The Meeting of the Zoning Board of Appeals was called to order by Chairman
Champ Davis in the Samuel E. Dean Board Room of the Butler Government
Center at 7:01 p.m.

Chairman Davis announced the public hearing and reviewed the request. All
witnesses providing testimony were sworn in. Chairman Davis noted for the
record that Member Cappetta was present at the hearing but recused herself and
would not vote on these matters.
Chairman Davis noted that the Plan Commission imposed a condition that
Special Use be contingent upon the approval of the variations.
Walter Morrissey. Lillig and Thorsness, Ltd., attorney for the petitioner, Christ
Church of Oak Brook, introduced the representatives of Christ Church, David
Melvin, Executive Director, John Blacketor, Trustee, Facility Improvement

Committee, Rich Mueller, Pepper Construction, General Contractor and
Andrew Uttan, V3 Companies, Civil Engineer and Stormwater Engineer and
John Ryan, Certified Landscape Architect, Ives/Ryan Landscape Group.
Mr. Morrissey reviewed the location of the property, including all parcels
owned by the church. The southernmost lot at 3306 York Road has been
excluded from the special use request and will remain as open space.
Mr. Morrissey provided a visual on the screen to show the variation proposed
on an overlay of the site plan of the property. They are seeking the following
variations:
• Side yard setback on York Road to be reduced from 50 feet to 40 feet to
accommodate the easternmost section of parking lots 1, 2 and 3 (section
13- 613- 317-2a)
• Side yard setback on York Road to be reduced from 30 feet to 10 feet
for parking and an accessory garage structure (section 13- 6B- 3F -2c)
• Variation to reduce width of drive aisles from 27 feet to 24 feet in the
parking areas (section 13- 12 -3C)
• Locate a right - in/right -out access driveway on Oak Brook Road
approximately 290 feet west of Coolidge Street replacing the current
full access opposite Coolidge (section 13- 12 -3E), spaces approximately
340' from the full access opposite Lincoln Road and will be 49 feet
wide (Section 13- 12 -3E -4)
• Convert the full access driveway at the current right - in/right -out access
driveway on Oak Brook Road opposite Lincoln Road (section 13- 12 -3E,
spaced approximately 340 feet from the new right- in/right -out (Section
13- 12- 3E -4), and will remain 49 feet wide as currently existing (section
13- 12- 3E- lb(3)(B).
• An accessory use to construct and maintain a three -bay garage storage
facility in the northwest corner setback of the property for its
maintenance equipment (Section 13 -3 -6)
The police and fire department reviewed the proposed drive aisle width and
they have agreed that it does not present a problem for emergency equipment
ingress or egress access to the property. The purpose of the request is to
address the traffic flow.
They are seeking to move the full access driveway to the west in order to
accommodate a new worship center on the' northwest side of the church, the
detention will be relocated, which will move the access farther from the
intersection at York and Oak Brook Road, which the DuPage County
Department of Transportation prefers since it would provide further separation

from the signalized intersection. The existing full access at Coolidge will be
turned into a right - in/right -out driveway.
The current garage is located on the southeast side of the property. It will be
demolished and a garage will be built in the northwest corner of the property,
tucked in by the vegetation which backs up to the Forest Preserve District. The
garage will be approximately 25 feet long, 15 feet high and 50 feet wide.
An interior view of the worship spaces was shown. One of the features they will
be providing will allow access from the outside to the contemporary worship
center.
Mr. Morrissey noted that the standards for the variation were addressed and
were submitted in writing in the case file.
The special use amendments are as follows:
• To allow the addition of Contemporary Worship Space.
• Reconfiguration of the parking areas and drive aisles.
• Convert existing right - in/right -out access on Oak Brook Road located
opposite Lincoln Road to full access using manned traffic control on
every high use occasion (i.e., no traffic light)
• Locate new right - in/right -out access on Oak Brook Road approximately
290 feet west replacing the existing full access opposite Coolidge
• Install new berm inside the east side yard boundary adjacent to York
Road to shield Parking Lots 1, 2 and 3 accompanied by a landscaping
plan utilizing evergreen, deciduous and other plant species.
• Install a 4 foot (initially) high shrubbery line including some trees shall
be planted running east to west at the southern edge of the
southernmost parking lot 3 or the northern edge of 3306 York Road.
• Lighting measurement classification of backlight, uplight, and glare on
newly installed overhead parking lights is B3UOG1 on 43W fixtures
and B2UOG1 on 26W fixtures; with an average illumination of 0.57
foot candles; with a light color (temperature) of 3000 Kelvin; and ANSI
recommended color consistency.
• In Lot 2 and Lot 3 adjacent to York Road, the number of overhead
lighting fixtures will be limited to 7; shall not exceed 20 feet from
grade; and shall employ accessory shields as necessary to limit
visibility from neighboring residences.

