MEETING CALL: The Regular Meeting of the Board of Trustees was called to order by President Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:30 p.m. Pledge of Allegiance was given. 2. DeLISE President Bushy commended Sergeant DeLise for his actions taken as a police officer in a life - threatening situation. Police Chief Pisarek awarded Sergeant DeLise the first Medal of Valor for his personal courage in a life - threatening situation that occurred on November 14, 2000. Chief Pisarek acknowledged Officers Jacobs, Hall and Peterson who were also involved in this incident and previously received Department commendations. 4. ORDINANCES & RESOLUTIONS: 1) ORDINANCE #2001- ZO -SU -S -986, AN ORDINANCE ORD #0l -ZO- APPROVING FIFTH AMENDMENT TO ORDINANCE S -841 SU -S -986 EXTENDING THE EXPIRATION DATE OF THE SPECIAL EXP DATE USE PERMIT GRANTED THEREIN (1717 OAK BROOK SPEC USE ROAD, OAK BROOK, IL 60523) 1717 OB RD At the January 23, 2001 Village Board meeting there was concern that the nature and scope of activities currently contemplated for the special use property might exceed the provisions and limitations of Ordinance S -841. Although the uses do not seem to be inconsistent with the original grant, the special use property does not include the "retreat wing" area, as that structure was not part of the Mayslake Conservancy's original plans. Although staff believes the District still desires an extension of the existing special use, staff also understands the District will file an application for an amendment to the special use VILLAGE OF OAK BROOK Minutes Page 3 of 11 February 13, 2001 zc 7. B.1. to expand its area and revise its site plan. Probable site plan revisions include additional parking, which will raise issues related to stormwater management and impact on neighboring property. The special use amendment process will be more complicated than a simple change in the legal description. Village Attorney Martens explained that the Forest Preserve District's request before the Village Board is a request to extend their existing special use for one year. The second segment of their relief request is an amendment to the existing special use. He noted, in discussions with the District's Attorney, that the District will soon address in a filing before the Village this amendment and preceding the filing perhaps engage in meetings with their neighbors regarding this project. Trustee McInerney commented that he felt this should be the last extension offered the Forest Preserve District as they have previously had three extensions and requested they go forward with completion. Trustee Caleel stated he had toured the facility and noted considerable progress has been made. He suggested that due to a shortfall of funding the project had been delayed but that the project is worthwhile being completed. He requested that if office space is being developed that it not be for commercial use and asked that this be clarified when the District returns for their second request. Trustee Butler noted that consideration of additional parking must be discussed when they present their second request. Ms. Audrey Muschler, 55 Yorkshire Drive, addressed the Village Board in support of the request made by the Forest Preserve District of DuPage County. She indicated that the proposal would benefit the Village for both residents and businesses, as the site is listed on the National Registry of Historical Places. Trustee Savino inquired as to the feasibility of the building being completed in one year and their fundraising efforts to acquire approximately one -half of their anticipated budget to complete the proj ect. Mike Palazzetti, Program Services Division Manager for the Forest Preserve District of DuPage County, indicated that the building project is to be completed at the end of December 2001 or by early January 2002. He explained that funds have been secured for compliance of life safety issues and the Americans with Disabilities Act requirements. Motion by Trustee Savino, seconded by Trustee McInerney, to approve Ordinance #2001- ZO -SU -S -986, "An Ordinance Approving Fifth Amendment to Ordinance S -841 Extending the Expiration Date of the Special Use Permit Granted Therein (1717 Oak Brook Road, Oak Brook, IL 60523)," as presented and waive the full reading thereof. B. 2) ORDINANCE #2001- AL -RR -G -670, AN ORDINANCE AMENDING SECTION 4 -1 -25A OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATIVE TO FINES FOR VIOLATIONS OF THE LIQUOR CONTROL ORDINANCE House Bill 4043, (Public Act 91- 0854), increases the fines that may be imposed by a Local Liquor Commissioner from $1,000 per violation to $1,000 for a first violation within a twelve (12) month period, $1,500 for a second violation and $2,500 for a third or subsequent violation within a twelve (12) month period. The bill also increases the