MINUTES OF REGULAR MEETING •
February 10, 1981
I. CALL MEE NG TO ORDER
The regular meeting of the Board of Trustees was called to order at 7 :30 P.M. by
President Cerne in the Samuel E. Dean Board Room of the Village Commons.
A. Appointment - Recording Secretary
Due to the absence of Village Clerk Lakosil, President Cerne called for a
motion to appoint - LaVerne Skale as Recording Secretary for the purposes of
this meeting.
Trustee Congreve moved - seconded by Trustee Reynolds....
That LaVerne Ska•le be appointed Recording Secretary for this meeting.
Voice vote: All in favor. So ordered.

II. APPROVAL OF MINUTES
Trustee Philip moved - seconded by Trustee Rush....
That the minutes of the Regular Meeting of January 27, 1981 be approved
and waive reading of same.

III. ORDINANCES, RESOLUTIONS, VARIATIONS, PLATS, ETC.

A. Ordinance No. S -469: Ordinance granting Variations from the provisions of
Sections VII (D)(8)(b) and VII(D)(3) of the Zoning Ordinance of the Village
of °Oak Brook, Ordinance G -60, as amended, relative to Yard and Area Require-
ments in a R -2 Single- family Detached Residence District (3109 York Road)
Trustee Congreve moved - seconded by Trustee Philip....
That Ordinance S -469, as presented, be adopted and that reading of same be
waived.

B. Certification of Appreciation - Firefighter John Meyers
Trustee Watson read Certificate of Appreciation and presented plaque to
Firefighter John Henry Meyers in recognition of meritorious service
performed under extreme conditions and received the Village Board's con-
gratulations.
C. Ordinance G -278: Ordinance amending the Traffic Regulations of the Village
of Oak Brook, Ordinance G -177, as amended
Trustee Watson moved - seconded by Trustee Congreve....
That we amend Ordinance G -177, as amended, adding Section 1- 1301.1 Handicapped
Parking Areas and that reading of same be waived.

One federally secured certificate of deposit in the amount of $129,262.67
to mature at First Federal Savings and Loan on April 28, 1981 at a rate
of 17.25% (90 days).

V. OLD BUSINESS
A. Mark & Robert Fleishman - Assessment Plat
Trustee Congreve moved - seconded by Trustee Watson....
To approve the Assessment Plat dated January 30, 1981 conditioned upon the
roadway dedication being made to the Village of Oak Brook

B. Sports Core - Room Rental Rates - ORDINANCE G -279

To adopt this ordinance, as presented, amending Ordinance S -465 regarding
Room'Rental Rates, Sports Core and waive reading of same.

C. Acceptance of Easement for Bicycle & Pedestrian Path - Oak Brook Christian
Church
Trustee Congreve moved - seconded by Trustee Imrie....
That the Village Board accept this Grant of Easement and authorize signature
of the Plat by the President and that staff write the Oak Brook Christian
Center to thank them for their cooperation in this matter.

D. Firouz.Amirparviz - Side Yard Variation
'The Zoning Board of Appeals, at their meeting of February 3, 1981, recommended
denial of the requested variation since the petitioner established no
evidence of any particular hardship and that no unique circumstances were
proven.
Trustee Reynolds moved - seconded by Trustee Rush....
That the requested variation be denied by the Village Board for the same
reasons as the Zoning Board of Appeals' recommendation.

E. James Guido - Variation
Trustee Reynolds moved -
Trustee Reynolds stated that having heard the material presented at the
Zoning Board of Appeals meeting of February 3, 1981,,that the Village
Board deny the petition as requested.
Motion failed for lack of second.
Trustee-Watson -moved - seconded by Trustee Rush....
That we approve the variation of the property at 24 Devonshire Drive and
direct the Village Attorney to draft an ordinance.

Special Use
Flood Plain
The Plan Commission at its meeting of January 19, 1981 recommended to the
Village Board the granting of this Special Use in the Flood Plain conditioned
upon no mechanical or other pertinent devices needed for the maintenance and
operation of this building be located within the basement crawl space and
also that the requirement of compensatory storage be waived.
The Zoning Board of Appeals at their meeting of February 3, 1981 recommended
granting the proposed Flood Plain Special Use to allow the placement of the
Fuller house on the Forest Preserve District property, and conditioned the
recommendation upon the construction of the foundation in a manner satisfactory
to the Village Engineer and Building Inspector.
Trustee Reynolds moved - seconded by Trustee Rush....
That the Village Attorney be directed to prepare an ordinance granting a
Special Use in the Flood Plain as requested with the following conditions:
- that the museum be required to make connection to the sanitary sewer and
water lines
- that it never be used as a residence
- that compensatory storage be provided in a manner as agreed upon by the
Village Engineer and Building Commissioner
- that two building permits be authorized - (1) for the foundation and moving
of the house, and (2) for the renovation work which should include installa-
tion of a sanitary sewer and water lines.
- that a demolition bond be put up to guarantee removal of the house, should
that become necessary
® that a time limit be placed on the second building permit requiring that
the building permit be acquired and work started within a maximum of
18 months of the move and that work be completed within 30 months after
the house is moved
- that no mechanical devices needed for the maintenance and operation of
of this building be located in the basement crawl space, excluding the sump
pump which might be necessary for drainage,
that the foundation be constructed in manner satisfactory to the Village
Engineer and Building Commissioner
- that the foundation plan be signed and sealed by a registered Structural
Engineer

That the Village Attorney be directed to prepare an ordinance granting the sign
variation, -as, requested, consistent with the Zoning Board of Appeals recommen-
dation of February, 3, 1981.

Finalized Agreement was not received and matter will be placed on the next
Board of Trustees' agenda, February 17, 1981.
B. Heritage Oaks Subdivision - Reduction in Letter of Credit
Trustee Congreve moved - seconded by Trustee Philip...
To approve reduction in the Irrevocable Documentary Letter of Credit
#1980 -110 -5 dated August 21, 1980 by $64,974.15 leaving a balance in
Letter of Credit of $76,843.44.