• In Lot 2 and Lot 3 adjacent to York Road, vehicular access and use will
be limited to the daytime. It would be closed every evening at 6:00
p.m. and chained and will not be lighted except 12 nights per year as
designated and published each year on the Church website as long as a
church remains the record owner.
• The 3306 York Road property is excluded from the special use
amendment.
He reviewed the plan details in slides and noted the following:
• Accesses into and out of the site, including internal parking spaces and
traffic flow.
• Berms along York Road will have a 4 to 1 slope with plantings.
• Proposed tree line will be in the parking lot facing adjacent to the
northernmost part of the 3306 York parcel.
• Parking lot lighting including, backlight, uplight and glare from the
lights along with the style of light fixture featuring a recessed light. The
average illumination was reduced to an average of 0.57
• They agreed to limit the use of the parking lots to daytime only with the
exception of 12 nights per year; they are typical holidays and
occasionally used during soccer tournament and Sports Core activity.
Fred Cappetta said that he represented some objectors and appeared at the Plan
Commission. He represented several residents, some of which were more
concerned than others regarding the entire project. He met extensively with the
developer, the Pastor and their attorney, Mr. Morrissey. He noted that the berm
had been extended 10 feet in width and 2 feet higher. The landscaping now has
more evergreens at a higher level of the berm that will give line of site
interruption from the properties across York Road. The parking light standards
were reduced by 2 feet in height. The illumination of the parking lot was also
reduced up to 75 percent of what had been originally proposed, which is a
significant reduction of the overall glow from this project. In addition they have
taken the southernmost lot out of the project and have taken the other two lots
to be opened in the evening with the lights on only 12 nights per year and that
really changes the nature of the project for the people that live adjacent to it.
He pointed out that the church did a wonderful job meeting with them
repeatedly and made changes to plans they had worked on for a long time. He
thanked them for their efforts and their responsiveness to the requests he made
on behalf of the residents.
Chairman Davis questioned approximately how many meetings were held.
Mr. Cappetta responded that he met with the neighbors 3 -4 times, and there

were many phone calls. He also met with Mr. Morrissey a few times and with
him and the Pastor 3 -4 times. Altogether it was probably 18 -20 meetings.
There were incremental changes, what was presented to the Board at this
meeting is the conclusion.
Chairman Davis questioned how many meetings were held with the Plan
Commission.
Mr. Morrissey responded that they were before the Plan Commission twice.
The process was started in the last quarter of 2015. Letters were sent to the
neighbors to the north, south and east of them. David Melvin met with those
neighbors as well as numerous phone calls.
Chairman Davis questioned that the plans presented to the Zoning Board were
the result of changes from the Plan Commission and the neighbors.
Mrs. Morrissey responded that they were. The Plan Commission had asked that
they look at the landscaping and in particular the berm and to accommodate the
lighting issues. In terns of compromises, they withdrew the Master Plan and
proceeded with the Facility Improvement Plan. They removed the lot known as
3306 York Road from the special use and the,property will remain in its current
natural state. The lighting plan was substantially revised, including the BUG
rating for the lights and the light poles were reduced in height from 22 to 20
feet. The total number of lighting fixtures was reduced from 71 to 45. They
agreed there would be 7 poles in Lots 2 and 3, which are the parking lots along
York Road and they are illuminated only 12 nights per year. They met with Mr.
Cappetta and other neighbors not represented by him. They left all of the
driveways along York Road in their current state and will not be touched.
After all of the changes they think they have a better plan. They have a better
traffic flow on site.
Modifications to the Landscape Plan:
o 3306 York Road remains as is in natural state as open space (eliminate
prior proposed berm and any development of that lot).
o Evergreen trees exchanged /switched for deciduous trees on apex of
berms on the east side of Lots 2 and 3.
o Ensure adequate foliage on southernmost boundary of York Road Lots
(currently tree and brush line exists south of Lot 3).
o Berm on east boundary of parking lots 1, 2 and 3 adjacent to York Road
added about 10 feet in width and 2 feet in height to improve grade
differentials and sight lines.

