SUBJECT: Award of Contract — Construction Management Services for the Police
Detention and Addition Project

BUDGET SOURCE/BUDGET IMPACT: The Proposed 2018 Budget includes
$2,300,000 in 421-90400 (Municipal Building—Structural Improvements)
RECOMMENDED MOTION: I move that the Village Board approve Resolution
2017-PD-RNVTN-PRJT-AG-R-1679 and award a Construction Management Agreement
to Shales McNutt Construction, Elgin, Illinois, for the Police Department Detention Zone
Renovation and Addition Project in the estimated amount of$2,475.164.
Background/History:
After a five year planning process, the Village Board gave authority to go out for bid for
the police detention project. These bids cover the rebuild of the lock up, booking, main
hallway, relocation of firing range exhaust equipment, construction of a new usable sally
port, and enclosed roof over the walkway that continuously leaks into the building. The
project also improves the electronic surveillance of the lockup area and brings us into
compliance with all applicable requirements by the Department of Corrections. The
project cost also includes all construction management and contingency fees. It is hoped
that some minor interior work can begin this winter, with the major excavation and
construction to start as soon as the weather breaks in the Spring. It should be completed
six to eight months after breaking ground.
The Village, along with our Consultant, Shales McNutt Construction, sent out Requests
for bids to over 200 vendors for the following services for the Police Department
Detention Zone Renovation and Addition Project:

Bid Openings were held on October 10 and November 7, 2017 and fifty-three sealed bids
were received (see attached bid tabulations). Shales McNutt checked references for the
low bidders and the Village is satisfied (see attached letter from Shales McNutt). Staff is
requesting the approval of a construction management agreement with Shales McNutt
Construction for this project. The vendors will serve as subcontractors under the
agreement.
Recommendation
That the Village Board awards a Construction Management Agreement to Shales McNutt
Construction, Elgin, Illinois, for the Police Department Detention Zone Renovation and
Addition Project in the estimated amount of$2,475.164, and approve Resolution 2017-
PD-RNVTN-PRJT-AG-R-1679.

In soliciting these bids, Shales McNutt Construction notified over 200 local contractors regarding this
project and the project was publicly advertised in the Daily Herald Newspaper. 95 contractors
responded to the advertisement for bids and 53 contractors responded with sealed bid proposals. In
addition, Shales McNutt contacted 5 surveying firms with a request for professional services with two
responding positively to the request.
Over the past several days, we have had an opportunity to meet face to face with the apparent low
bidders to discuss their respective scope of work and adherence to the contract documents. We have
contacted banking and bonding references to determine the financial soundness of each of these firms,
as well as contacting references to confirm the ability of each to complete the work. Based on the
information received during the discussion and review, we have attached a recommendation of award
for the packages represented above.
In our recommendation, you will note that we have included an allowance for removal of an
underground electrical ductbank containing what is believed to be a non-friable asbestos containing
material. We have discussed potential removal requirements with an environmental abatement
professional to determine an order of magnitude of the cost. Actual costs for this work will be
determined at the time that the asbestos is encountered and removal is required.
It is our intent to provide a Letter of Intent to the contractors listed following award of this project by
the Village Board.

1 This allowance of$5,225 will be carried in the excavation contract to furnish and install structural mat per the Civil SWPPP drawings if project conditions
require the work.
2 The Village of Oak Brook has brought to our attention that existing underground electrical ductruns may contain Asbestos. Some or all of this
material may need to be removed as part of this project. We have included an estimated amount of$15,000 for removal of this work. Actual
costs will be determined if and when this material is encountered for removal.
3 Allowance and Contingency funds will only be allocated and spent following approval of the Village of Oak Brook.
4 Whereas all of the trade contractors have provided payment and performance bonds,SMC has not included a bond in our costs.
