THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK APPROVED AS WRITTEN ON
MARCH 25, 2008.
1. CALL TO ORDER
The Special Meeting of the Village Board of Trustees was called to order by Manager
Niemeyer in the Samuel E. Dean Board Room of the Butler Government Center at 7:00
p.m.
2. ROLL CALL
Village Clerk Charlotte Pruss called the roll with the following persons
PRESENT: Trustees James Carson, Jeffrey J. Kennedy, Kathryn F. Manofsky, Moin
Saiyed, Robert G. Sanford and Gerald Wolin.
ABSENT: President John W. Craig
IN ATTENDANCE: David Niemeyer, Village Manager; Blaine Wing, Assistant Village
Manager; Mark Sterk, Village Attorney; Dale L. Durfey, Jr., Village
Engineer and Darrell J. Langlois, Finance Director.
Motion by Trustee Wolin, seconded by Trustee Carson, to appoint Trustee Kennedy as
Acting Chairman in the absence of President Craig. VOICE VOTE: Motion carried.
3. PUBLIC HEARING
A Notice for this Public Hearing was legally published as required by State Statute.
The hearing is for the proposed Tuscan Woods Special Service Area (SSA). The purpose
of this SSA is to help fund the future maintenance and /or removal of a noise wall to be
placed near the Tuscan Woods subdivision and I -88. This SSA is being requested by the
Tuscan Woods developer who is sharing the cost of the sound wall with the Tollway.
The Village has already had an informal meeting with some of the residents about this
proposed SSA. As was discussed at this meeting, the Village can levy a property tax of
up to 20 cents per annum of assessed value if the Special Service Area is approved.
However, this SSA is considered a "dormant SSA ". That is, the Village does not intend
to levy this amount until future maintenance or removal of the wall is desired. The noise
wall is expected to last 20 to 30 years. In order to trigger this levy, the Village would
need to adopt a tax levy ordinance setting this rate.
At this hearing, all property owners have a right to be heard and submit written
objections. Opponents of the Special Service Area may veto it by filing a petition signed

by 51 of the electors and by 51 percent of the property owners of record on the area within
3. 60 days following the final adjournment of the hearing. If the Special Service Area is not
defeated by petition, the Village must then adopt the ordinance actually establishing the
Special Service Area.
The Village is also in the process of finalizing agreements with the Tollway and the
developer in regards to the sound wall. The Tollway will only enter into an agreement
with the Village and is making the Village responsible for designing, constructing and
maintaining the noise wall. The agreement with the developer will transfer all of the
Village's responsibilities in the agreement with the Tollway to the developer.
Acting Chairman Kennedy described the properties involved in the area. He indicated
that the Tollway authority required an agreement with the Village for future maintenance
of the wall if it is constructed. He indicated that this hearing was to obtain input from the
affected homeowners. He asked whether there were any residents who wished to address
the issue.
Mr. Anthony Cassacio, President of the Tuscan Woods Homeowner's Association and
also as President, Inland Real Estate Development Company, who is the developer of the
property. He clarified that the developer is building the wall, not the Homeowner's
Association.
Resident Mr. Thomas Moore asked for clarification of the financial arrangements.
Manager Niemeyer explained the process.
Acting Chairman Kennedy explained that during the next sixty days there is the ability of
residents to object to the project.
4. ADJOURNMENT
Motion by Trustee Wolin, seconded by Trustee Sanford, to adjourn the Special Meeting
of the Board of Trustees at 7:13 p.m. VOICE VOTE: Motion carried.
