RECOMMENDED MOTION: I move to refer the request for a Special Use to the July 16,
2007 meeting of the Plan Commission and to the Zoning Board of Appeals for public hearing at
its June 25, 2007 meeting.
Background /History:
InSite Oak Brook Limited Partnership, the owner of 1603 16th Street has submitted a petition
seeking approval of a special use for a drive -thru banking facility.
Recommendation:
Please refer the request for a special use to the July 16, 2007 Plan Commission meeting and to
the August 7, 2007 Zoning Board of Appeals meeting.

RECOMMENDED MOTION: I move to pass Ordinance S -1208, An Ordinance Granting
a Special Use for a Drive -In Banking Facility
Background /History:
Per recommendation of the Plan Commission and the Zoning Board of Appeals, the President
and Board of Trustees have directed the Village Attorney to draft this Ordinance which requests
that a special use be granted to permit construction of a 3 -bay drive -in banking facility for the
property owned by the InSite Oak Brook Limited Partnership, located at 1603 16th Street.
Recommendation:
I recommend that this Ordinance be considered for passage.

AN ORDINANCE GRAFTING A SPECIAL USE
FOR A DRIVE -IN BANKING FACILITY

WHEREAS, the owner of the property, InSite Oak Brook Limited Partnership and the tenant, Fifth
Third Bancorp ( "Petitioners ") at 1603 16t Street, Oak Brook, Illinois ( "Subject Property ") have applied to
the Village for a special use to permit construction of a three (3) bay drive -in banking facility, and
WHEREAS, on July 16, 2007 the Plan Commission reviewed the request for the special use and
recommended its approval; and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on August 22, 2007
pursuant to due and appropriate legal notice, regarding the request for special use and recommended
approval of the special use; and
WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the Petitioners
satisfactorily addressed the factors required for approval of this special use and made specific findings;
and
WHEREAS, the Village president and Board of Trustees have reviewed the recommendations of
the Plan Commission and Zoning Board of Appeals and deem the special uses as set forth below to be in
the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: That the recitals above are hereby incorporated into and made a part of this
ordinance.
Section 2: That the Subject Property aforesaid is hereby granted a special use to permit
construction of a three (3) bay drive -in banking facility, subject to the following conditions-
1 Development in accordance to the site plans proposed by Fifth Third Bancorp prepared
by Charles Vincent George Design Group, Inc , dated June 8, 2007;
2 Construction of a landscaped wall /berm along the south side of the bank - drive -thru
addressing concerns raised by the residents of Oakbrook Terrace;
3 Amend the landscape plan to enhance and extend the evergreen vegetation south along
the west side of the retaining wall as prepared by Charles Vincent George Design Group,
Inc., dated August 29, 2007;
4 All lighting on the bank property shall be properly screened to ensure that the illumination
shall not exceed .5 foot candles at the property line; and
5. Notwithstanding the exhibits contained in the case file, the Applicant shall meet all Village
ordinance requirements at the time of building permit application except as specifically
varied or waived.

property located at 1603 16th Street, Oak Brook, Illinois, which property is legally described as follows.

UNIT NUMBER THREE, BEING A SUBDIVISION IN THE SOUTH EAST Y4 OF SECTION 22,

ACCORDING TO THE PLAT OF SAID RESUBDIVISION RECORDED SEPTEMBER 8, 1988 AS
