The Regular Meeting of the Board of Trustees was called to order by President
Bushy in the Samuel E. Dean Board Room of the Village Commons at 7:34
p.m. Pledge of Allegiance was given.
The Clerk called the roll with the following persons

Motion by Trustee McInerney, seconded by Trustee Bartecki, to
concur with the recommendation of President Bushy and appoint
Deborah Karcanes, the new General Manager of the Renaissance Oak
Brook Hotel, as a member of the Oak Brook Hotel, Convention and
Visitors Committee effective April 12, 1996, to fill the unexpired term
of Ronald 3uneman, who recently resigned; term will expire February
28, 1997. VOICE VOTE: Motion carried.

Bid packages were sent to eight (8) firms. Competitive sealed bids
were received on March 27, 1996 from six (6) companies.
Staff has received adequate references as to the quality of work
provided by Green Horizon. However, as %v'th other contracts of this
type, specifications allow the Village to cancel the contract if the
quality of work fails to meet the Village's expectations.
Areas to be maintained include all Village properties, plus various
cul -de -sacs and median strips along street rights -of -way, some
sections of County right- of-way, and the banks of Salt Creek
(Roosevelt to 22nd Street). Funds in the amount of $79,850 have
been budgeted in various programs to cover this work.
President Bushy commended the Purchasing Department for the cost
savings to the Village of bid proposals presented for Board approval.
Motion by Trustee Bartecki, seconded by Trustee McInerney, to
award a two year contract with one year option, subject to staff
review, to the lowest responsible bidder, Green Horizon, Lombard, at
the annual lump sum prices indicated on the bid tabulation for the
various areas to be maintained (total of $59,000 for each year) and
that the unit costs for miscellaneous labor and equipment for other
work as needed be accepted, as indicated on the bid sheets. ROLL

President Bushy requested staff to review all Village -owned
properties for proper landscaping and cost for tree plantings to
improve any of these areas. Village Manager Veitch commented that
staff was aware of problem areas and planned for the new landscape
maintenance company to address these areas.

Prospective bidders were required to be Illinois Department of
Transportation prequalified for this work. Bid packages were picked
up by seven (7) companies. Three (3) competitive sealed bids were
received on March 27, 1996.
S.K.C. was the Village's contractor in 1995 with a unit price of $.903
and performed well. Although staff requested pricing on crack
routing and filling of concrete pavement at route 83 and 16th Street,
this work will not be performed at this time. Removing those two
items from the package leaves two bidders with the same price for the
fiber asphalt crack sealing material (S.K.C. and Midwest Tar Sealer).
Since S.K.C. was lowest overall, (even though the Village will only
be doing the crack sealing), staff recommends that they be awarded
the contract.
Areas which will be cracksealed include streets in the Saddlebrook,
Timber Trails and Yorkshire Woods subdivisions, and on Jorie
Boulevard. The contractor is responsible for providing any necessary
traff ^ control to direct motorists around the work zones. Disruption
is minimal with this process. All work is scheduled to be completed
by June 1, 1996.
Funds in the amount of $51,000 have been budgeted in the Roadway
Improvements Budget (program 4601) for this work.
Motion by Trustee Shumate, seconded by Trustee Bartecki, to award a
contract, subject to staff review, to S.K.C. Construction, Inc.,
DesPlaines, the lowest responsible bidder, based on the unit price of
$.88 per pound of fiber- asphalt crack sealing material, for an
estimated total project price of $47,140.72. ROLL CALL VOTE:

1996 CRACK
SEALING PROJECT

Bid packages were sent to fourteen (14) firms. Competitive sealed
bids were received on April 3, 1996 from seven (7) companies.
Contracts with these seven firms will operate as Requirements
Contracts, i.e., orders will only be placed when and if the Golf Course
has such needs. There is no requirement that the Village purchase a
set quantity (the Village retains the right to either increase or decrease
quantities at its sole option). The Village also has the option to
purchase these same items through other sources, e.g., in an
emergency when an item is needed sooner than it can be supplied by
the low bidder. Approximately $62,000 has been budgeted in various
accounts for the purchase of these items.

award Requirements Contracts to the following seven (7) companies,
subject to staff review, based on unit prices bid by the lowest
responsive bidders, as indicated on the bid tabulation:
Arthur Clesen, Wheeling, Illinois;
Bojo Turf Supply, Frankfort, Illinois;
Consery FS, Tinley Park, Illinois;
H & E Sod Nursery, Markham, Illinois;
Lesco, Rocky River, Ohio;

were received on April 3, 1996 from three (3) companies. The two
(2) firms that failed to bid were too busy. Davey Tree was the low bid
contractor in 1995, and their current bid is lower than in 1995.
The parkway tree pruning activities called for in this contract will be
accomplished this spring (30 days to complete the work) in die York
Woods, 'trinity bakes, Old Oak Brook, and Robin Hood Ranch areas.
In 1997 trees will be pruned in the Ginger Creek, Brook Forest,
Yorkshire Woods and Woodside Estate; areas. Trees to be pruned are

