at the Warner residence at 26
Baybrook Lane, Oak Brook, IL, 6052' ). By your agreement, as representative of the Petitioner,
Section 2(b) of the Ordinance conditioned approval of the variation on execution of an
agreement by the petitioner, within thirty (30) days of the date that the Ordinance was passed,
restricting the Subject Property so that the gates will be removed if the petitioner sells the
property or no longer resides at the property.
As I indicated in our telephone conversation last week, the Village of Oak Brook is
currently unable to locate a copy of the executed agreement in its files. Apparently, your files
also do not include an executed copy of the agreement and covenant forwarded to you by one of
the Village's attorneys in 2003. We agreed that I would forward a copy of the agreement and
covenant to you, and that you would arrange to have Mr. Warner execute them.
Enclosed are an agreement and declaration for Mr. Warner's signature. Once executed,
please return the executed originals to me for recording. Thank you for your cooperation in this
matter.

Lane, Oak Brook, Illinois (the "Subject Property "), petitioned the Village for a zoning variation
to install driveway gates on the Subject Property; and
WHEREAS, on September 23, 2003, the Village approved Ordinance 2003- ZO -V -S-
10541 "AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF
SECTION 13 -344 OF TITLE 13 ( "ZONING REGULATIONS ") OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK RELATIVE TO DRIVEWAY GATES" (the "Variation
Ordinance "), by which the Village granted a variation from its zoning regulations allowing
driveway gates to be installed on the Subject Property, subject to the condition that Ty Warner
execute an agreement, within thirty (30) days of September 23, 2003, restricting the Subject
Property that the gates will be removed from the Subject Property if petitioner sells the property
or no longer resides at the property; and
WHEREAS, the Variation Ordinance was recorded with the DuPage County Recorder of
Deeds on October 29, 2003 as Document No. R2003- 417167,
NOW, THEREFORE, in consideration of the approval of the requested variation, Ty
Warner hereby agrees as follows:
1. To remove the gates fi-om the Subject Property if he sells the property or no
longer resides at the property; and
2. To execute the "Declaration of Restrictive Covenant" attached hereto as Exhibit
"A" (the "Declaration "), which shall be recorded by the Village as a restriction on the title of the
Subject Property.
