SUBJECT: Amendment to Title 1 of the Village Code — Chapter 14 — Fees

RECOMMENDATION: If it is your wish to move toward approval of this recommendation,
it would be appropriate to pass a motion authorizing Attorney
Martens to draft the necessary ordinance for final consideration at
your November 26, 2002 meeting.
Consistent with the Village Board Objective to update all development codes and ordinances, Staff has
undertaken the process to review `and recommend changes (where appropriate) to the fee schedule
found in Title 1, Chapter 14 of the Village Code. These particular fees are associated with petitions
and applications that are filed with the Village for activities that are reviewed by the Plan Commission
and Zoning Board of Appeals (i.e., amendments, variations, special uses, subdivision plats, etc ).
Using the process that was used in the recent review and update of the fees associated with new
construction, staff has compared the Oak Brook fees against those assessed by other communities in
the area.
Some History
The framework for the existing fee schedule in Chapter 1 was adopted by the Village in March 1981 as
Ordinance G -289. On several occasions, several of these fees were amended However, there does not
appear to be any Board action that would indicate approval of a comprehensive update of this fee
schedule.
The fees specified in Chapter 1 are collected by the Community Development and Engineering
Department's and are deposited in the Village's general fund and offset the expenses incurred for the
review and processing of petitions and applications. Historically, the fees collected for these activities
average approximately $5,000 per year. However in 2002, over $7,000 has been collected.
Cost Recovery/Review Processes
Applying the philosophy of cost recovery that was used as the basis for the recent comprehensive fee
amendment that was enacted in conjunction to the adoption of new building codes, the fees collected to
process applications and petitions should be sufficient to cover the staff time to process the request

Chapter 14 — Fees
through the Plan Commission/Zoning Board/Village Board approval processes. To better understand
these processes, the average application/petition goes through the following steps:
• Pre - application meeting (to review requirements, processes, timeframes)
• Application/petition submittal received
• Review submittal to determine compliance with requirements
• Create files for Plan Commission, Zoning Board, Village Board
• Prepare referral memo to Village Board
• Prepare and mail resident letters
• Prepare public notice (required for public hearing) and publish in newspaper
• Prepare staff report for Plan Commission/Zoning Board
• Meet (when applicable) with the Village Engineer to address engineering issues
• Prepare for Plan Commission/Zoning Board including quorum calls, prepare agendas, etc
• Attend Plan Commission/Zoning Board meeting(s)
• Prepare meeting minutes
• Prepare Plan Commission/Zoning Board Chairman letter
• Prepare Village Board memo
• Update individual case files as additional materials are received
• Attend Village Board meeting
• Prepare applicable ordinance /resolution
Based on a review of the time spent to accomplish all of the aforementioned steps for an "average"
application/petition, a conservative estimate of at least 30 hours of staff time (both Community
Development and Engineering) are spent on each request.
Methodology
In addition to cost recovery, another means of reviewing fees is to compare the Village's fee schedule
against other communities in our area. Accordingly, the fee schedules were gathered from 10 other
jurisdictions in the area including:

• Elmhurst
• Lisle
• Woodridge
• Naperville
• Schaumburg

Chapter 14 — Fees
Comparing the individual elements of fee schedules from different communities is a difficult and
complex exercise. Different communities employ different and sometimes unique methods and /or
rationale for establishing a particular fee amount. As an example, most of the communities surveyed
establish a specific fee that is then applicable to any future request (irrespective of its complexity)
Other communities such as the Village of Lisle have a base fee and then require payment of additional
fees to cover any costs that are incurred for outside services (i.e., legal, engineering, design, etc ).
In comparison, the Oak Brook fee schedule, though complex, is not that different from what is
employed in the majority of the communities that were surveyed. The fee amount that has been
established for each type of application/petition request does not factor in the complexity of a request
A very simple and straightforward special use request to modify an existing site plan would be assessed
the same fee that is required for a very complex project (i.e., St. Paschal's Friary) Because our fees are
collected as a condition of initiating a case before either the Plan Commission or Zoning Board of
Appeals, it is impractical to assess a fee based on the estimated time needed to review and process the
request. Therefore, the fee amount should be sufficient to reasonably cover the "average" time spent
by staff to review and process the request.
Comparison of Fee Schedules
Understanding that communities assess fees differently, one must try to compare the fees assessed by
each of the communities against one another for different kinds of application/petition requests. For
this comparison, fees were calculated for five different requests, including:
Scenario One: A special use request for a commercial project with the following base characteristics.
lot area — 4 acres.
Scenario Two: A variation request for a residential project with the following base characteristics* lot
area — 4 acres.
Scenario Three: A rezoning with the following base characteristics: area — 4 acres; five lots, 2 page
plat; 10 pages of documents to be recorded.
Scenario Four: A preliminary subdivision plat with the following characteristics: use — residential, area
— 4 acres; 5 lots; 2 page plat; 10 pages of documents to be recorded.
Scenario Five: A final subdivision plat with the following characteristics: use — residential; area — 4
acres; 5 lots, 2 page plat; 10 pages of documents to be recorded.
The fees that would be assessed by Oak Brook and each of the 10 surrounding communities for each of
these permits are found in attachment A. An average fee was calculated for each of the permits by
dropping the highest and lowest fee to account for the any significant anomalies that may exist.

The fees for this type of request vary widely — the greatest being the $2000 assessed by Oakbrook
Terrace to the lowest being $250 which is assessed by Schaumburg. The average fee is $507. Oak
Brook's fee of $400 ranks 81h out of 11, and is 78.9 percent of the average fee.
Scenario Two — variation
The fees for this type of request vary but not as significantly as with special uses. The highest fee was
$750 in Lisle, while the lowest fee of $75 was assessed in Hinsdale. The average fee is $306 Oak
Brook's fee of $300 ranks 5th out of 11, and is 98.04 percent of the average fee.
Scenario Three — rezoning /amendment
The fees for this type of request vary significantly — the greatest being the $6500 assessed by Elmhurst
to the lowest being $290 which is assessed by Naperville. The average fee is $631. Oak Brook's fee
of $650 ranks 4th out of 11, and is 103.01 percent of the average fee.
Scenario Four — preliminary subdivision plat
The fees that are charged for a preliminary subdivision plat also differ — the greatest being $1500
assessed by Elmhurst to the lowest being $92 which is assessed by Hinsdale. The average fee is $571
Oak Brook's fee of $500 ranks 6th out of 11, and is 87.6 percent of the average fee
Scenario Five — final subdivision plat
The fees that are charged for a final subdivision plat vary similarly to those charged for preliminary
plats — the greatest being $1500 assessed by Elmhurst to the lowest being $92 which is assessed by
Hinsdale. The average fee is $515. Oak Brook's fee of $500 ranks 5th out of 11, and is 97 1 percent of
the average fee.
Based on the findings of this analysis, even though the Oak Brook fee schedule for petitions and
applications consistently ranks in the upper quartile when compared to the survey group of neighboring
communities, Oak Brook's fee is no where near the maximum fee assessed. Accordingly, to keep the
Oak Brook fee schedule within the range of fees assessed by other communities and more reasonably
cover the costs that are incurred by the Village to process an "average" application/petition request, the
applicable fees need to be increased. It should also be stated that because Oak Brook is relatively built -
out, most of its requests for special use, rezoning, variation, and subdivision are often the result of
redevelopment of existing properties and structures. Because of the constraints that often exist in
redeveloping in an already developed area, the amount of staff necessary to process the request
increases compared to projects that occur on vacant, unimproved property.
Recommendation
The revised fee schedule (attachment B) recommended for your consideration will not only generate
additional revenues, but is based on a comparison of the fees assessed by neighboring communities as

well as provide a mechanism to cover the costs of staff that are involved in the review and approval
processes related to these types of requests. It should be noted that a new fee is recommended to cover
the costs associated with processing extensions to applications for special uses, variations and
subdivisions. Also, cost for publishing the public notice will be passed on to the applicant.
Based on the proposed fee schedule, the fees that would be assessed for each of the five scenarios
previously discussed would increase as depicted in the following table:
From the table above, one can see that the fee for each of the five scenarios has been increased. Even
though the proposed Oak Brook fee would be increased above the average, it would still be less than
the maximum fee assessed by any community that was surveyed.