maximum annual amount of fines from $10,000 to $15,000. Motion by Trustee Savino, seconded by Trustee Caleel, to adopt Ordinance #2001- AL -RR -G -670, "An Ordinance Amending Section 4- 1 -25A of the Village Code of the Village of Oak Brook, Illinois Relative to Fines for Violations of the Liquor Control Ordinance," as presented and waive the full reading thereof. B.3. In order for the new Village Code to be current, staff recommends that Section 1 -4 -1 regarding Compensation of elected Village officials be amended by deleting transition language which is no longer applicable. This inapplicable language pertained to the compensation for any Village President whose term commenced prior to April 1, 1999, any Village Trustee whose term commenced prior to April 1, 1995, and any Village Clerk whose term commenced prior to April 1, 1999. The current terms of the incumbent Village President, Clerk and Trustees commenced after these dates. The Village President has also noted that she is sometimes incorrectly referred to in the Village Code as the "President of the Board of Trustees ". This incorrect term has apparently been in the Village Code since the first code was enacted in 1960. This incorrect term is replaced with "Village President ", the correct term. Motion by Trustee Caleel, seconded by Trustee Savino, to approve Ordinance 2001- BD -BOT -G -671, "An Ordinance Amending Section 1- 4-1 of the Village Code of the Village of Oak Brook Relative to Compensation of Elected Village Officials and Replacing all References to `The President of the Board of Trustees' with `The Village President'," as presented and waive the full reading thereof. Motion carried. 4) ORDINANCE #2001- TA -RR -G -672, AN ORDINANCE AMENDING SECTION 4 -2 -3 -1134 ENTITLED, "CAB COMPANY LICENSES" OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS The Village Clerk and the Police Department have reviewed the renewal process for taxi company licenses and cab registrations and have recommended that the registration decal be affixed to the rear bumper of the cab rather than in the rear window. Most of the vehicles now have tinted windows, which makes it difficult for police officers to determine if the cab has been properly registered with the Village. It is our belief that this change will enhance the ability of police officers to monitor compliance with Village Code. B. 5) ORDINANCE #2001- VCODE- REV -G -673, AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 1, ADMINISTRATION, AND TITLE 10, BUILDING REGULATIONS. OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, IL Staff has found provisions which were omitted, or inaccurately stated within the new Village Code. The ordinance addresses a variety of housekeeping measures as follows: a) Inclusion of the cooperative purchasing provision from our old code which was inadvertently omitted in adopting our new code; b) A fee of $300 is imposed for an application for a variation under the Stormwater ordinance; c) A provision has been inserted which requires applicants to reimburse the Village for outside consulting and inspection charges which pertain to engineering inspections; d) Pursuant to our instructions to bidders, our ordinance has been amended to provide that a bid security is forfeited after 15 days — not 10 days as currently stated; e) Reference to the "bureau of inspections" has been replaced with the current agency, the Community Development Department. REG PURCHASE AEUS 7. 7. C.1. The Village of Oak Brook 2001 Program Objectives #731 -1 and #621- 5 target equipping all Village buildings and Police Department squad cars with AED technology. Sufficient funding is available in the 2001 Fire Department and Police Department Budgets (accounts #731 -9010 and #621 -9010) for the purpose of purchasing this equipment. Since the Fire Department and Park District already own and operate this model of AED, it is recommended that, for purposes of standardization between departments, Survivalink AEDs be purchased. Motion by Trustee Caleel, seconded by Trustee Butler, to waive competitive bidding and authorize Village staff to issue a purchase order for the purchase of 20 AEDs (automated external defibrillators), 11 hard sided waterproof carrying cases, 9 wall mount rescue cases and 20 pair of defibrillation electrodes to Survivalink Corporation for an amount not to exceed $54,357. C. 2) AUTHORIZATION TO PURCHASE - REPLACEMENT POLICE VEHICLES Pursuant to the provisions of Section 1 -7 -10 of the Village Code and Compiled Statutes, the Village is permitted to join with other governmental units in order to benefit from cooperative purchasing arrangements. Motion by Trustee Caleel, seconded by Trustee Savino, that purchase orders be awarded to: Anderson Brothers Ford, 6539 Ogden Avenue, Berwyn, IL 60402 and Landmark Ford, Inc., 1800 South Dirksen Pkwy., Springfield, IL 62703, for the purchase of three 2001 Ford Crown Victoria police vehicles to Anderson Ford in the amount of $62,856 and one 2001 Ford Expedition to Landmark Ford in the amount of $27,283. Motion carried. 