An Ordinance Amending Chapter 5 of Title 8 of the Village Code of the Village Of
Oak Brook, Illinois Relating to Water Charges
Trustee Aktipis asked that this item be removed from the Consent Agenda for further
discussion.
Trustee Aktipis reiterated his opposition to any increases in the water charges. He
believed that the increase is both high and premature since there are no specifics
available as to what is actually needed and what it would cost
President Quinlan noted that he had received additional information from the Public
Works Department indicating that during 2005 there had been a record number of
water main breaks and he commented that this was a major reason for his support of
the water rate increase because it is evident that there are needs.

ORDINANCE 2005- ZO -SU -S -1142
AN ORDINANCE GRANTING A SPECIAL USE
FOR A DRIVE -IN BANKING FACILITY

WHEREAS, the owner of the property (Petitioner) at 1110 Jorie Boulevard, Oak Brook, Illinois
(Subject Property) has applied to the Village for a special use to permit construction of a single -bay drive -
in banking facility, and
WHEREAS, the Plan Commission reviewed the request for the special use and recommended its
approval, and
WHEREAS, the Zoning Board of Appeals conducted a public hearing on November 1, 2005
regarding the request for special use pursuant to due and appropriate legal notice, and recommended
approval of the special use; and
WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the Petitioner
satisfactorily addressed the factors required for approval of this special use and made the following
specific findings
1 The proposed drive -in banking facility is consistent with existing building designs, scale
and traffic patterns
2 The Petitioner has addressed all of the applicable factors required for a special use
3 No comments have been received from the neighboring property owners that the
proposed special use will negatively impact the adjacent properties
WHEREAS, the Village president and Board of Trustees have reviewed the recommendations of
the Plan Commission and Zoning Board of Appeals and deem the special use as set forth below to be in
the best interest of the Village,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows
Section 1 That the recitals above are hereby incorporated into and made a part of this
ordinance
Section 2 That the Subject Property aforesaid is hereby granted a special use to permit
construction of a single -bay drive -in banking facility, subject to the following conditions-
1 Approval of the proposed variation to permit a drive -in banking facilty to be located within
the front yard setback along Jorie Boulevard
2 The project is to be developed in substantial conformance with the Elevation and Site
Plans as submitted, dated September 26, 2005, on pages O and P of the case file
3 That additional landscaping is to be located between the building and Jorie Boulevard to
enhance the aesthetics of the area as well as lessen the visual impact of locating the
drive -in facility in the front yard Staff is to review and approve the plan at the time of
permitting The proposed fencing is to not exceed the height of forty -two inches (42 ")

4. Approval of the special use will be based on the current business model of the
PrivateBank and will continue subject to the customer and traffic estimates being satisfied
as presented at the public hearing
Section 3 This special use and the scope of this ordinance are limited and restricted to the
property located at 1110 Jorie Boulevard, Oak Brook, Illinois, which property is legally described as
follows.
Lot 1 in Northern Builders resubdivision, being a subdivision of lot 1 in Oak Brook
Development Company's Jorie Boulevard resubdivision and also a portion of the land
conveyed in the Northern Illinois Gas Company warranty deed number 991698 being in
section 26, Township 39 North, Range 11 East of the third principal meridian, according
to the plat of said Northern Builders re- subdivision recorded October 24, 1985 as
document R -85- 92579, in DuPage County, Illinois
Section 4 This ordinance shall be in full force and effect from and after its passage, approval
and publication as required by law
Section 5 All ordinances or parts thereof in conflict with the provisions of this ordinance be and
the same are hereby repealed to the extent of such conflict