B. SLEDDING HILL
C.
This agenda item concerns re- shaping and improving the appearance of the
sledding hill just northwest of the Library on the Sports Core property.
President Bushy requested that a discussion be placed on the Unfinished and
New Business portion of the Board Agenda. She stated that several hundred
thousands of dollars were saved by having the dirt remain and not be hauled
away while the new Library was being built. Unfortunately, the hill became
too high and Village Engineer Durfey was able to locate a local company
that is interested in dirt fill at their location and they will be taking the dirt.
,It will be reshaped to a bunny hill for small children to sled during the
winter months and will also be seeded.

8. B. 1) The Fair Labor Standards Act contains a provision for establishing 7g2
agreements with public safety employees for this type of work. The basic
principles are that the rate for the work can be different from the rate paid
to the employee while working as a firefighter provided it is a "bona fide"
rate (i.e. based on reasonable criteria). Further, since the employee is
working additional hours for the employer (albeit, in a different position),
the payment is made at an overtime rate.
The rates were established when the part-time fire inspection program was
implemented, and the Wage and Hour Division deemed the rates to be
"bona fide" based on the formula used. Since that time, the rates have
been increased each year consistent with percentage increases applied to
all un- represented full -time positions.
Based on its current investigation, the Wage and Hour Division has
concluded that new 7g2 agreements should be implemented in order to
more clearly reflect both straight time rates and overtime rates for part-
time work performed by off -duty firefighters. Staff has developed new
rates for positions covered by 7g2 agreements based on survey
information, and the Wage and Hour Division has again approved the
formula by which the new rates were developed.

C AWARD OF CONTRACTS.
1) REMOVE FROM THE TABLE - AUTOMATIC METER READING
(AMR) SYSTEM
Motion by Trustee Caleel, seconded by Trustee Craig, to remove from the
table the award of contract for an automatic meter reading system. VOICE
VOTE: Motion carried.
The Village's water meter reading contract with NICOR will expire on
June 30, 2003. As such, authorization was granted at the Board's March
125 2002 meeting for staff to solicit proposals for the procurement and
installation of a system -wide, automatic meter reading system (AMR).
Subsequently, staff prepared a detailed Request for Proposal (RFP) with a
submittal deadline of June 7, 2002. Five firms responded. After thorough
review of each proposal, three (3) firms, Midwest Meter, Water Resources,
and US Filter were invited to meet with Village staff to discuss their
proposals in depth.
After consulting with several other communities throughout the nation that
had already, or presently are in the process of switching to an AMR
system, staff came to the conclusion that the Hexagram STAR fixed
system would be the system of choice based on the following:
• The fixed system, with its area -wide receiver /antennae network,
automatically collects readings twice a day without employee
involvement. Conversely, with the drive -by system, an employee will
be required to drive throughout the water service area to within 750
feet of the water meter to obtain the reads Staff has estimated that the
time needed to collect reads, both commercial and residential, to be
approximately 80 hours per year for an annual cost of approximately
$2,500.

E. Application for subdivision:
1. Preliminary plat, per lot $ 50
Minimum fee $750
2. Final plat $750
3. Plans and specifications: The following fees for the review of engineering plans
and specifications shall be paid to the Village at the time the documents are
submitted for review:

$20,001.00 to $50,000.00

In addition to the above fees, all applicants shall reimburse the village for any
outside consulting review charges within thirty (30) days of the date the village
seeks reimbursement for such charges.
4. Engineering inspection: At the time the subdivision plat is presented for final
approval, a fee for inspection of the improvement shall be paid to the village in
the amount indicated by the following table:

Dick asked that we change the original ordinance to read as attached (Sterling found the
discrepancies and are making the changes to the code). Then make copies (Note revised'and
give copy of attached to show where changes were made) to whoever got them before and for
official files. Thanks.

1 researched this ordinance (G-,,706) in Sandy's computer, She created
only the ordinance. Attachment B probably came from Gail, and since
she in,not in the office until next year, Z will hold this ordinance
and finalize the corrections next year,
