MEETING CALL: MEETING CALL
The Regular Meeting of the Board of Trustees was called to order by President
Bushy in the Samuel E. Dean Board Room of the Village Commons at
7:30 p.m. Pledge of Allegiance was given.
ROLL, CALL: ROLL CALL
The Deputy Clerk called the roll with the following persons
PRESENT: President Bushy, Trustees Butler, Caleel, Craig, Kenny,
McInerney and Savino.
ABSENT: None.
IN ATTENDANCE: Bruce Kapff, Acting Village Manager and Robert L.
Kallien, Jr., Community Development Director.
ANNOUNCEMENTS AND OPEN FORUM: ANNOUNCE. &
OPEN FORUM
Trustee McInerney announced that the Vietnam Wall Experience will be
displayed at the Chapel Hills Garden West in Oakbrook Terrace. He indicated
that this is a 250' replica of the Vietnam Wall located in Washington, D.C.
The event will take place from June 9, 2000 at 8:00 a.m. through June 11, 2000
until dusk. He suggested that support would be appreciated from local
Veterans in attending the experience.
Trustee Caleel noted that a letter sent to DuPage Mayors and Managers
Conference President Ron Ghilardi (Village President, Lisle) expressed the
Board's feelings regarding Chicago Metropolis 2020. He requested that the
letter should also be sent directly to Chicago Metropolis 2020 as a matter of
record. The Board concurred with this suggestion.
President Bushy called attention to a few particular articles that are printed in
the "Nation's Cities Weekly" publication. She indicated that one article was in
regards to the E- Commerce Panel which met in Texas. The article highlights
some of the oppositions that governments and businesses have toward tax -free
internet sales. Also included was a follow -up article regarding Senator
McCain who has changed his bill in the Senate. Although he still feels that
there should be a total moratorium on sales tax on the internet, he is
recognizing that local governments need to be able to survive. These articles

provide some insight into the committee's responsibilities in addressing
Congress on behalf of local and state government.
4. APPROVAL OF MINUTES: MINUTES
BOT 03/14/00
Motion by Trustee McInerney, seconded by Trustee Caleel, to approve the
minutes of the Regular Meeting of March 14, 2000 as presented and waive the
full reading thereof. VOICE VOTE: Motion carried.
5. OMNIBUS AGENDA:
All items on the Omnibus Agenda are considered to be routine in nature and
will be enacted in one motion. There will be no separate discussion of these
items unless a Board member so requests, in which event, the item will be
removed from the Omnibus Agenda and considered as the first item after
approval of the Omnibus Agenda.
Motion by Trustee Caleel, seconded by Trustee McInerney , to approve the
Omnibus Agenda. ROLL CALL VOTE:

A. VILLAGE PRESIDENT:
President Bushy announced that she was in Springfield lust week, as she was
asked to sit on the Illinois Municipal League's Task Force regarding E-
Commerce. She provided packets of information regarding this issue that were
distributed to the Illinois Municipal League and the members of the task force.
Several Mayors have contacted her who wish to copy this informational
format. They are trying to organize a session with local banks and include
Senator Fitzgerald and Senator Durbin. She commented that local banks
understand the gravity of the situation if municipalities' are unable to fund
themselves.
President Bushy recently spoke at a local group of Women in Planning &
Development regarding E- commerce. Many of the attendees had changed their
mind regarding sales tax -free internet sales after she had explained the
consequences.

A. RECOMMENDATION - O'DONNELL (344 FOREST TRAIL DRIVE) - VARIATION

The Zoning Board of Appeals, at its meeting on March 7, 2000, held the
required public hearing for the O'Donnell variation request. Mrs.
O'Donnell, 344 Forest Trail Drive, has requested a variation to reduce the
required side yard from 12 ft. to 8 ft. 10 inches to expand the existing
garage by less than 4 feet. The addition would align with the building line
of the existing home. The existing home was annexed into Oak Brook with
a non - conforming side yard setback.
The side yard of the property abuts a residential property at 330 Forest
Trail Drive to the north. Ms. O'Donnell has submitted a letter signed by
the owner of this adjacent residential property indicating they do not object
to this variance request. There was no public testimony in opposition to
this request.
For the record:
• The O'Donnell home was built in 1951 prior to Oak Brook's
incorporation, and is situated on the lot at an angle. The northwest
corner of the home is located 7 ft. 8 inches from the north property
line.
• When annexed to Oak Brook, it was done so with a non-
conforming side yard setback that was less than the 12 -ft. required
in the R -3 Zoning District.
• In 1989, the O'Donnell's added a garage but designed it so that it
conformed to the required 12 -ft. setback. However, the width of
the garage was reduced by over three feet and is inset from the rest
of the structure.
• The proposed addition will utilize the existing building line of the
structure and therefore, should have a minimal visual impact from
the adjacent property to the north and from the street.
The Zoning Board of Appeals by a vote of 6 to 0 at their March 7, 2000
meeting, recommended approval of Mrs. O'Donnell's, 344 Forest Trail
Drive, request for a variation to reduce the required side yard from 12 feet
to approximately 8 ft. 10 inches to allow construction of an addition that
increases the size of the existing garage by less than four feet to better
accommodate two full -sized vehicles.
Motion by Trustee Savino, seconded by Trustee Butler to authorize the
Village Attorney to prepare the necessary ordinance for final action at the
Regular Village Board of Trustee's Meeting of April 11, 2000. VOICE
VOTE. Motion carried.
President Bushy noted that the new addition would still be 100 feet behind
the front building line, and does not appear to be a visual problem from the

street. She indicated that it's difficult for many residents to improve and
update their properties and be in compliance with the zoning ordinance, as
many homes were built prior to the establishment of the ordinance.

Motion by Trustee Caleel, seconded by Trustee Craig, to adjourn the meeting
at 7:51 p.m.. VOICE VOTE. Motion carried.
