Dean Board Room of the Village Commons at 7:35 p.m. Pledge of Allegiance was given. The Clerk called the roll with the following persons PRESENT: President Bushy, Trustees Ci -deel, McInerney and Shumate. Trustee Kenny arrived at 7 :51 p.m. ABSENT: Trustees Bartecki and Savino. President Bushy announced she attended the National League of Cities Conference in Washington, D.C. as a representative of the DuPage Mayors and Managers Conference. Severa! major items of interest for municipalities were President Clinton's call for a six -year moratorium to bar states and local governments from collecting current or future sales taxes on the Internet. The Internet Tax Freedom Act has been introduced for this purpose. The small cities passed a resolution objecting to the Internet Tax Freedom Act. Lynn Montei. Executive Director of the DuPage Mayors and Managers Conference, and President Bushy also visited congressional legislators to urge Congress to re- authorize the Intermodel Surface Transportation Efficiency Act. This Act re- authorizes the federal government in partnering with state and local governments for the creation and preservation of a national transportation system. The rejuvenation of Interstate 55 may be funded as a special project, and it is in jeopardy without this Act being re- authorized. The ordinance amends the text of the Zoning Ordinance which pertains to Special Uses in residential districts. The amendments are set forth in detail in the case file and have been addressed by both the Plan Commission and Zoning Board of Appeals. The Zoning Board of Appeals included in their motion the possible advisability of retaining the "museums" special use with a ftu-ther limitation that this special use be restricted to buildings of historical significance. This alternative was prompted by the concerns raised by the Historical Society regarding the future need for a storage and display location. The Board concurred that the ' °museums" special use be omitted from the ordinance. The petitioner may apply for a text amendment to the Village. Trustee Caleel asked who would remove the fallen tree limbs from the storm, as some limbs are lying on utility lines in the public right -of -way. Public Works Director Meranda clarified Trustee Caleel's question regarding fallen tree limbs on utility lines. Trees below the utility, lines are addressed by the Village, and those above the utility lines will be addressed by Commonwealth Edison in public rights -of -way. Trustee Shumate clarified that the Forest Glen and Saddle Brook subdivision trees which were planted by the developer in the public right -of -way will be addressed as part of our Village Forestry Program. The Village Board's policy on Finance, Taxation, and Budget outlines the following procedures for budget administration and how these variances are to be addressed: 1. "i�'lhat the Budget Officer, with the approval of the Village Manager, may authorize transfers of budgeted funds between accounts or between account categories within a single budget program. 2. That any transfer of budgeted fluids from one budget program to another shall be subject to approval by the Board of Trustees upon the recommendation of the Village Manager. 3. That any transfer from contingency shall be subject to approval by the Board of Trustees upon the recommendation of the Village Manager. 4. That any increase in the total appropriation within any fund shall be subject to approval by the Board of Trustees upon the recommendation of the Village Manager. In order to make as few changes to the budget as possible, formal budgetary control has been established at the category level, i.e, personnel, materials and supplies, operation and contractual, and capital. After the budget transfers were made administratively as authorized in item # 1, some individual programs remained over budget. The schedule attached to the ordinance provides the necessary transfers between budget programs so that each category in every program is within budget. The following is a brief explanation of the causes of the more material budget transfers: Progra_m__ 1302 -H Oman saur [,g: This variance resulted from the costs associated with collective bargaining, primarily legal fees, exceeding the amount budgeted for this activity. Of course, this gives rise to a budget variance since back pay was not budgeted for in the 1997 Budget. Program_ 710.1 -Firg S r ices 1tiA tia m n : The variance in this program is primarily Niue to the separation pay necessitated by the retirement of two employees from this program in 1997. Program 7201- Uyertim This variance was caused by the delay