Modifications to the Civil Engineering plan:
• Eastern most line /row of parking removed in lot 1, 2, and 3 to
accommodate widening of the landscape berms.
• Berm on east boundary line adjacent to lots 1, 2 and 3 widen by
approximately 10 feet and heightened by 2 feet.
• York Road lots 2 and 3 are limited to 12 evenings annually with
lighting. They are available for parking every day during the daytime,
• Chains will close the York Road lots 2 and 3 during evening except for
12 permitted evenings annually.
Member Young asked about the illumination and asked whether it was
consistent with the current Village standard.
Mr. Melvin responded that the lighting is .57 in the area that will be added. The
west lot has more lights. If those existing lights were factored in, it would be
more than .57. There was a significant decrease in the lights being added.
Mr. Kallien responded that it does meet the Village standard. He added that
what the applicant proposed is more restrictive than the Village requirement.
Member Young questioned if lighting would be included on the garage.
Mr. Melvin responded that at this point, only a box was drawn where the garage
would be. There might be an outdoor light and would be reviewed by the
village before being approved. There would be lights indoors. It would not be
used at night unless it was snowing and at that point the entire parking lot
would be lit.
Member Nimry noted that the existing garage cannot be seen for the trees. His
concern was that in the new location it would be seen.
Mr. Melvin responded that the garage would face east and considered facing it
west and it would then be shielded by pine trees.
Director of Community Development Kallien added that as part of the
recommendation it should be added as a condition where the garage would be.
Member Bulin noted that on the current site there are at times, yard goods,
mulch, salt, etc., is staged on the site. It does not appear there is a place at the
new location for the staging of those types of materials and asked if an
accommodation had been made. He also noted that a drainage ditch was also

located just west of where the garage would be along with yards goods being
washed into it.
Director of Community Development Kallien added that it was the County's
expectation that there would be minimal impact. If there is outside storage we
should be careful that another problem is not created.
Member Savino questioned as to the type of material the garage would be
constructed.
Mr. Melvin responded that it would probably be a typical frame residential
garage, similar to the one currently used. There is the golf cart, tools, etc. They
were not sure of the material that would be used, but would not expect it to look
out of place for the neighbors.
Chairman Davis questioned how many new parking spaces were proposed and
how many would be in Lot 3.
Mr. Morrissey responded that there would be 257 new spaces; 127 would be in
Lot 3.
Member Bulin said that in 2006 there was a conversation regarding a cross
walk at Lincoln.
Mr. Melvin said that he agreed and that they would look into it with the County.
Member Savino questioned where they were with the Forest Preserve District
recommendations, including not using a petroleum asphalt sealcoat products.
Mr. Morrissey responded that the Forest Preserve raised concerns regarding the
plantings that would migrate into the buffer zone. They have responded that
their landscape architect is using the approved species for this area that do not
migrate and spread. To avoid that problem, they have also used paver bricks
that are pervious and help the water to address its transition. They also
informed them that at the time the planting list is completed, it will be sent to
them to make sure that none of the plant species is used that would be deemed
to be unfriendly or not a good habitat for the area. They have already informed
the Forest Preserve District in writing that they would not use any of the tar
based sealcoat products. They will use an alternate product that is more eco
friendly.

