SUBJECT: Ordinance Proposing Establishment of SSA 41 for Irgens Development

RECOMMENDATION: The Village Board approve Ordinance S -1298, an Ordinance
Proposing the Establishment of Special Service Area #1 by the Village of Oak Brook for
Constructing Sanitary Sewer and Highway Improvements, and Providing for a Public Hearing and
Other Procedures in Connection therewith.
Background/History:
As you may remember, the Village Board approved a number of incentives for the Irgens
Development proposed construction of an office building at York and Harger Road. One of them
was creation of a Special Service Area (SSA) to pay for approximately $800,000 in public
improvements to serve the development. This is being done because of the difficulties of getting
bank financing for these improvements. The approval of this ordinance is the first step in creating
this special service area. This ordinance proposes the establishment of the SSA and sets a public
hearing for the SSA on December 14, 2010. It does not approve the SSA, that will happen after
the public hearing.
There is no cost or risk to the Village for this SSA. The SSA bond that will be issued will be
repaid solely by a property tax levied only on the Irgens property. The Village will not be at risk if
there is a default on the bond.
The SSA will be fully explained at the public hearing.
Recommendation:
That the Village Board approve Ordinance S -1298.

AN ORDINANCE PROPOSING THE ESTABLISHMENT OF
SPECIAL SERVICE AREA NO. 1 BY THE VILLAGE OF OAK BROOK FOR CONSTRUCTING
SANITARY SEWER AND HIGHWAY IMPROVEMENTS, AND PROVIDING FOR A PUBLIC HEARING
AND OTHER PROCEDURES IN CONNECTION THEREWITH
BE IT ORDAINED by the Village President and Board of Trustees of the Village of Oak Brook,
DuPage County, Illinois, as follows:
Section 1: Authority to Establish Special Service Areas. That the Village of Oak Brook (the
"Village ") has authority pursuant to Article VII, Section 7 of the Illinois Constitution of 1970 to provide
special services to contiguous areas within its corporate limits and within the corporate limits of other
consenting municipalities; and to provide the manner of levying and imposing additional taxes to pay the
cost of such special service in accordance with the provisions of the Special Service Area Tax Law, 35
ILCS 200/27 -5, et seq.
Section 2: Findings. This Village President and Board of Trustees finds as follows:
(a) that it is in the public interest that the creation of a special service
area (the "SSA ") for the purposes set forth herein be considered;
(b) that the SSA is compact and contiguous and is located wholly within the
Village;
(c) that the SSA will specially benefit from the new construction of a sanitary
sewer system and highway improvements, which new construction is in
addition to municipal services generally provided by the Village as a
whole and it is, therefore, in the best interest of the SSA that the
issuance of bonds in the SSA be considered; and
(d) that the SSA will be known as Village of Oak Brook Special Service Area
No. 1.
Section 3: Public Hearing - Tax Rates - Bonds. That a public hearing, chaired by the Village
Manager, shall be held at 6:30 p.m. on December 14, 2010 in the Samuel E. Dean Board Room, 1200
Oak Brook Road, Oak Brook, Illinois 60523 to consider the creation of the SSA, in the following described
territory within the Village:

At the hearing, there will be considered the issuance of bonds in an amount not to exceed
$850,000 to be paid over not more than eleven (11) years and bearing interest at a rate not to exceed the
greater of 9% per annum or 125% of the rate for the most recent date shown in the 20 G.O. Bond Index
of the average municipal bond yields as published in the most recent edition of The Bond Buyer.
Section 4: Notice of Hearing. Notice of hearing, in substantially the form attached hereto, shall
be published at least once not less than fifteen (15) days prior to the public hearing in one or more

depositing said notice in the U. S. mails addressed to the person or persons in whose name the general
taxes for the last preceding year were paid on each lot, block, tract or parcel of land lying within the
proposed SSA. Said Notice shall be mailed not less than ten (10) days prior to the time set for the public
hearing. In the event taxes for the last preceding year were not paid, the Notice shall be sent to the
person last listed on the tax rolls prior to that year as the owner of the property.
Section 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the
invalidity thereof shall not affect any of the other provisions of this ordinance.
Section 6: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
Section 7: This ordinance shall be in full force and effect from and after its passage, approval and
publication as provided by law.

new construction of a sanitary sewer system and highway improvements.

formation of the special service area and the issuance of bonds.
The issuance of bonds in an amount not to exceed $850,000 payable over not more than eleven
(11) years and bearing interest at a rate not to exceed the greater of 9% per annum or 125% of the rate
for the most recent date shown in the 20 G.O. Bond Index of the average municipal bond yields as
published in the most recent edition of The Bond Buyer will also be considered at the public hearing.
At the hearing, all persons affected will be given an opportunity to be heard. The hearing may be
adjourned without further notice to another date without further notice other than a motion to be entered
upon the minutes of its meeting fixing the time and place of its adjournment.
If a petition signed by at least 51% of the electors residing within the proposed special service
area and by at least 51% of the owners of record of the land included within the boundaries of the
proposed special service area is filed with the Village Clerk within 60 days following the final adjournment
of the public hearing objecting to the creation of the special service area or the issuance of bonds for the
provision of special services to the special service area, no such special service area may be created or
no such bonds may be issued.
