Carmignani, Village Manager FROM: John H. Brechin, Village Attorney SUBJECT: Village Board Meeting, October 23, 1979 In addition to the copies of letters which you have received, you should note the following action the Village Board took at this meeting in regard to other items not covered by the letters. Under IV -D Authority to Landscape Well #7, the Village Board tabelled this matter, ostensibly until next Spring when the landscaping issue can be taken up again. It appeared the con - census of the Board that they did not wish at the present time to undertake this project without the benefit of other competitive quotes. Oak Brook Landscaping has been informed that this matter has been deferred for the present. Under the Quarterly Report of the Fire Department and Ambulance, much discussion ensued over the false alarm problem that plagues the Village. The Board noted its desire to levy stiffer fines for false alarms including the possibility of fining the phone company for any negligence it may be responsible for in causing such false alarms. Both Chiefs and myself noted for the Board that the entire matter of the false alarm problem is presently under discussion and as soon as possible a report and recommendation will be made to the Board dealing with this issue. Under VI -B - Bid Recommendation for the Snow Plow and Spreader, the Village Board tabelled the matter until its next regular meeting to evaluate the bids for compliance with specifi- cation. As you recall, Floyd recommended that the bid of Rendels be accepted, even though that bid was approximately $2000.00 higher �r a October 24, 1979 Page two K. Carmignani Re: Village Bd. Meeting 10/23/79 than the low bidder, Hillsman Equipment Company. Since on the face of the bids it appeared that both bidders met specifications but the Rendels proposal was more compatible with our intended equipment, Floyd recommended the Rendels' bid be accepted. How- ever, due to the apparent compliance of the specifications of both bids, and in light of our Ordinance G -246 defining lowest responsible bidder, I noted to Floyd that I saw no way that the bid could be let to the bidder who is not the lowest bidder un- less the low bidder was shown to be "not responsible ". Hopefully within the next three weeks the details of each of the companies bids can be examined for compliance with specifications to see if any further differentiation can be made between the bids so that a decision can be made by the Board. Floyd noted that this delay is not critical. Under VII -A, an appointment was made to the Zoning Board of Appeals for the unexpired term of John Lavery ending November 17, 1980 of Walter Imrie, presently the Chairman of the Board of Fire and Police Commissioners. Appropriate docu- mentation necessary to formalize the appointment has been pro- cessed. Moreover, all of the items set for referral were in fact referred as noted on the agenda.