located within the Village right -of -way and the work is to be directed
by a Certified Arborist provided by the Contractor. The Village will
pay the Contractor based on unit prices contained in the bid. Funds in
the amount of $20,800 have been budgeted in the Forestry Program
(3305) to cover this work.
Emergency work ('March through October) consists of tree removal
and items other than parkway tree pruning. Off - season work
(November through February) includes any type of tree maintenance
work. Both emergency and off - season tree care activities will be
conducted on both the Sports Core and Village -owned properties
utilizing unit prices contained in the bid. Funds to cover these
additional activities have been budgeted within the Forestry Program
( #3305) - $27,500, the General Operations Bath & Tennis Club
Program ( #8101) - $1,500, and in the Golf Course Maintenance
Program ( #8304) - $1,000.
Motion by Trustee McInerney, seconded by Trustee. Bartecki, to
award a two year contract with a one year option, subject to staff
review, to The Davey Tree: Expert Company, Kent, Ohio, the lowest
responsible bidder, at the unit price for parkway tree pruning of
$12.25 per tree (1996 total estimated cost of $12.250) and $14.75 per
tree (1997 total estimated cost of $14,750), and that the unit costs for
miscellaneous labor and equipment for other work as needed be

As part of the Village's continuing effort to review and update the
Code of Ordinances, staff has developed a comprehensive: amendment
to Article I1 of Chapter 8 of the Code, which deals with taxi service.
A draft of the ordinance was circulated to the Board on March 8,
1996, and discussed at the March 12th Board meeting. The version of
the ordinance has been modified slightly from the dram based on
comments received. The changes are not substantive.

The most significant difference between the proposed article and t.l�e
existing one is in the area of licensing. Presently, Oak Brook licenses
only the individual taxicabs themselves. In so doing, the Village
assumes responsibility for passing on such matters as the mechanical
condition of the car, without the requisite expertise. The existing
ordinance does not address the credentials of cab company owners or
taxi drivers.
The new ordinance will require that cab companies and drivers be
licensed, according to the standards enumerated. A registration
procedure for the cars mill replace taxicab licenses, and will involve
an appropriate visual irispection and independent certification as to
mechanical condition. Operators will have the ability to insert and
withdraw cabs from their fleets at any time, subject to meeting the
registration requirements and the overall limitation as to the number
of cabs that may be registered.
Other features of the new ordinance include a more complete array of
general regulations, updated insurance requirements, a revised
licensing year, clearer procedures for determining the maximinn
number of cabs that will be allowed to operate (the existing number
has not been changed, however) and a p c: educe for investigating and
resolving complaints.
It is staff's belief that the proposed ordinance will put in place a more
appropriate and beneficial approach to regulating taxi service than is
currently the case.

Trustee Shumate discussed the Illinois Environmental Protection Agency's
findings that the underground tank at Fire Station #1 requires no further action.
The Village is #217 of the 1,615 for reimbursement of the underground storage
tank replacement project. Appropriation of funds by our legislators should be
soon for funding the state's reimbursement program for the remediation of the
leaking tank.
Finance/Purchasing and Information Services: Trustee Bartecki - The audit
report is available for review. Proposals by two films are being reviewed for
the Information Services project. The York Road path location will be
reviewed at the April 23, 1996 Village Board meeting.
Lihrwz ,,d Hotel,. Convention & Yisitors Committee: Trustee McInerney -
Mike Campa was chosen as the new Chairman of the Hotel, Convention and
Visitors Committee.
National Library Week will be celebrated at our Library with the first sessions
of the spring youth services programs. A new wall hanging is on display at the
Library. It was created by the children of Cicero, under the guidance of
Rosetta Lombardi, an Oak Brook resident and teacher in the Cicero Public
Schools.
National Poetry Month will be celebrated in April. The voting results for
National Women's History Month was: Eleanor Roosevelt, Mother Teresa,
Marie Curie, Rosa Parks and Margaret Thatcher.

hearing on June 4, 1996.
The related issue of the Traylor, et al, Text Amendment petition to delete the

This is considerably downsized from the original approved Planned
Development and has the support of the nearby property owners in Oak Brook
Colony which is in an unincorporated area of DuPage County.
Highland Lankmark is approximately one -half mile from the nearest Oak
Brook properties.
Public Works & Cable Tel 'Sinn: Trustee Savino - Village Manager Veitch
explained our annual curb inlet cleaning program will begin. This year, we
will be having a private contractor perform this service. If all goes well, the
Village will continue to contract this service out on a yearly, or multi -year
contract basis. The intent being to eliminate capital equipment outlay costs of
up to $150,000 for a new Vac -all cleaning machine, while maintaining the
same level of service in our curb inlet cleaning program. Objective No. 3304-
2.
Parkway restorations will begin due to water main breaks and other
excavations (inlet repairs /replacements) that were conducted late last fall and
over the winter months. However, with the labor savings staff will be realizing
from the inlet cleaning program, those man-hours will be utilized for
performing our own in -house restorations.
The Water Department will be beginning the annual valve exercising program.
This will consist of half our water system's distribution valves (approximately
550) being fully exercised to maintain operable valves and mitigate valve
breakage. This is an on -going maintenance program where half our valves are
exercised annually. Objective No. 3501 -4.
Village Oak: Clerk Gonnella - The Village Clerk lobbied in Springfield with
the Illinois Municipal League for the Unfunded Mandates. Addison and Itasca
clerks also attended and were able to speak with Lee Daniels and Pate Philip.
Since they were not in favor of SJRCA 76, Clerk Gonnella alerted all of the
DuPage County Municipal clerks of this situation and sent them the legislators
addresses, telephone numbers anc, sample letters to write them a response.
Village President: President Bushy - The flags are flown at half staff as a show
of respect for the loss of Secretary of Commerce Brown while serving his
country.