Director of Community Development Kallien said that Linda Lojewski has had
a conversation with him regarding the full access at Lincoln. He would
recommend that signage be placed on Lincoln to keep traffic from meandering
onto their street. Lincoln is not designed for many cars. He noted that the
Village would work with Public Works and the Police Chief. As part of the
approval the Village should consider the installation of signage on the north
side of Oak Brook Road in the Lincoln Road right of way to help minimize the
through movement to the north. Condition should be that consideration of
signage north of Oak Brook Road to minimize the through movement from the
Church property onto Lincoln Road.
Chairman Davis noted that the Variation standards were fully addressed in
writing on page 23c -23.g of the case file.
Mr. Morrissey addressed the variation standards as follows:
La. The property in question cannot yield a reasonable return if permitted
to be used only under the conditions allowed by the regulations governing
the district in which it is located.
The proposal by Christ Church of Oak Brook to add a contemporary
worship center and associated amenities and reconfigure its parking
spaces is undertaken to satisfy generational changes and the aspirations
of its membership that have evolved since its founding in 1965. It
would be an appropriate use for this specific piece of property in the
Village with a specific mission and will allow it to modernize its
facilities to meet the needs of its current and future membership.
l.b. The plight of the owner is due to unique circumstances.
The property is in the R -2 District and the special use started in 1965. It
has been compatible in the community. The church improvements are of
a quality and consistent with the core values of the community and
believe the request meets that test as well.
1.c. The variation, if granted, will not alter the essential character of the
locality.
There have been impressive substantial residential developments along
Lincoln, Grant, Coolidge and along the east along York Road. Homes
built in the 1940's and 50's have been replaced with new homes that
continue to be built in the area. They think the character of the
neighborhood will only continue to improve and reflect the core values
of Oak Brook and the commitment of open space.

2.a. The particular physical surroundings, shape, or topographical
conditions of the specific property involved would bring a particular
hardship upon the owner as distinguished from a mere inconvenience if
the strict letter of the regulation were to be carried out.
The church has recognized that there have been changes in the law. The
Americans with Disability Act imposes certain obligations on all entities
open to the public. They intend to meet that obligation to be more
accessible to comply with the ADA Act. It is easier for the seniors to
have access especially during the winter months.
2.b The condition upon which the petition for variation is based would not
be applicable generally to the other property within the same zoning
classification.
It is a unique parcel that operates under a special use and remains that
the underlying zoning is R -2 and has been that way since the beginning.
They do not believe that it sets any type of precedent by another entity.
2.c The granting of the variation will not be detrimental to the public
welfare or injurious to other property or improvements in the
neighborhood in which the property is located.
Christ Church of Oak Brook does not believe the variations will be
detrimental to the public welfare. They are a vital member of the
community. They maintain community programs, social outreach
programs.
2.d. The proposed variation will not impair an adequate supply of light
and air to adjacent property, or substantially increase the danger of fire,
or otherwise endanger the public safety or substantially diminish or impair
property values within the neighborhood.
The proposed contemporary worship center and accessories will
conform to the Building Code in all aspects including height and floor
area ratio.
2.e. That the purpose of the variation is not based exclusively upon a
desire to make more money out of the property.
Christ Church of Oak Brook is a not - for - profit corporation organized
exclusively for religious, charitable, educational and social outreach
purposes.
2.f. That the alleged difficulty or hardship has not been created by any
person presently having an interest in the property.
Christ Church of Oak Brook as a not - for - profit entity under the

