AN ORDINANCE GRANTING A SPECIAL USE TO
CUBELLIS MGDF, ON BEHALF OF MID-AMERICA ASSET MANAGEMENT,
FOR AN OUTDOOR DINING AREA ADJACENT TO A RESTAURANT FOR PANERA BREAD

WHEREAS, an application has been filed by Cubellis MGDF, on behalf of Mid-America Asset
Management, requesting a special use for an outdoor dining area adjacent to a restaurant, for Panera
Bread, located at 1600 16th Street, Oak Brook, Illinois; and
WHEREAS, on August 21, 2006, the Plan Commission reviewed the request for a special use
and recommended its approval subject to certain conditions; and
WHEREAS, on September 5, 2006, the Zoning Board of Appeals conducted a public hearing on
the request for a special use pursuant to due and appropriate legal notice, and recommended approval of
the special use subject to certain conditions; and
WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the petitioner
satisfactorily addressed the factors required for approval of the requested special use and made specific
findings, including that the special use for outdoor dining at Panera Bread would be operated so that the
public health, safety and welfare will be protected and there will be no substantial injury to other property
in the neighborhood.;
WHEREAS, the Zoning Board of Appeals and the Plan Commission also found that the request
for the special use was consistent with other outdoor dining arrangements for restaurants within the
Village of Oak Brook; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and Zoning Board of Appeals and deem the special use, as set forth below, to be in
the best interest of the Village;
. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The recitals above are hereby incorporated into and made a part of this ordinance.
Section 2: Cubellis MGDF, on behalf of Mid-America Asset Management, is hereby granted a
special use for outdoor dining adjacent to a restaurant, for Panera Bread, located at 1600 16th Street, Oak
Brook, Illinois, subject to the following conditions:
1) The outdoor dining area shall be limited to twenty-eight (28) seats, and shall be
constructed in substantial conformance with the plans submitted on pages J, K, L and M
(Sheet A-0.1, A-0.2, A-0.3 and A-0.4,) as prepared by Cubellis MGDF and Alkemeyer &
Associates, dated July 13, 2006.
2) Access to the outdoor dining area shall be from the sidewalk that borders the restaurant.
3) The ornamental railings will be provided at the perimeter of the seating areas, and shall
be augmented with piers to provide protection of the seating space.

4) The outdoor dining area shall be operational between April 1 and October 15 of each
year. Tables and chairs shall be removed during the winter months.
5) No live music or other live entertainment shall be allowed in the exterior seating area.
6) No wait service shall be provided to the exterior seating area.
Section 3: The special use and the scope of this ordinance are limited and restricted to the
property of approximately 3 acres in area, including the building occupied by Panera Bread, which is
located at 1600 16th Street, Oak Brook, Illinois, and is legally described as follows:
Lot 1 in Vantage Properties Resubdivision, being a Resubdivision of Lots 13 through 17 and 19
through 28 and parts of Lot 18 in Block 1 in Town Development Company's Elmhurst Countryside
Unit Number One, being a Subdivision of part of the North East 1/4 of Section 22, Township 39
North, Range 11, East of the Third Principal Meridian, according to the Plat of said Vantage
Properties Resubdivision recorded October 29, 1987 as document R67-156766, in DuPage
County, Illinois.

Section 4: Notwithstanding the plans identified in Section 2 of this ordinance, the petitioner shall
meet all Village ordinance requirements at the time of the filing of a building permit.
Section 5: This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.
Section 6: All ordinances or parts thereof in conflict with the provisions of this ordinance be and
the same are hereby repealed to the extent of such conflict.

RECOMMENDED MOTIONS: I move to concur with the recommendations from both
the Plan Commission and Zoning Board of Appeals and approve the requested special use
for outdoor dining adjacent to the Panera Bread Restaurant located at 1600 16`h Street and
authorize the Village Attorney to draft the necessary ordinance for final consideration at
the October 10,2006 Board of Trustees meeting.
BackEround/History:
The Plan Commission, at its meeting on August 21, 2006 and the Zoning Board of Appeals, at its
meeting on September 5, 2006, reviewed a petition submitted by Cubellis MGDF (as authorized
by Panera Bread, on behalf of Mid-America Asset Management) seeking approval of a special
use for outdoor dining adjacent to anew Panera Bread restaurant.
The applicant is seeking a special use to Section 13-7A-2 to permit Panera Bread to incorporate a
28-seat outdoor dining area on the south side of the restaurant. The patrons using the seating
area will be protected from the potential conflicts of vehicles in the parking lot by the installation
of ornamental railings augmented with piers along the perimeter of the seating area.
As part of the applicant's request, a detailed plan of the outdoor dining area has been submitted
along with a list of operational constraints (type of chairs, tables and umbrella, hours of
operation, outdoor music ban, etc.) that will be implemented.