RECOMMENDATIONS
Since the Board has acted to amend the zoning Ordinance to revise $ORSOM/YORK
the discontinuance date for non - conforming business uses in TAVERN
residence districts (Section XII(B)(8)(c) of the zoning Ordinance)
from July 9, 1996 to July 8, 2006, it is appropriate to consider what

further action the Board wishes to direct based on the additional
recommendations of the Plan Commission and Zoning Board of
Appeals, if any.
Wen king Restrictions, The first additional
recommendation that wound require Village Board action concerns
establishment of a resident only parking zone on Wennes Court.
Based oil the hearing record, it is staff's understanding that
implementation of such parking restrictions is important to the
residents of Wennes Court and was key to their acceptance of the
amendment to the discontinuance date for York Tavern. If the Board
wishes to address this recommendation, the following motion would
be in order:
Motion to direct the Village Attorney to prepare an ordinance
that would establish a "resident parking only" zone on Wennes
Court between York Road and a point approximately 400 feet
west of York Road, for consideration at the next regular meeting
of the Board.
Gener View of Amnrti�atinn nr vi iain� The other item that
would require Village Board action is the recommendation that the
Village "review the appropriateness of the .Zoning Ordinance
amortization provisions ". As a policy matter, staff's advice to the
Board is to seriously consider repealing the Zoning Ordinance's
amortization provisions.
For reasons stated repeatedly over the years, staff does not believe
that these provisions. as applied to Oak Brook non - conforming uses
and structures, are enforceable. That is to say staff does not believe
that, as applied to the relatively few non - conforming situations
affected by the provisions, there is a sufficient public put-pose for their
elimination that would withstand legal challenge. Thus, staff
recommends that they be allowed to continue indefinitely, subject to
the restrictions in the Zoning Ordinance governing their continuation,
operation and expansion.
The appropriate manner in which to address this question is to refer to
public hearing a text amendment that would remove the subject
provisions from the Zoning Ordinance. Staff recommends that the
Board take that action. If the Board concurs with this
recommendation, a motion such as the following would be in order:

Motion to authorize and direct the Village Manager to petition for
a further text amendment that would repeal the amortization
provisions of the Zoning Ordinance.
Trustee Shumate voiced his concern for restricted parking and asked
for staff to review this area to see what type of parking takes place on
Wennes Court.
Motion by Trustee Shumate, seconded by Trustee Bartecki, to direct
staff to monitor a traffic study of the affected area and propose
restrictions, if necessary, for further review by the Tillage Board.
VOICE VOTE: Motion carried.
Trustee McInerney discussed that the issue of amortization provisions
has been before Village Boards in prior years. He recommended this
issue be resolved for the current businesses and zoning ordinances
that are enforceable now. The testimony the Village Board heard was
that the current ordinances are applicable to these businesses. If we
enact what was presented, we would refer this issue to the Zoning
Board of Appeals and Plan Commission. During their hearings,
maybe other issues would be discussed that the Village Board is not
aware of at this time.
Village Attorney Martens explained that the performance standards
are applicable to residential and business districts. If the Village
Board wishes to amend them, it is possible to do so.
Trustee McInerney noted if lie were an adjacent property owner, he
would want to know what is applicable.
President Bushy suggested the Plan Commission and Zoning Board of
Appeals could review this issue, and the Village Board review their
comments. The Village Attomey could discuss the amortization
provisions with the Boards as to what is legally feasible.
Trustee Bartecki recommended acting on Trustee Shumate's motion
and let the applicants pursue this issue.

Trustee Shumate asked for a tiveds analysis of the Gazebo building usage for
Village personnel and relocation of the DuPage Mayors and Managers,
President Bushy stated stafl'will present this to the Village Board in the next
two to four weeks,

President Bushy commented on twL areas of the Departmental Reports. With
respect to the Ethnic Fest Committee, a theme for its promotion of the event
has been selected. It is "A World Within a Village, Oak Brook".
The pool and tennis courts preparations are ahead of schedule for the 1996
reopening of the season. Green fees of $5,063 have been collected for the 1996
golf season with 352 rounds of golf already played for the season. The pro
shop sales have been excellent with a total of $6,415.