3) MICROFILMING SERVICES The Village has used the services of Vital Record Banc (other bidder) since 1991. As a comparison, the unit price bid by Micrecord for microfilm ($0.035 per image) is lower than it was in both of our previous contracts with Vital Record Banc ($0.043 for 1994 — 1997, VILLAGE OF OAK BROOK Minutes Page 8 of 11 February 13, 2001 PURCHASE POLICE VEH MICROFLM $0.047 for 1997 — 2000). Village departments that microfilm records include Administration, Engineering, Finance, Purchasing, Legal, Library and Police. Adequate funds are budgeted annually in each of these areas to cover anticipated microfilming. Motion by Trustee Caleel, seconded by Trustee McInerney, to accept the unit prices bid and award a three -year contract, subject to staff review to: Micrecord Sales & Service Corp., 155 Eisenhower Lane North, Lombard, Illinois 60148, for microfilming services for the years 2001 through 2003. VILLAGE PRESIDENT VLLG PRES President Bushy announced that in March she would be attending the National League of Cities Conference in Washington at which her primary focus will be attending discussions regarding sales tax (e -tax). President Bushy stated that there might be a potential trip to Washington made by Mayors in order to visit with the delegates to discuss specific issues. B. VILLAGE MANAGER VLLG MGR Village Manager Veitch and President Bushy will attend the Chicago Metropolis 2020 event on February 26, 2001 for discussion of the metropolis report, "Regional Realities: Measuring Progress Toward Shared Regional Goals." A follow up report will be given to the Village Board on the contents of this report. The Metropolitan Mayors Caucus has set aside a small working committee of Mayors, of which President Bushy is a member, to discuss ordinances and State Statutes that may impact municipalities. The caucus is organizing an Illinois Mayors day in Washington where they will visit the Illinois delegation to discuss issues especially e -tax. President Bushy announced that staff has been working with the State of Illinois regarding traffic congested areas along 22nd Street. The State of Illinois is aware of the problem near Costco on 22 n Street, at which there are three lanes eastbound lanes that quickly turn into two lanes then back to three lanes. UNFINISHED AND NEW BUSINESS (Final Action Not Anticipated): A. DISCUSSION - ADOPTION OF MAYORS AND MANAGERS AND ADOPT ILLINOIS MUNICIPAL LEAGUE LEGISLATIVE PROGRAMS LEGIS PRG The Village Board were provided with copies of the 2001 DuPage Mayors and Managers Conference Legislative Action Program and the 2001 Illinois Municipal League Legislative Agenda. The Village Manager requested consideration by the Village Board for adoption of these programs, in whole or in part, as positions of the Village of Oak Brook. Most municipalities are adopting these as Village policies. This suggestion arose from a discussion that took place last summer among the Mayors and Managers Conference Board of Directors and membership. The subject was how to address those instances when professional municipal employee associations, (e.g., police chiefs, fire chiefs, public works) to which our department heads belong, adopt positions on legislation that might be contrary to the positions taken by our municipal associations (e.g. DMMC and IML) to which their employers belong. One option raised by that discussion was to recommend action by corporate authorities to formally adopt the legislative positions of the municipal associations in order to assist managers and staff in determining appropriate responses to those situations when a professional association takes a contrary stance. Motion by Trustee McInerney, seconded by Trustee Savino, to direct the Village Attorney to draft an appropriate resolution for Village Board consideration at their February 27, 2001 meeting. VILLAGE OF OAK BROOK Minutes Page 10 of 11 February 13, 2001 Trustee Savino indicated that many of the positions that would be beneficial to the Village appear to have been on the Du Page Mayors and Managers Conference agenda for quite some time. He inquired as to how effective this organization was in legislative action for municipalities. Trustee Caleel concurred with Trustee Savino and asked what legislative successes the Conference have occurred in return for the Village's membership fee. Village Manager Veitch indicated he would provide this information for the Village Board. He noted one specific area is the sales tax information the Village now obtains was initiated by the Conference's legislative action. 11. OTHER BUSINESS PERTAINING TO VILLAGE OPERATIONS: None. 12.