Chairman Davis swore in Wally Funk, Cubellis MGDF, architects for Panera
Bread, Chris Skiles, Senior Construction Manager for Panera Bread and Peter
Dugan from Cubellis MGDF.
Mr. Funk reviewed the request. They are located at the Oaks of Oak Brook
located at 16th Street and Route 83 on the south end of the strip. They are
seeking an outdoor seating area with 28 seats. It would be located along the
south and east edge of the space, occupying what is currently a walkway. They
will not be doing any additional expansion to the building. They will provide a
protective barrier along each area. It will be an ornamental railing with
decorative finished piers to address some of the safety concerns. There will be 6
tables on the south side and 3 tables on the east side. Access will only be from
the exterior and maintaining a clear entrance at the corner and a clear exit way
at the south side.
Chairman Davis noted that the matter was presented to the Plan Commission
and approved unanimously, subject to the conditions set forth on page 7-7.a of
the case file. He asked if they were agreeable to those conditions. Mr. Funk
agreed.
Chairman Davis questioned whether there was vehicular traffic surrounding the
seating area. Mr. Funk responded that there is a two-way traffic aisle, which
runs adjacent (east/west) to the area. There is and a traffic aisle that runs
north/south directly across from the small area. There is very little traffic in the

No one in the audience spoke in support of or in opposition to the request.
Chairman Davis noted that the standards for approval of a special use were
presented in writing on page C of the case file.
Motion by Member Young, seconded by Member Bulin to recommend
approval of the requested Special Use for an outdoor dining area adjacent to a
restaurant, subject to the following conditions.
1. The 28-seat outdoor dining area is to be constructed in substantial

Mr. Newman provided a brief overview of the hotel and the requested text
amendment. Their company is Pyramid Hotel Group in Boston and they
purchased the hotel from Hyatt in February of 2005 for just over $20 million.

Wally Funk, Cubellis MGDF, architects for Panera Bread reviewed the request.
They are located at the Oaks of Oak Brook on the south end of the strip. They are
seeking an outdoor seating area with 28 seats. It would be located along the south
and east edge of the space, occupying what is currently a sidewalk. They will not be
doing any additional expansion to the building. They will provide a protective

railing along each area. It will be an ornamental railing with decorative piers to
address some of the safety concerns. No parking runs headlong into the seating
area.
Member Wolin said that Panera would be a good addition to the center. The only
issue that has been debated in the past on similar requests is the safety issues. He
questioned if there was adequate protection provided along the front seating area.
Director of Community Development Kallien said that applicant was advised of the
safety concerns in regards to the locations of the seating and vehicles in the parking
lot.
Mr. Funk responded that they addressed the issue on both sides of the outdoor dining
area by providing a disguised concrete bollard, which has a repetitive element with
an ornamental metal railing in between and has been spaced in such a fashion that it
would be able to resist traffic or any car that would come along. There is also a
stop sign located right there to stop the traffic. It is also protected by an existing
landscapeg area located just north of the seating area.
No one in the audience spoke in support of or in opposition to the request.
Motion by Member Wolin, seconded by Member Saiyed, to recommend approval of
the requested Special Use for an outdoor dining area adjacent to a restaurant, subject
to the following conditions.
1. The 28-seat outdoor dining area is to be constructed in substantial

The applicant is seeking a special use, Section 13-7A-2 to permit Panera

Staff Comments
In reviewing the site plan for the site, several issues should be considered in
conjunction with your deliberations on these requests:
1. The design of the outdoor dining area is consistent with other
outdoor dining areas in the Village.
2. The proposed ornamental fence and pier system appears to address
the concerns that have been expressed with other similar requests for
protection of patrons from vehicles in the parking lot.
3. The L-shaped parcel (to be known as lot 2) will be used entirely for
additional off-street parking and stormwater management. The
applicant has indicated that lot 2 may be redeveloped when market
conditions can support such a change.
Please see the materials provided by the petitioner in the case file for a more
detailed description and the rationale for this request.
RESPONSIBILITIES OF HEARING BODIES:
The Plan Commission has the responsibility to make a recommendation on
this request for a special use. The Zoning Board of Appeals has the
responsibility to hold the required public hearing on the special use and
make recommendations on this request. Please include in your
consideration, your findings with respect to the standards specified in the
Zoning Ordinance for a special use. The materials submitted by the
applicant specifically address each of these standards.
CONCLUSION: Based on the information provided by Staff, if it is the opinion of the Plan
Commission and Zoning Board of Appeals that the applicant has satisfied
the applicable Ordinance requirements and factors for a special use, a
recommendation would be in order to approve this request subject to the
following conditions:
1. Development in substantial conformance with the approved plans
including the location, size, design and operational guidelines for the
outdoor dining area.
2. Establish the maximum seating capacity for the outdoor dining facility
at 28 seats.
3. Other conditions relevant to the special use request.

