SUBJECT: Sexual Harassment Policy Amendment

RECOMMENDED MOTION: A Motion to Approve Ordinance 2017-PL-HARAS-G-
1121,An Ordinance Amending Section 7.02 of the Personnel Manual Of The Village of
Oak Brook To Expand On The Definition and Actions To Be Taken In Relationship To
Sexual Harassment.
Background/History:
Public Act 100-0554 amends the State Officials and Employees Ethics Act, including Section
70-5, which pertains to government entities. The Act mandates all governmental units adopt, an
ordinance or resolution establishing a policy prohibiting sexual harassment by January 15, 2018.
Presently, our Personnel Manual that was approved by the Village Board on January 14, 2015
has our policy stated under section 7.02 Anti-Harassment and Retaliation Policy which covers
sexual harassment.
The Illinois Municipal League (IML) has developed a Policy Prohibiting Sexual Harassment that
complies with the mandates of the Act, along with a model ordinance adopting the Policy
Prohibiting Sexual Harassment. Their policy defines what sexual harassment entails, sets out
procedures for reporting of sexual harassment, prohibits retaliation for reporting sexual
harassment, sets out consequences of a violation of the prohibition on sexual harassment, and
consequences for making a false report.
Recommendation:
The Village Board approves the ordinance as presented.
