Dean Board, Room of the Village Commons at 7 :33 p.m. Pledge of Allegiance was given. The Clerk called the roll with the following persons v PRESENT: President Bushy, Trustees Caleel, Kenny, McInerney, Savino and Shumate. ABSENT: Trustee Bartecki. IN ATTENDANCE: Stem B. Veitch, Village Manager; Michael A. Crotty, Assistant to the Village Manager; Dale L. Durfey, Jr., Village Engineer; Bruce F. Kapp Director of Information Services & Purchasing; Richard A. Martens, Village Attorney; Ruth A. Martin, Library Director; Bonnie Sartore, Batn and Tennis Club Manager; Trey VanDyke, Golf Club Manager Roberta Petz„ Library Commission Chairman; and Barbara Benezra and Anthony Ingrisano, Library Commission members. Roberta Petz, Library Commission Chairman, wished to place on record a commendation for Trustee McInerney for his service as Library Trustee. He Promoted library awaaeness at Village Board meetings and to the public. He spent many hours inter% iewing architects, speaking informatively of the Library and its services. Joseph Fullan, 122 Timberview Drive, voiced a concern with the proposed Oak Brook Road expansion and loss of trees. He inquired if the Village had budgeted for a replacement forestry project. Village Engineer Durfey explained that the Village is waiting for the final plans of the project from DuPage County. President Bushy indicated that tree replacement will occur, but there will be some tree loss due to the stormwater detention requirement. Harry Terlecki, 104 Canterberry Lane, requested Village Board action be taken to determine continuation or termination of the lease agreement between the Village of Oak Brook and the DuPage Mayors and Managers Conference for rental space at 1220 Oak Brook Road. The property would not be conducive for use by building and zoning staff, as some staff members are firefighters and would have to cross the street to the fire station. The present driveway is not part of the property, but the surrounding property owner permits its use. Trustee Savino suggested if the Village would lose the road through development of the surrounding property. it would render the property valueless. He inquired if the roadway property could be purchased. President Bushy indicated this could not be discussed at this time due to the current discussions of the surrounding property, Trustee Shumate explained that because of the nature of the DuPage Mayors and Managers, they are not able to pay rent. The facility was renovated at a cost of $250,000 to their organization that is amortized over the time of the lease. If the Village terminated the lease, the Village would be required to reimburse this expenditure- Trustee McInerney requested the Village Board to ask- the School District to schedule their events so as to not conflict with the regularly scheduled Village Board meetings. President Bushy noted the Village Board meeting dates have been standard for years. It was a consensus of the Village Board to request in writing the School District's consideration of scheduling their events so they do not conflict with the regularly scheduled Village Board meetings. President Bushy advised the public that the Village Board meeting will be televised on Channel 19 at 7:00 p.m. the following Monday of a regularly scheduled Village Board meeting. She welcomed our new Trustee, George• Caleel, and noted the newly arranged seating a ,signments. President Busher explained that since the Village Board meeting is being televised to our residents for the first time. the purpose of the Omnibus Agenda was to approve routine items and noted each agenda item. A taxi company license has been approved for issuance to AAA Universal, Inc. of Ehuhurst, pursuant to Section 8-42 of the Code of Ordinances. A taxi company license entitles any of the licensed company's cabs that are registered with the Village to originate trips in Oak Brook. The maximum number of cabs that may be registered is limited by Village ordinance and is presently 55. Pursuant to Section 8 -62 of the Code, AAA universal is requesting that the maximum number of registrations be increased. The company has provided endorsements for its entry into the market from hotels and major retailers in Oak: Brook. The principal purpose of licensing taxicab drivers individually is to permit a check of the criminal history and driving record of each applicant to be completed. Recently, due to regulations on the Village's use of the LEADS system and the fees charged by the Illinois State Police for background checks. the cost of the process has grown to exceed the fee charged for the license. Accordingly, the Village Clerk has recommended an increase in the fee for a taxi drivers license to cover the cost of the licensing process. F PUBLIC 1► The Village's existing ordinance is modeled after the Illinois Criminal Code. This ordinance is modeled after an Indiana statute which specifically prohibits public nudity. In a 5 to 4 plurality opinion, the United States Supreme Court upheld that Indiana statute. This ordinance strengthens the Village regulation of so- called adult uses. The Village ordinance presently prohibits the issuance of liquor licenses to so- called "gentlemen's clubs" or other establishments which allow exhibiting or exposing to public view various private portions of the human anatomy. The proposed amendment enlarges the prohibition to include all adult uses as defined in the ordinance. • It permits locked cabinets for the storage of liquor for the use of room guests in each room of a hotel, provided that the kf- for such a cabinet is given only to a guest 21 years of age or older. 3. Since this was significantly more than the Village wanted to spend for this project, staff chose to reject that bid, re- budget for 1997, and study any options. IL is designed to assist golf courses in meeting Federal and State environmental laws (Illinois law required the Village's compliance by January, 1993). To the best of staff's knowledge, this is a sole source product and similar products are not produced b_y any competitors at this time. Funds in the amount of $37,500 are budgeted in the Golf Course Maintenance Program (14 -8304) to cover this project. Staff estimates the total project cost to be $32,045 ($30,644.20 product cost, plus in- house expenses for crane rental, site preparation, and hook -up of water, gas and electricity). The intended location for this item is directly adjacent to the Golf Maintenance building. Motion by Trustee Kenny, seconded by Trustee Savino, to waive bidding due to sole source, and authorize the issuance of a purchase order to Eagle Container Corporation, Chillicothe, Illinois, for a rinsate%hemical storage complex, delivered to the Golf Maintenance facility, at a total price of $30,644.20. Competitive sealed bids were received on April 30, 1997 from six (6) companies. As indicated on the bid tabulation attached to Purchasing Director Kapff's memo dated May 9. 