guidance of its Board of Trustees is organized for the benefit of its
entire congregation. Christ Church also is an active supporter of the
community with its welcome and open door philosophy to community
members and making available its parking and other facilities and
partnering on community events. They are taking great care and
sensitivity to the plantings that will be added.
Mr. Morrissey reviewed the special use standards that were fully addressed in
writing on page 23 -b and c of the case file.
SPECIAL USE
Is of the type described in subsection Al of this section, is deemed
necessary for the public convenience at that location;
Accessibility, traffic flow, direction control will be improved by
relocating the driveways on 31St. Traffic has been moved farther from
the intersection at York and Oak Brook Road. From a safety standpoint
it is better for crowd management. If DuPage County agrees they will
provide a crosswalk at Lincoln Road.
13- 14 -9 -E2 Is so designed, located and proposed to be operated that the
public health, safety and welfare will be protected; and
There will be elevators added, fire suppression added, traffic flow will
be improved due to the redesign of the parking as well. Christ Church of
Oak Brook has demonstrated a longstanding commitment to the public
health, safety and welfare of its members and the community.
13- 14 -9 -E3 Would not cause substantial injury to the value of other
property in the neighborhood in which it is located.
There has been continual new development in the area along Oak Brook
Road and York Road. It is becoming one of the more desirable
neighborhoods in Oak Brook.
The Church presented the proposal to adapt to generational, societal and
community changes. The Village has grown and prospered and during that
time has maintained its core values and high standards as the Church needs to
do. It has taken special care to be good neighbors. It continues to offer social
outreach programs. They believe the facilities are essential to the community,
not just for worship but also for the special community events. The public
school uses the church facility for some of its events and is made available on
July 3rd for the community gathering for fireworks and celebration. It has also
allowed the fire and police departments for training exercises. The traffic flows
will accommodate the flow of water from the golf course to Salt Creek. Their

main traffic activities are during off peak times on Saturday and Sunday. There
is no profit to be made by this and it has a long history in the community and
has been a partner in the community in maintaining the high quality standards
to match the core values of the community.
Director of Community Development Kallien offered the following language as
a condition regarding the accessory garage materials. "The proposed garage
located at the northwest corner of the church property will be in keeping with
the design and character of the primary church facility and be constructed to a
standard that meets all codes and ordinances of the Village."
Chairman Davis questioned the location of the garage.
Mr. Morrissey responded that their desire is to locate the garage on the
northwest corner of the property and consistent with the design and quality of
the main church structures. It will blend in with the quality in the neighborhood
and would be shielded. There is a lot of foliage from the trees and shrubbery.
It will be the least intrusive as possible. They were in agreement to locate it as
shown on the plans with adequate landscaping. Should an issue arise they
would then reapply for a variation for the garage.
The Zoning Board discussed yard products currently stored at the existing
garage site.
Mr. Melvin noted that the new access point will become their main entryway so
they will work on it.
Chairman Davis noted that there will be a condition added to address the
construction and landscaping of the proposed garage.
Director of Community Development Kallien said that a provision should be
included that the landscaping as proposed will be installed and maintained in
order to stay in compliance with the Code.
A general discussion regarding all other provisions of any approved special use
or variation previously approved for the Christ Church property shall continue
unless specifically changed by the approval of the proposed special use
amendment and variations.
Resident William Lindeman, 11 Pembroke Lane noted that a resident had
addressed the Village Board regarding the need to hire an attorney for
representation. The other issue was storrn water runoff and how it is handled,

running into Salt Creek. He also questioned the lighting standards and noted
the comparison of the lighting at Brook Forest School. He also questioned the
garage and how it will look. He questioned whether the County was involved
in the storm water runoff /control. He wanted to make sure that the Zoning
Board makes things as they should be.
Chairman Davis noted that Mr. Cappetta had done a substantial job of
representing his clients in negotiating many changes to the project.
Mr. Morrissey responded to Mr. Lindeman's comments that V3 prepared a
storm water management report and the Church was in compliance with the
Code. Pervious pavers would be used in parking lots 1, 2, and 3. The purpose
in using them is to be eco- friendly and noted that they are the same type of
pavers used by the Forest Preserve District, which will have a zero impact on
water flow. The northeast pond will be relocated so that there will not be an
excess flow off the property.
Director of Community Development Kallien noted that the Village of Oak
Brook is a full waiver community and will not deviate from the County Flood
Plain Ordinance. It is the intention of the applicant and staff that the plans as
proposed will fully meet the County and Village's ordinance. There is every
guarantee that will happen.
Member Young said that the comment regarding Salt Creek that it is monitored
by the State and the County and they enforce things that the village does not.
Director of Community Development Kallien added that the Brook Forest and
Butler schools follow the zoning code, but do not get permits from the Village;
it is covered by the regional superintendent's office. He did not believe they
were violating the lighting standards.
Member Savino questioned the applicant regarding the deficient landscape
along Oak Brook Road that the applicant stated they would look into.
Mr. Morrissey responded that the church had indicated they would not only
install but would also maintain the landscaping. He reviewed the landscaping
slides along Oak Brook Road and indicated that when the access drives have
been constructed the landscaping would be installed and maintained.
Chairman Davis said that the applicant had addressed the standards for the
variations and the special use. He also noted that requests are condition upon
approval of the other.

