RECOMMENDED MOTION: I move that the Village Board approve Ordinance 2017
TELECOM-TWR-S-1517 to approve an Amendment to the Ground Lease Agreement with
SprintCom, Inc. for cellular communication equipment installed at 1200 Oak Brook Road.
Background/History:
On September 12, 2006 the Village Board approved Ordinance 2006-TELECOM-TWR-EX1-
R950 with Nextel West Corporation (Nextel) to construct an 80-foot monopole communication
tower at 1200 Oak Brook Rd and to lease ground space to support their cellular communication
equipment. A short time after the tower was constructed, Nextel was purchased by SprintCom
(Sprint)and Sprint has continued to operate their cellular equipment from this site since that time.
On October 24,2017,the Village Board approved Ordinance 2017-TELECOM-TWR-S-1516 with
Verizon Wireless to construct a new 120-foot monopole communication tower at 1200 Oak Brook
Rd on the grounds of the Butler Government Center to replace an existing 95-foot monopole tower.
In an effort to avoid having two (2) monopole towers at 1200 Oak Brook Rd, Village staff has
negotiated with Sprint to move their equipment from the current tower to the new monopole tower
being constructed by Verizon. Sprint has determined the relocation costs of their equipment will
be approximately$40,000. The proposed lease amendment will allow Sprint to abate their current
monthly rent until the abatement is equal to the lesser of$40,000, or the actual expenses directly
attributable to relocating the equipment described within the agreement. After the abatement
period,rental payments shall again become due at the figures set forth in the Option and Structural
Lease Agreement. The agreement also requires Sprint to deliver to the Village written evidence of
the relocation costs so the Village can confirm the value and schedule of the abatement.

The proposed lease amendment with Sprint is the last of(4) four ordinances that are required to
commence construction of the new monopole project. The Village Board has previously approved
agreements with Verizon, T-Mobile and AT&T.
Recommendation
I move that the Village Board approve Ordinance 2017 TELECOM-TWR-S-1517 to approve an
Amendment to the Ground Lease Agreement with SprintCom, Inc. for cellular communication
equipment installed at 1200 Oak Brook Road.
