Pursuant to your direction, I have drafted the following ordinances relative to the property at
32 Regent Drive:
(1) An Ordinance Granting A Flood Plain Special Use Permit Pursuant To
Section 9 -1 -8 Of The Village Code Of The Village Of Oak Brook, Illinois
(2) An Ordinance Granting A Variation From The Provisions Of 9- 1 -10B, 9 -1-
10C And 9 -1 -10D Of The Village Code Of The Village Of Oak Brook,
Illinois
Please note the conditions and restrictions set forth in Section 3 of the flood plain special use
ordinance.
I understand you will consider these ordinances at your regular meeting on November 14, 2000.

PURSUANT TO SECTION 9 -1 -8 OF THE VILLAGE CODE OF
THE VILLAGE OF OAK BROOK, ILLINOIS (32 REGENT
DRIVE, OAK BROOK, IL 60523):
Pursuant to the Village Board's direction at their meeting of October
24, 2000, Village Attorney Martens drafted two ordinances relative to
the property at 32 Regent Drive (Haff — Briarwood Lakes Community
Association, Flood Plain Special Use with Variation).
Motion by Trustee Savino, seconded by Trustee McInerney, to approve
Ordinance #2000- ZO- SU -FP -EX 1 -S -976, "An Ordinance Granting a
Flood Plain Special Use Permit Pursuant to Section 9 -1 -8 of the Village
Code of the Village of Oak Brook, Illinois (32 Regent Drive, Oak
Brook, IL 60523)," as presented and waive the full reading thereof.

ORDINANCE 2000- ZO -V -S- 977
AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS
OF 9 -1 -1013, 9 -1 -10C and 9 -1 -1OD OF THE VILLAGE CODE OF
THE VILLAGE OF OAK BROOK, ILLINOIS
(32 Regent Drive, Oak Brook, IL 60523)
WHEREAS, an application has been filed requesting a variation from the provisions of Sections 9-
1 -10B, 9 -1 -10C and 9 -11 OD of the Village Code of The Village of Oak Brook, as amended, reducing the
building top of foundation to 2.2 feet above the base flood elevation rather than the required three feet;
and
WHEREAS, a public hearing on such application has been conducted by the Zoning Board of
Appeals of the Village on October 3, 2000, pursuant to due and appropriate legal notice; and
WHEREAS, a recommendation has been made by the said Zoning Board of Appeals that the
variation requested be approved; and
WHEREAS, this Board of Trustees of the Village of Oak Brook, having reviewed the proceedings
before the Zoning Board of Appeals, finds that the applicant has demonstrated exceptional hardship and
otherwise satisfied the standards of Section 9 -1 -9 of the Village Code of the Village of Oak Brook for the
reasons enumerated in the Zoning Board's October 3, 2000 minutes; and
WHEREAS, the corporate authorities of the Village of Oak Brook deem the passage of this
ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as
though fully set forth herein.
Section 2: That a variation is hereby granted from the provisions of Section 9- 1 -10B, 9 -1-
10C and 9 -1 -1 OD of the Village Code of the Village of Oak Brook to permit construction of a
single - family residence 2.2 feet above the required base flood elevation instead of the required
three feet as depicted on the Topographical Survey and Site Development Plan last revised
August 30, 2000 by Morris Engineering, Inc., a copy of which is incorporated herein by reference.
Section 3: That this ordinance is limited and restricted to the property located at 32 Regent Drive,
Oak Brook, Illinois, which property is legally described as follows:
Lot 257 in Brook Forest Unit Two, being a subdivision of part of Section 27, Township 39
North, Range 11, East of the Third Principal Meridian, in DuPage County, IL.

Section 4: That this ordinance shall be in full force and effect from and after passage and
approval pursuant to law.