1997, staff recommends acceptance of some bids which were not the lowest submitted price (items #27, 33, 44, 45, 46). The lower priced items may have met Village specifications, however these bidders failed to submit the required samples for proposed substitutions (samples are required as part of the W, in order to avoid possible switching of samples following the bid opening once competitors' pricing is known). For items where there is a tie bid. staff plans to split the orders between both companies. Based on an analysis of last }Tear's purchases and current year estimated quantities, the Village should save approximately $2,500 by purchasing from these suppliers. The Village will no longer be paying additional shipping charges (free shipping is included in the bid prices). Bid prices are firm for the entire calendar yeah. There is no requirement that the Village purchase a set quantity. The Village retains the right to either increase or decrease quantities at its sole option. The Village has the option to purchase these same items through other sources, e.g_ in an emergency when an item is needed sooner than it can be supplied by the low bidder. Approximatety $30,000 has been budgeted in various accounts for the purchase of these items. The Agreement represents the current mechanism by which private alarm systems throughout the Village are monitored by the Village Communications Center. The alarm board located in the Communications Center is owned by SecurityLink from Ameritech, and residents and businesses may link their individual burglar or fire alarm systems to that board via telephone line. The resident or business pays an initial connection fee and a monthly monitoring fee (currently, $85 and $16. respectively) directly to SecurityLink, and the Village receives a portion of the monthly fee (currently, $4) in recognition of the fact that our Communications Operators monitor the board and dispatch alarm calls. The Agreement again has a five (5) year term. The initial connection fee has been increased to $105, and the monthly monitoring fee has been increased to $17 per month. Although the Agreement allows for increases in the monitoring fee based on the percent change in the CPI (with a cap of $1), no request for an increase can be made before May 1, 1999. The terms of the Agreement call for SecuritvLinlc to continually upgrade the alarm equipment so that it is the most modern and efficient system available. A mother and her four young children were transported to the hospital. All patients recovered. President Bushy noted that due to this incident, a letter from the Fire Chief will be mailed to all residents in Oak Brook highlighting the dangers of carbon monoxide poisoning. This is the second time in almost a year this has occurred where we almost lost a family to carbon monoxide poisoning. Residents may contact the Fire Department to determine if their home is properly regulated. LibmEy: Trustee Caleel - The Summer Reading Program, "Get in the Game ", will begin June 9, 1997. The Library will be participating in Oak Brook Day by having a computer set up to show the "dial -up from home" capability of iLhe new software system. The software that operates the Library's circulation, cataloging and public access catalog (that which used to be the "card catalog ") systems should be operational on May 19. 1997. Police: Trustee Shumate - Sergeant Donald E. Shaw retired from the Police Department effective April 26, 1997. Sgt. Shaw served the Village for 33 years. On May 8, 1997, Sergeant Edward Caspers announced his retirement from the Police Department. Sgt. Caspers was with the Department for 22 years. His last day will be Friday. May 23, 1997. The Police Department's on -site assessment is scheduled for May 17 -21, 1997. This is the final step in the accreditation process. During these five days, the assessors will make sure that the Department is in compliance with all 436 standards by checking the Department's General Orders for written compliance and checking the facility for visual compliance. They will also interview officers at random and probably request ride -a- longs. The recruitment process for the new Police Chief has begun. Advertisements will run in publications of the International Association of Chiefs of Police, the International City/County Management Association and the Illinois Municipal League. Applications will also be welcomed from within the Department. Public WQrk : Trustee Savino - Personnel from both the Water and Street divisions have been working on the restoration of parkways and paved areas due to water main breaks, curb inlet excavations and minor snow plow damage. Weather permitting, these restorations should be completed this month. Contract cleaning of the Village's street curb inlets has begun. This is an annual maintenance program wherein accumulated debris is removed from 25% of the 1,200 system -wide street inlets. This year's residential water meter replacement program has been completed. Additionally, 15 of the 30 large. commercial water meters have been tested and repaired to date. It is anticipated that the remaining 15 will be completed over the next few weeks. A. ]:.RANG I E AGREEMENT - AT &T: AT &T - FRANCHISE Representatives from AT &T present at the meeting were: Peter AGREEMENT Coules and Robin Charleston, Attorneys; and John Fisk, Engineer. Over a year ago AT &T approached the Village about permission to use public rights- of -«-ay to establish a fiber optics network for local access to certain targeted customers within the Village. Those discussions have proceeded with significant progress. AT&T has permission to compete with Ameritech and other local service providers. Consequently, AT&T has requested permission to lay certain fiber optic fibers for local access to predominantly large business customers. As economic conditions allow. AT&T has indicated an interest in expanding its local access facilities. The dram Non - Exclusive Franchise Agreement is modeled after a form of franchise agreement recommended by the DuPage Mayors and Managers Conference. Staff had significant input in drafting the model agreement. Most of the provisions in the AT &T Agreement are the same or substantially similar to the Village's existing agreements with MFS and MCI. There are two principal provisions which are different from earlier franchise agreements: 1. The franchise fee set forth in Section 4 (located on pages 5 through 11 of the draft agreement) provides for the provisions of two (2) pairs of fiber optics for Village use and a sliding scale of access line fees. This provision provides that in the event that the State of Illinois enacts legislation providing for a so- called infrastructure maintenance fee and provided further that Ameritech agrees to waive its $0.38 per line access fee to the Village in favor of the infrastructure maintenance fee, then AT&T will likewise waive its access line fees to the Village in favor of the infrastructure maintenance fee. In essence, the infrastructure maintenance fee is 1% of the company's gross charges within the Village. 2. The term of this agreement is approximately five (5) years to coincide urith the expiration of the Ameritech franchise agreement.
