RECOMMENDED MOTION: I move for passage of Ordinance G -956, an ordinance amending the
Oak Brook Code to prohibit parking on Village property as posted.
Background/History: The Village Code of the Village of Oak Brook ( "Village Code ") does not
currently prohibit parking in Village Parking Lots by individuals who are not carrying on bona fide
business within Adjacent Property; and therefore, Village Police Officers cannot ticket individuals who
park their vehicles in Village Parking Lots where the Village desires to restrict such parking. The
proposed amendment to Section 7 -1 -1318, entitled "Parking on Municipally Owned or Leased Property"
will provide the authority to enforce specific restrictions or regulations set forth on a sign installed by the
Village on that property.
Additionally, the Village has received complaints from patrons of the Village library who have been
unable to find parking in the library parking lot due to a large number of people utilizing that lot for the
purpose of attending athletic events on nearby athletic fields. Signs prohibiting Athletic Event Parking
have been erected by the Village at the entrance to the Village library. These signs have not deterred the
use of that lot for the purpose of attending athletic events. The current ordinance does not provide Village
Police Officers with the authority to enforce the restriction as posted. The proposed amendment to Section
7 -1 -1319, entitled "No Athletic Event Parking" will expand the current ordinance to include municipally
owned or leased property.
Recommendation:
I recommend the Village Board pass the Ordinance G -956.

ORDINANCE 2011- TC -RR -G -956
AN ORDINANCE AMENDING THE OAK BROOK VILLAGE CODE
TO PROHIBIT PARKING ON VILLAGE PROPERTY WHERE RESTRICTED
WHEREAS, pursuant to Section 11 -42 -12 of the Illinois Municipal Code, 65 ILCS 5/11- 42 -12, the
Village has the authority to regulate parking within the Village; and
WHEREAS, the Village provides parking in parking lots adjacent to Village owned or leased
property and buildings ( "Village Parking Lots" and "Adjacent Property," respectively); and
WHEREAS, the Village Code of the Village of Oak Brook ( "Village Code ") does not currently
prohibit parking in Village Parking Lots by individuals who are not carrying on bona fide business within
Adjacent Property; and therefore, Village Police Officers cannot ticket individuals who park their vehicles
in Village Parking Lots where the Village desires to restrict such parking;
WHEREAS, in particular, the Village has received complaints from patrons of the Village library
who have been unable to find parking in the library parking lot due to a large number of people who park
in the library parking lot to attend athletic events on nearby athletic fields;
WHEREAS, the Village Board has determined that it would be in the best interests of the Village
and its residents to amend the Village Code to allow for the prohibition of parking in Village Parking Lots
by individuals who are not conducting bona fide business in Adjacent Property;
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Amendment to Section 7 -1 -1318. Section 7 -1 -1318, entitled 'Parking On
Municipally Owned or Leased Property" of Chapter 7, entitled 'Traffic Code ", of the Village Code shall be
amended further, and shall read as follows:
No person shall stop, stand, or park a vehicle upon municipally owned or leased property
in violation of any specific restrictions or regulations set forth on a sign installed by the
Village on that property."
Section 3: Amendment to Section 7 -1 -1319. Section 7 -1 -1319, entitled "No Athletic Event
Parking" of Chapter 7, entitled 'Traffic Code ", of the Village Code shall be amended further, and shall
read as follows:
"It shall be unlawful to park any vehicle along any street or on any other municipally
owned or leased property within the corporate limits of the village of Oak Brook for the
purpose of attending any athletic event where signs prohibiting same are so posted."
Section 4: Severability. If any provision of this Ordinance or part thereof is held invalid by a
court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and
effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose
and intent of this Ordinance to the greatest extent permitted by applicable law.

Section 5: Effective Date. This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