Please find attached the required submittal documents for the Special Use Application for an outdoor
seating area at the proposed Panera Bread,to be located at 1600 W. 16"'Street in Oak Brook.
Panera Bread is a Bakery/Caf6 which offers an array of breakfast, lunch and dinner items. The menu
consists of a selection of bakery goods, sandwiches and soups, as well as coffees, teas and other non-
alcoholic beverages. As an asset to the customer dining experience and also as an enhancement to the
exterior aesthetics of the building, Panera Bread requests that a Special Use be granted for the location

• The seating area is available for use by Panera Bread customers who purchase their items
inside and carry them out. There is no wait service to be provided at the exterior seating
area. The tables and seats will be available for use in the summer season, which we
understand to be from April In through October IS', tables and chairs will be removed
during the winter months. Panera Bread's business hours are normally 6 AM to 9 PM
during the summer;the outdoor seating will be available to customers during that time.
• We understand that no live music or other live entertainment will be allowed in the
exterior seating area.
• The outdoor seating area will have no adverse impact on the surrounding properties. The
seating area is to be located on existing sidewalk area directly adjacent to the building and
is buffered from properties directly to the south and west by parking and landscaping. The
properties to the west of the Panera Bread are zoned Residential R-I in Oakbrook
Terrace, while the properties to the east, south and southeast are zoned B-I and B-2 in
Oak Brook. The exit ramps from Route 83 are located directly north of the center.

No special use shall be authorized by the Village Board unless the special use:
I. Is of the type described in subsection A I of this Section, is deemed necessary for the public
convenience at that location;
Response: This standard is not applicable,the outdoor seating area is located on private property
and intended for use by Panera Bread patrons.
2. Is so designed, located and proposed to be operated that the public health,safety and welfare
will be protected;
Response: The outdoor seating area is proposed to be located on an existing area of sidewalk
directly adjacent to the proposed Panera Bread. The seating area shall have ornamental
railings and piers installed at the perimeter to further separate the seating area from the
parking lot. The piers are proposed to be constructed of reinforced concrete and
installed with concrete foundations to Y-6"below grade.
3. Would not cause substantial injury to the value of other property in the neighborhood in which
it is located.
Response: The seating area is to be located on an existing sidewalk area directly adjacent to the
building The seating area is buffered j'ered from properties directly to the south and west by
parking area and landscaping,there is also a raised landscaped berm at the perimeter of

CUBELLIS MGDF, ON BEHALF OF MID - AMERICA ASSET MANAGEMENT,
FOR AN OUTDOOR DINING AREA ADJACENT TO A RESTAURANT FOR PANERA BREAD

WHEREAS, an application has been filed by Cubellis MGDF, on behalf of Mid - America Asset
Management, requesting a special use for an outdoor dining area adjacent to a restaurant, for Panera
Bread, located at 1600 16th Street, Oak Brook, Illinois; and
WHEREAS, on August 21, 2006, the Plan Commission reviewed the request for a special use
and recommended its approval subject to certain conditions; and
WHEREAS, on September 5, 2006, the Zoning Board of Appeals conducted a public hearing on
the request for a special use pursuant to due and appropriate legal notice, and recommended approval of
the special use subject to certain conditions; and
WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the petitioner
satisfactorily addressed the factors required for approval of the requested special use and made specific
findings, including that the special use for outdoor dining at Panera Bread would be operated so that the
public health, safety and welfare will be protected and there will be no substantial injury to other property
in the neighborhood.;
WHEREAS, the Zoning Board of Appeals and the Plan Commission also found that the request
for the special use was consistent with other outdoor dining arrangements for restaurants within the
Village of Oak Brook; and
WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of
the Plan Commission and Zoning Board of Appeals and deem the special use, as set forth below, to be in
the best interest of the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1: The recitals above are hereby incorporated into and made a part of this ordinance.
Section 2: Cubellis MGDF, on behalf of Mid - America Asset Management, is hereby granted a
special use for outdoor dining adjacent to a restaurant, for Panera Bread, located at 1600 16th Street, Oak
Brook, Illinois, subject to the following conditions:
1) The outdoor dining area shall be limited to twenty -eight (28) seats, and shall be
constructed in substantial conformance with the plans submitted on pages J, K, L and M
(Sheet A -0.1, A -0.2, A -0.3 and A -0.4,) as prepared by Cubellis MGDF and Alkemeyer &
Associates, dated July 13, 2006.
2) Access to the outdoor dining area shall be from the sidewalk that borders the restaurant.
3) The ornamental railings will be provided at the perimeter of the seating areas, and shall
be augmented with piers to provide protection of the seating space.

Section 3: The special use and the scope of this ordinance are limited and restricted to the
property of approximately 3 acres in area, including the building occupied by Panera Bread, which is
located at 1600 16th Street, Oak Brook, Illinois, and is legally described as follows:
Lot 1 in Vantage Properties Resubdivision, being a Resubdivision of Lots 13 through 17 and 19
through 28 and parts of Lot 18 in Block 1 in Town Development Company's Elmhurst Countryside
Unit Number One, being a Subdivision of part of the North East % of Section 22, Township 39
North, Range 11, East of the Third Principal Meridian, according to the Plat of said Vantage