SPECIAL USE MOTION:
Motion by Member Young, seconded by Member Nimry that the applicant
satisfied the requirements for the requested special use amendment for the
Christ Church property at 501 Oak Brook Road, 3202, 3212 and 3222 York
Road.
1. Development is to be in substantial conformance with the plans as
revised and submitted.
2. The applicant is to install four -foot (4') high permanent landscaping to
screen the southerly exposure of the new parking lot in accordance to
Village Code requirements for parking lot screening.
3. All new landscaping proposed by the applicant shall be installed and
maintained in conformance with the Village Code and the proposed
special use for Christ Church.
4. Subject to the approval of DuPage County, construction of a cross -walls
across Oak Brook Road /31St Street, between the new full access
driveway at the northwest corner of the site and Lincoln Road.
5. With the approval of the Village Police and Public Works Departments.
Install appropriate signage on the north side of Oak Brook Road /31St
Street at Lincoln Road to minimize the through movement from the
Church property onto Lincoln Road.
6. The proposed garage located at the northwest corner of the church
property will be in keeping with the design and character of the primary
church facility and be constructed to a standard that meets all codes and
ordinances of the Village. It will be properly landscaped so as to be
unobtrusive from Oak Brook Road and screen any yard materials
storage.
7. Lighting shall be complied with as follows for the BUG rating
(Backlight, Uplight and Glare):
• BUG rating (26 W) — B2 UO G1 — 22 fixtures
• BUG rating (43 W) — B3 UO G1 — 23 fixtures
• 71 fixtures were reduced to 45 fixtures.
• Reduction to 0.57 from 2.02 by 1.45 points or 71.7%
8. The proposed special use for Christ Church is conditioned upon
obtaining final approval of the requested variations.
9. All other provisions of any approved special use or variation previously
approved for the Christ Church property shall continue unless

Building, Life Safety and other development related Codes and
Ordinances.
11. Any change to the location and design of accesses to both Oak Brook
Road and York Road shall require written approval from the DuPage
County Division of Transportation.

VARIA'T'IONS MOTION:
Motion by Member Nimry, seconded by Member Young that the applicant
satisfied the requirements for the requested variations to recommend approval
of the variation as requested, subject to substantial conformance to the plans
submitted.
1. Variation to Section 13- 6B -3F -2a to reduce the side yard along York
Road from 50 feet to 40 feet to accommodate the easternmost portions
of parking lots 1, 2 and 3 and the expanded landscape berm.
2. Variation to Section 13- 613-317-2c to reduce the interior side yard in the
northwest corner of the site from 30 feet to 10 feet in order to
accommodate parking and a new accessory storage garage.
3. Variation to Section 13 -12 -3C to reduce the width of drive aisles from
27 feet to 24 feet in the parking areas.
4. Variation to Section 13 -12 -3E to reduce the driveway spacing from 400
feet to approximately 340 feet and relocate a right -in, right -out access
driveway onto Oak Brook Road, approximately 290 feet west of
Coolidge Street.
5. Variation to Section 13 -12 -3E to reduce the driveway spacing from 400
feet to approximately 340 feet and convert the existing right -in, right -
out driveway on Oak Brook Road opposite of Lincoln Street to a full
access.
6. Variation to Section 13- 12- 3E- lb(3)(B) to increase the maximum width
of the full access driveway from 44 feet to 49 feet.
7. The proposed development shall be constructed in substantial
conformance with the plans as submitted.

8. All other provisions of any approved special use or variation previously
approved for the Christ Church property shall continue unless
specifically changed.
9. Approval of the requested special use amendment.
10. Add the condition "Notwithstanding the attached exhibits, the applicant
shall meet all Village Ordinance requirements at the time of building
permit application except as specifically varied or waived
