NOTICE IS HEREBY GIVEN that the Village President and Board of
Trustees have called a Reconvened Board of Trustees Meeting for Monday,
April 1, 1996 at 7:30 p.m. in the Samuel E. Dean Board Room of the Village Hall
located at 1200 Oak Brook. Road, Oak Brook. The Agenda for this meeting is as
follows:

A. An Ordinance Amending Section XII(B)(8)(c) of the
Zoning Ordinance of the Village of Oak Brook,
Ordinance No. G -60, As Amended (Borsom - [stork
Tavern - 3702 York Road] - Request to Extend
Discontinuance Date for Non- conforming Business Uses
in Residential Zoning Districts to July 8, 2006)

The Reconvened Meeting of the Board of Trustees was called to order by
President Bushy in the Samuel E. Dean Board Room of the Village Commons
at 7:30 p.m. Pledge of Allegiance was given.
The Clerk called the roll with the following persons
PRESENT: President Bushy, Trustees Bartecki, Kenny, McInerney, Payovich
and Savino.
Trustee Shumate arrived at 7:33 p.m.
ABSENT: None.
IN ATTENDANCE: Stephen B. Veitch, Village Manager; Michael A. Crotty,
Assistant to the Village Manager; and Tom Hawk, Director of Code
Enforcement
President Bushy stated the item on the Active Agenda has been
continued from the Regular Board meeting of March 26, 1996 in
which the Board directed the Village Attorney to prepare an ordinance
amending Section XII(B)(8)(c) of the Zoning Ordinance of the
Village of Oak Brook, as amended. The applicant, Borsom - York
Tavern at 3702 York Road, requested extending the amortization of
non - conforming business and commercial uses in residential districts
from July 8, 1996 to July 8, 2006.
Village Attorney Martens gave a point of clarification that was
requested from the Board at their March 26, 1996 meeting. Trustee
Savino had raised the question whether performance standards set
forth in the Zoning Ordinance pertained to residential districts. In the
general provisions of the Ordinance, Residential, Business and ORA
Districts are covered by pe i formance standards.

AMENDED:
President Bushy stated the item on the Active Agenda has been
continued from the Regular Board meeting of March 26, 1996 in
which the Board directed the Village Attorney to prepare an ordinance
amending Section XII(B)(8)(c) of the Zoning Ordinance of the
Village of Oak Brook, as amended. The applicant, Borsom - York
Tavern at 3702 York Road, requested extending the amortization of
non - conforming business and commercial uses in residential districts
from July 8, 1996 to July 8, 2006.

Trustee McInerney commended Mr. Kamper, Village Gate Tavern,
and Joseph Rush for adjudicating the private nuisance of smoke.
Trustee Savino inquired if the performance standards apply to
cooking. Village Attorney Martens indicated the intention of
performance standards was to protect any situation that would
endanger the public health and safety. The private nuisance of the
odors, discussed at this point, would not qudify under that category.
Village Attorney Martens indicated that comfort is not looked upon as
favorably in the court system of today as compared to the safety and
public health of the residents.
Motion by Trustee Kenny, seconded by Trustee Payovich, to pass
Ordinance 96 -ZO- I'A. -G -568, "Ordinance Amending Section
XII(B)(8)(c) of the Zoning Ordinance of the Village of Oak Brook,
Ordinance No. G -60, as Amended ", as presented and waive the full
reading thereof. ROLL CALL VOTE:
Ayes: 6 - Trustees Bartecki, Kenny, McInerney, Payovich,
Savino and Shumate.
Nays: 0 - None.
Absent: 0 - None. Motion carried.
Motion by Trustee McInerney, seconded by Trustee Payovich, to adjourn the
meeting at 7:38 p.m. VOICE VOTE: Motion carried.