in filling two firefighter/paramedic positions due to the unfair labor practice charge regarding contract personnel. This variance is offset in the EMS program since there are substantial unspent funds for contract paramedics in line item 017301- 530700 - Other Services. Program 9701 - Community Events: For budget purposes the line item for Ethnic Fest is shown net of revenue for the event. For accounting purposes the Village is required to show revenues separate from the expenses. revenue account number 010000 - 440215 has a balance of $10,269 from Ethnic Fest which somewhat offsets this variance. The remainder of the variance is due to the event not meeting its revenue targets. Progrant 8104-Tennis 0DeratiQns- Indoor: This transfer essentially establishes the 1997 Budget for this program. When preparing the 1997 Budget, staff only budgeted for debt see vice on the tennis dome under this program with the assumption that the facility would not operate in 1997. Since the Village has continued to operate the facility on a limited basis until it is sold, budget transfers are needed to offset these costs of continued operations. Operating revenues of $103,976 from indoor tennis offset approximately 83% of the expenses related to the limited operations. Program 01- Bariguets: Most of this variance is due to needing more part time hours to staff special events than was budgeted for and food costs slightly exceeding its target as a percentage of sales. In 1997, five funds exceeded the budget in total. It should be noted that each fund only has one program. Should variances in the program arise, the only way to pay for them is to amend the fund's total appropriation as opposed to transferring funds fiom program to program as has been done in the General Fund and Sports Core Fund. As the ordinance indicates most of these amendments are not VILLAGE OF OAK BROOK Minutes 6 of 13 March 10, 1998 significant, except for the Firefighters' Pension Fund. This was caused due to the retirement of three Fire Department employees in 1997 when for budget purposes the Village only assumed one employee will retire. In addition there were some unanticipated medical and legal fees associated with a lengthy disability pension request. ' 13 Bid packages were picked up by seven (7) companies. Prospective bidders were required to be Illinois Department of Transportation prequalified for this work. Seven (7) competitive bids were received on February 25, 1998. The low bid is approximately 12.6% or $103,053 below the engineer's estimate of $819,455. Areas included in this project are Green Leaf Drive, Kingston Drive, Spring Road (31 st to York), Timber View Drive, Walnut Lane, York Road (Tollway bridges to North Village limits) and Polo Road. Work is scheduled for approximately 65 days following issuance of the Notice to Proceed. Funds in the amount of $1,855,000 have been budgeted for 1998 in the Roadway Improvements Program (41 -461) of the Infrastructure Fund for multiple projects (this Infirastructure Fund project, the MFT project - previously accepted at $706,964, and construction by the consulting engineer). Final payouts on all of these items will take place next year and be reflected in the 1999 Budget. Davey Tree was the Village's low bid contractor in both 1995 for a one -year contract and in 1996 for a two -year contract. Davey's unit prices for 1996 and 1 997 were $12.25 and $14.75, respectively. Unit prices bid for tree pruning are as follows: $14.75 of trees (est.) Spring, 1998 850 Fall, 1998 500 Winter, 1999 1,000 Winter, 2000 100 $14.75 $34.00 $15.00 $20.00 $14.00 $22.00 $19.50 $70.00 Areas to be pruned over the course of this three- year,contract include Saddle Brook (Spring, 1998), Forest Glen (Fall, 1998), York Woods, Trinity Lakes, Old Oak Brook and Robin blood Ranch (Winter. 1999), and Ginger Creek. Brook Forest and Woodside Estates (Winter, 2000). The contract allows the Village to either extend or shorten the amount of work, including elimination of any of the items. Trees to be pruned are located within the Village right -of -way and the work is to be directed by a Certified Arborist provided by the Contractor. The Village will pay the Contractor based on unit prices contained in the Bid. Funds in the amount of $51,500 have been budgeted in the Forestry Program (10 -335) to rover the scheduled tree pruning and other tree maintenance work. The contract also includes prices for miscellaneous tree maintenance work throughout the year, conducted on any Village -owned property. The Infrastructure Fund portion has opened bids and a contract will be awarded on March 10, 1998 and is two weeks