SUBJECT: Amendment to Title 10 of the Village Code — Chapter 4 Building Regulations — Fee
and Bond Schedule

RECOMMENDED MOTION: I move that the Village Board approve the recommended
changes to the Fee and Bond Schedule in Chapter 10 — Building Regulations and approve
attached ordinance G -908.
Backaround/History:
Beginning in 2001, the Village Board has approved annual updates to the fee schedule in Chapter
10 — Building Regulations relative to fees associated with new construction activities (e.g. permits,
plan review and inspections). At that time, the Board directed that Staff update the fee schedule
each year to ensure that a goal of cost recovery be met.
Proposed Update
Consistent with the Board's goal to cover Staff costs; the fee schedule applicable to our building
regulations has been updated. Each fee category has been increased by approximately three (3)
percent. Some exceptions can be found where rounding was necessary or where the previous fee
was found to be insufficient to recover actual costs. As an example, the existing fees for working
without a permit or occupying a building prior to receiving occupancy are proposed to increase
from $250 to $500. The current fee has proven to not be an effective impediment from starting
work prior to receiving Village approvals.
In addition, our fees for building inspections and plan review are proposed to increase from $56 to
$62 in order to more fully cover all of the staff costs.

Finally, in order to provide better service to our citizens and businesses, a key change in this year's
fee schedule is to make provision for what the code calls "phased approval" of a permit. This
procedure allows for the homeowner or contractor to start some portions of the work before the
entire permit package has been approved. Typically, a phased approval allows for an early start for
some things such as a demolition or excavation.
Positive results will come from the higher satisfaction of getting work completed in a shorter
timeframe from the submittal of the application to start of work. The impact of such a fee on the
recently approved permit for the expansion of Labriola Bakery would have permitted the applicant
to begin construction and take occupancy of the new space sooner than following current processes.
Recommendation:
The revised fee and bond schedule (see attached) recommended for your consideration will generate
an additional $25,000 of revenue and provide a mechanism to continue the Board's goal to cover
the costs of all Village staff involved in the review and approval processes related to new
construction as well as required inspections of existing development.

AN ORDINANCE REVISING THE FEE AND BOND SCHEDULE
BY AMENDING CHAPTER 4 (FEES AND BONDS)
OF TITLE 10 (BUILDING REGULATIONS) OF THE
VILLAGE CODE OF THE VILLAGE OF OAK BROOK
WHEREAS, the President and Board of Trustees have determined that it is necessary to increase
the current building permit fee schedule in order to defray the Village's increased costs relative to the
issuance of building permits and to protect the public health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows:
Section 1. The foregoing preamble is restated and incorporated herein by reference as though
fully set forth herein
Section 2: Chapter 4 (Fees and Bonds) of Title 10 (Building Regulations) of the Village Code is
hereby amended by deleting Chapter 4 in its entirety and substituting the following in lieu thereof:

SECTION.
10 -4 -1. Fee and Bond Schedule
10 -4 -1: FEE AND BOND SCHEDULE: Before a permit required by this Title is issued, the Director of
Community Development shall collect a fee and bond calculated according to the
following schedule.
A. Volume Computation: Volume shall be computed on the exterior dimensions of the building and
shall include all space above the lowest level of the foundation wall and to the highest point of the
main roof and to include all projections
B. Unit of Volume Cost: Figure a fraction larger than one -half (112) as a full unit

21. Inspection Fee (each): $ 62.00
A fee based on the estimated number of inspections will be assessed prior to permit
issuance. Additional inspections will require payment of an additional fee.

A fee assessed for each inspection required to determine compliance with
previously cited violations to the Building Codes of the Village. "For annual
Fire Inspections, the fee will be assessed for continued non - compliance after the
issuance of a 30 day correction notice. For violations that continue 90 days after
the first correction notice will be assessed an additional inspection fee plus an
additional administrative fee of $100 for each subsequent inspection.
24. Cleanup and Street Bond:

Once a permit application has been submitted to the Village for review and
approval, any staff time devoted to plan review shall be billed to the applicant at a
rate of $62 per hour if the applicant makes a formal request to cancel the permit
application.

For permits issued with phased approval — as allowed in the adopted building
code — there shall be an administrative fee in addition to any and all fees required
by this code for each permit so issued. ** *This administrative fee shall be equal
to one half (1/2) the sum of all fees otherwise required in Section 10 -4 -1, but not
less than two hundred dollars ($200.00). All permit and administrative fees
known at the time of the phased approval shall be paid prior to the issuance of
such partial permit. These fees may be recalculated prior to approval of each
phase, modification or at the time of completion.
Section 4: If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not effect any of the other provisions of this ordinance.
Section 5: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
Section 6. This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law.