away from construction. finance and Hole! Committee: Trustee McInerney - The Village completed the first closing for the Month of January on the new Pentamation system. Final fieldwork for the 1997 audit was completed in February. The Government Finance Officers Association awarded the Village a Certificate of Achievement for Excellence in Financial Reporting Award. This marks the 20th time that the Village has received this recognition. President Bushy acknowledged Finance Director Langlois and his staff for their excellent financial recordkeeping. The Village has started the conversion process to Smyth Systems for the various Sports Core applications. As a result of the arbitration ruling, retroactive pay checks were issued to Police Department personnel on February 18, 1998. The March meeting of the Hotel, Convention and Visitors Committee was rescheduled for Thursday, March 12, 1998 so that the Committee would have time to review the proposed contract between the Village and BVK/McDonald for the development and implementation of the 1998 marketing campaign. Trustee McInerney displayed a brochure of the various target markets for the hotels and shopping in three separate inserts for specific customers in overnight/weekend meetings. With the new marketing plan, hotel reservations have increased 18% year to date. President Bushy stated that according to the Illinois Compiled Statutes, the hotel tax is to be used for overnight stays and this is why the Committee is spending revenue for marketing overnight stays. She commended Trustee McInerney for his excellent service as the liaison to the Committee. Eim: Trustee Kenny - Monday. February 16, Oak Brook Fire and Rescue units responded to 1808 Swift Drive for a construction worker who fell approximately 20 feet through an open skylight to the ground below. Due to the seriousness of the injuries, the patient was transported by helicopter to Good Samaritan Hospital's Trauma Center. The Fire Prevention Bureau conducted one Office and Home Fire Safety presentation for 35 adults from the Chicago West Suburban Chapter of Property Casualty Underwriters. All Fire Department personnel participated in live fire training near 31 st and Meyers on a house which is scheduled for demolition. Fire Officers and Firefighters attended a special leadership and personal style seminar presented by a retired Fire Chief Isom Ft. Wayne, Indiana. VILLAGE OF OAK BROOK Minutes 9 of 13 March 10, 1998 7717 "rII, tr, DEPARTMENTAL REPORTS - LIAISON ASSIGNMENTS Fire Chief Jarvis was a co- presenter at a recent Illinois Fire Chief s Association "How to Prepare for Promotion" seminar in mid- February. President Bushy acknowledged a concerned citizen had spoken to her regarding the trained fire incident. She asked the Fire Department to consider posting "training in session" signs to inform the public so they are aware of the training exercise. ibr : Trustee Caleel - The Friends of the Oak Brook Public Library is sponsoring the Third Annual Used Book Sale on Friday, April 24 from Noon to 6 p.m. and Saturday, April 25 from 9 a.m. to 1 p.m. at the Oak Brook Bath ,-id Tennis Club. Donations of paperback and hardback books, CDs, and audio and video cassettes are needed. CD -ROMs available to borrow include interactive study aids for college tests, foreign languages, sports, art, garden design, trip planners. etc. The collection will be developed based on availability of funds. Police: Trustee Shumate - On Tuesday, February 24, 1998, the D.A.R.E. Graduation was held. This was the 10th anniversary for D.A.R.E. The Brook Forest 5th Grade students put on excellent skits. All students who participated in this program graduated and received a certificate of achievement and a D.A.R.E. medallion. On February 28, 1998, the Villages of Oak Brook, Hinsdale, Burr Ridge, Clarendon Hills and Willowbrook hosted a D.A.R.E. Lock -In for their 5th and 6th graders. 'there were 17 children from Oak Brook in attendance and a total of 302 children. The lock -in was held at Hinsdale Central High School from 9:30 p.m. -6:30 a.m. Some of the activities included relay races, volleyball, soccer, basketball, Jell -O eating contests and the children enjoyed snacks throughout the night. This is the first year Oak Brook participated in this event, and it was a great success. The Oak Brook Police Department wished to thank the Village Board for providing the resources and supporting the D.A.R.E. program for the last ten years. Trustee Shumate commended our Police Department personnel for their continued efforts in the D.A.R.E. program. Public Works: Trustee Savino - Village Manager Veitch thanked the Public Works Department for their outstanding efforts in plowing and cleaning the Village streets during the major snow storm. Village clerk: Clerk Gonnella - Two taxi cab companies have applied for a taxicab company license and sixty -five cab drivers have applied for taxicab driver's licenses. For the General Primary Election of March 17, 1998, fifty -four residents have voted absentee in the Village Clerk's office. In a joint effort the Illinois Municipal League, the Municipal Clerks of Illinois and the DuPage Mayors and Managers Conference submitted to the State of VILLAGE OF OAK BROOK Minutes 10 of 13 March 10, 1998 I Illinois Local Records Commission a revised HB2864. This bill would permit digitized electronic format of public records that are retained for 10 years or less. The Commission was receptive of the proposal. Joel Kagan, Circuit Court Clerk of DuPage County, was also given this proposed bill and he asked the inclusion of court records as a public records to be digitized. Village President: President Bushy - The Village of Oak Brook, Mayor Daley of Chicago and mayors representing six cowities have met to discuss 1,vgional concerns in the Chicagoland area. They have now formed the Metropolitan Mayors Caucus. One area of concern they are discussing is the Eisenhower Expressway (I -290) traffic congestion in Hillside. They are seeking federal funding in Washington, D.C. While at the Conference in Washington, D.C., they met with the Secretary of Transportation requesting funding for this project. 45 1 W9141.4 I M3 The Midwest Club Homeowners Association Architectural Review Committee called for berms in these locations as part of the site screening for the in- ground swimming pool. Testi.m©ny by the petitioner at the Plan Commission hearing indicated that the Homeowner Association accepted these improvements and returned the bond security. The Plan Commission, by a vote of 5 to 0, at their meeting on February 16, 1998, approved a motion recommending approval of the requested variances for berms located in the rear and side yards of the residence at 1501 Midwest Club. There was no public testimony either in support of or in opposition to the request at the Plan Commission meeting, and the Village followed normal practice of notifying the surrounding property owners and the Homeowner's Associations. Motion by Trustee Caleel, seconded by Trustee Shumate, to grant a variation to allow berms located in the side and rear yards of the 1501 Midwest Club residence as constructed. VILLAGE OF OAK BROOK Minutes 11 of 13 March 10, 1998 MALHOLTRA - VARIATION -- BERM LOCATION (1501 Midwest Club) The Plan Commission and Zoning Board of Appeals have concluded their review of the possibility of revising residential structure height requirements. Both bodies have recommended the consideration of the development of a Zoning Ordinance Text Amendment based on the following conditions: 1. Height increase is limited to properties in R -1 and R -2 Zoning Districts. 2. Minimum lot size of 1.5 acres. 3. Maximum height of forty feet (40) based on an increase of one foot of structure height for each 1.5 foot increase in interior side yard provided. Front, corner lot side, and rear yards will remain as specified in the underlying zoning district. 4. Only applies to roof pitches 5/12 and greater. Does not apply to flat roofs or roof pitches lower than 5/12. 5. In order to inform future property owners of the increased interior side yards required, a document shall be recorded with the Recorder of Deeds indicating the use of this zoning provision. Even though the Plan Commission and Zoning Board of Appeals discussions received considerable coverage in the press, the Village has received very little general public input on this question. Should the Village Board proceed with a Text Amendment, the notification to the Homeowner's Associations and further press coverage of an impending change to the Zoning Ordinance requirements may prompt public input on this matter. An alternative to proceeding with a Text Amendment at this time would be for staff to query directly the Homeowner's Associations for their thoughts and comments on this matter. President Bushy explained that Trustee Savino had asked that the residential structure height be reviewed. Since he was unable to attend this meeting, the Board may wish to table this recommendation to a later meeting with full attendance of the Village Board. Motion by Trustee Caleel, seconded by Trustee Shumate, to table the recommendation of residential structure height to the April Board meeting so that all members may be in attendance for discussion.
